The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>341, 324, 326 and 307 read with 149 of the Indian Penal Code.<\/p>\n<p>Petitioner is the fifth accused.\n<\/p>\n<p>       3. Learned counsel for petitioner submitted that the other<\/p>\n<p>accused are granted bail by the learned Magistrate. The bail bond<\/p>\n<p>was cancelled subsequently in violation of the conditions and they<\/p>\n<p>were released on anticipatory bail by the Sessions Court later.<\/p>\n<p>Though the petitioner moved the Sessions Court for anticipatory<\/p>\n<p>bail, it was dismissed as per Annexure A2 order.<\/p>\n<p>       4. Learned Public Prosecutor submitted that the charge sheet<\/p>\n<p>is already laid on 30.4.2008. The incident occurred as early as on<\/p>\n<p>21.4.2006, about two years back. Petitioner was shown as<\/p>\n<p>absconding since he was not available for arrest. Learned counsel<\/p>\n<p>for petitioner submitted that actually he was not absconding.<\/p>\n<p>       5. On hearing both sides, I find that at the present stage of<\/p>\n<p>the case, since the charge sheet has been filed, petitioner may<\/p>\n<p>approach the lower court for appropriate relief.
