The   present   petition   has   been   preferred   for   getting<br \/>\n     salary\/honorarium for the post of a Teacher of Kasturba<br \/>\n     Gandhi Awasiya Balika Uchh Vidyalaya, Kundahit, District-<br \/>\n     Dumka, mainly on the ground that though the petitioner is a<br \/>\n     Para-Teacher, but, the work of a Teacher was taken from<br \/>\n     him by the said school and, therefore, so long as the<br \/>\n     petitioner was deputed in Kasturba Gandhi Awasiya Balika<br \/>\n     Uchh Vidyalaya, Kundahit, District- Dumka, she ought to be<br \/>\n     paid honorarium of a Teacher.\n<\/p>\n<p>2.   I have heard learned counsel for the respondents, who has<br \/>\n     submitted that a counter affidavit has been filed, wherein, it<br \/>\n     has been stated that the petitioner was originally appointed<br \/>\n     as Para-Teacher and, thereafter, upon deputation, she was<br \/>\n     directed to work as Para-Teacher, at Kasturba Gandhi<br \/>\n     Awasiya Balika Uchh Vidyalaya, Kundahit, District- Dumka,<br \/>\n     as per Annexure 1 to the memo of petition. Thus, the status<br \/>\n     of the present petitioner was never changed from Para-<br \/>\n     Teacher to a Teacher. It is also submitted by the learned<br \/>\n     counsel for the respondent-State that the petitioner was paid<br \/>\n     all the legally payable dues to a Para-Teacher, but, the<br \/>\n     higher claim of the petitioner is not tenable, at law, because<br \/>\n     the petitioner was never appointed as a Teacher and never<br \/>\n     she has been selected or interviewed for the post of a<br \/>\n     Teacher and, therefore, this writ petition deserves to be<br \/>\n     dismissed.\n<\/p>\n<p>3.   Having heard learned counsel for both the sides and looking<br \/>\n     to the facts and circumstances of the case, it appears that<br \/>\n<span class=\"hidden_text\">                                          2.<\/span>\n<\/p>\n<p>             (i)     the petitioner was originally appointed as a Para-\n<\/p>\n<blockquote><p>                     Teacher and was deputed at Kasturba Gandhi Awasiya<br \/>\n                     Balika Uchh Vidyalaya, Kundahit, District- Dumka, as<br \/>\n                     Para-Teacher by order dated 15th September, 2007,<br \/>\n                     which is at Annexure 1 to the memo of petition, and,<br \/>\n                     thereafter, the petitioner has worked at Kasturba<br \/>\n                     Gandhi Awasiya Balika Uchh Vidyalaya, Kundahit,<br \/>\n                     District- Dumka, as a Para-Teacher;\n<\/p><\/blockquote>\n<p>             (ii)    the petitioner was paid salary, which is legally payable<br \/>\n                     to a Para-Teacher and there is no dispute so far as this<br \/>\n                     aspect of the matter is concerned;\n<\/p>\n<p>             (iii)   the petitioner expects her appointment as a regular<br \/>\n                     Teacher, being qualified for it, and is also expecting<br \/>\n                     honorarium, which is legally payable to the post of a<br \/>\n                     Teacher. So far as the claim of honorarium for the post<br \/>\n                     of a Teacher is concerned, it is not payable to the<br \/>\n                     petitioner, because the petitioner was originally a<br \/>\n                     Para-Teacher and she was deputed as a Para-Teacher<br \/>\n                     at Kasturba Gandhi Awasiya Balika Uchh Vidyalaya,<br \/>\n                     Kundahit, District- Dumka, and she has also been<br \/>\n                     paid the honorarium, which is legally payable to a<br \/>\n                     Para-Teacher. Thus, there is no legal vested right in<br \/>\n                     this petitioner to get honorarium, which is legally<br \/>\n                     payable to a Teacher, because the petitioner was never<br \/>\n                     appointed as a Teacher, at the said school. Never by<br \/>\n                     deputation, the petitioner, who is a Para-Teacher, is<br \/>\n                     elevated to the post of or made equivalent to a Teacher<br \/>\n                     and, therefore, she is also not entitled for honorarium<br \/>\n                     or salary, payable to a Teacher.\n<\/p>\n<p>      3.     In view of the aforesaid observations, there is no substance<br \/>\n      in this writ petition, which is hereby dismissed.\n<\/p>\n<p>                                                        (D.N.
