Justice M.SASIDHARAN NAMBIAR\n\n Dated :14\/08\/2008\n\n O R D E R\n              M.Sasidharan Nambiar,J.\n              =======================\n               C.R.P No.631 of 2008\n              =======================\n      Dated this the 14th day of August, 2008\n\n                     O R D E R\n<\/pre>\n<p>    This  petition  is   filed  by   respondent  in<\/p>\n<p>O.P.62\/2003 on the file of Sub Court, Thalassery<\/p>\n<p>under  section  115  of  Code  of  Civil  Procedure<\/p>\n<p>challenging the order passed by the Sub Judge<\/p>\n<p>permitting   respondent to sue      as an indigent<\/p>\n<p>person.  When the O.P was originally allowed and<\/p>\n<p>respondent was permitted to sue as an indigent<\/p>\n<p>person,  petitioner  filed  C.R.P.1317\/2004  before<\/p>\n<p>this court contending that respondent is not an<\/p>\n<p>indigent person and permission should not have been<\/p>\n<p>granted.   Under Ext.A1 judgment dated 24.2.2006,<\/p>\n<p>the earlier order was set aside and     trial court<\/p>\n<p>was directed to reconsider the question afresh.<\/p>\n<p>Learned Sub Judge thereafter passed the impugned<\/p>\n<p>order dated 25.3.2008 permitting  respondent to sue<\/p>\n<p>as an indigent person and converted the petition to<\/p>\n<p>a suit.  It is challenged in this revision petition<\/p>\n<p><span class=\"hidden_text\">CRP No.631\/2008             2<\/span><\/p>\n<p>contending that learned Sub Judge did not properly<\/p>\n<p>consider Annexure A2        report submitted by the<\/p>\n<p>Tahsildar, Thalassery disclosing that respondent is<\/p>\n<p>having sufficient properties.\n<\/p>\n<p>     2.      Learned counsel appearing for petitioner<\/p>\n<p>was heard.\n<\/p>\n<p>     3. The argument of the learned counsel is that<\/p>\n<p>under Annexure A1 order      this court set aside the<\/p>\n<p>earlier order as it was found that            question<\/p>\n<p>whether respondent has disclosed all the properties<\/p>\n<p>were not properly considered by the learned Sub<\/p>\n<p>Judge and only     report of the Tahsildar, Kannur was<\/p>\n<p>obtained       and no  report   from  the   Tahsildar,<\/p>\n<p>Thalassery was obtained and when Annexure A2 report<\/p>\n<p>submitted       by  the   Tahsildar   establish   that<\/p>\n<p>respondent is having other properties permission<\/p>\n<p>should not have been granted.\n<\/p>\n<p>     4.     On hearing the learned counsel and going<\/p>\n<p>through the impugned order, I do not find any<\/p>\n<p>illegality or irregularity warranting interference.<\/p>\n<p>     The learned Sub Judge has considered the aspect<\/p>\n<p><span class=\"hidden_text\">CRP No.631\/2008          3<\/span><\/p>\n<p>in the proper perspective and found that respondent<\/p>\n<p>is not owning property or other means sufficient<\/p>\n<p>enough to pay the court fee.
