Patel appearing on behalf of appellants,<br \/>\nlearned AGP Mr. Amit Patel appearing on behalf of respondent No.2 ?<br \/>\nState Authority and learned advocate Ms. Megha Jani appearing on<br \/>\nbehalf of respondent No.3 ?  Insurance Company.\n<\/p>\n<p>2.\tThese<br \/>\ntwo appears are filed by appellants ?  claimants for enhancement on<br \/>\nthe ground that disability certificate which has been produced by<br \/>\nclaimant before Claims Tribunal though advocate of the Insurance<br \/>\nCompany has accepted it and not awarded any amount of compensation by<br \/>\nClaims Tribunal. Therefore, according to him, Claims Tribunal has<br \/>\ncommitted gross error in awarding any compensation on the basis of<br \/>\ncertificate of permanent disability given by Doctor. Except that,<br \/>\nlearned advocate Mr. Patel for appellants has not made any other<br \/>\nsubmissions before this Court in both appeals.\n<\/p>\n<p>3.\tI<br \/>\nhave considered the submissions made by all the learned advocates<br \/>\nappearing on behalf of respective parties. The discussion in respect<br \/>\nto present appellant ?  Jayshreeben is made at Page 12 Para 24 that<br \/>\ncertificate of permanent disability was produced by claimant vide<br \/>\nExh.34\/1, where, 15% disability is assessed by Doctor, but, in<br \/>\ncertificate which kind of permanent disability is received by<br \/>\nclaimant is not mentioned and merely receiving injury in vehicular<br \/>\naccident is not enough to have the certificate of permanent<br \/>\ndisability upto 15%. According to Claims Tribunal, whatever injury<br \/>\nmentioned in disability certificate is not in accordance with primary<br \/>\ninjury received by claimant. The applicant has reduced disability<br \/>\nfrom 15% to 7.5% by Exh.66 purshis, but, Claims Tribunal has come to<br \/>\nconclusion  that looking to primary injury received by claimant where<br \/>\nthere is no permanent disability is found from claimant received in<br \/>\nthe accident. No doubt, advocate of Insurance Company has accepted<br \/>\n7.5% disability to be considered, but, ultimately, Claims Tribunal<br \/>\nhas independently examined the issue that whether claimant has<br \/>\nreceived permanent disability or not. The Doctor was not examined,<br \/>\ntherefore, this certificate was not proved before Claims Tribunal.<br \/>\nThe certain discharge papers have been produced by Claims Tribunal<br \/>\nfrom Safi Hospital and Claims Tribunal has also considered that there<br \/>\nis no fracture of head injury and only on the leg C.L.W. injury is<br \/>\nfound which cannot consider to be a permanent disability and<br \/>\ntherefore, Claims Tribunal has not awarded any amount of compensation<br \/>\nin favour of claimant in respect to medical certificate which has<br \/>\nbeen produced by claimant before Claims Tribunal vide Exh.34\/9.\n<\/p>\n<p>4.\tSimilarly,<br \/>\nin case of Venilal ?  father of Jayshreeben, certificate of 15%<br \/>\ndisability given by same Doctor Khatri vide Exh.50\/2 which has been<br \/>\nalso examined by Claims Tribunal while considering the case papers<br \/>\nExh.52, where, there is no fracture on 4th and 5th<br \/>\nrib of claimant. Therefore, considering that Doctor was not examined<br \/>\nby claimant and by purshis 67, 15% disability is considered 7.5% with<br \/>\nconsent of other side, but, Claims Tribunal has examined the matter<br \/>\nindependently and according to Claims Tribunal, primary injury which<br \/>\nhas ben received by claimant where there is no fracture found on the<br \/>\nrib by Claims Tribunal considering the papers Exh.52.\n<\/p>\n<p>5.\tTherefore,<br \/>\naccording to my opinion, Claims Tribunal has rightly examined the<br \/>\nmatter while considering the certificate of both cases in absence of<br \/>\nDoctor. The Claims Tribunal has examined the case papers and from<br \/>\ncase papers, there was no permanent disability found by Claims<br \/>\nTribunal. Accordingly, no amount has been awarded for such permanent<br \/>\ndisability which cannot consider to be erroneous and therefore,<br \/>\naccording to my opinion, Claims Tribunal has rightly not awarded<br \/>\ncompensation for permanent disability which claimed by claimants in<br \/>\nboth the cases.\n<\/p>\n<p>6.\tTherefore,<br \/>\nthere is no substance in the present appeals.
