This petition has been filed by the All<br \/>\nIndia Democratic Women&#8217;s Association, petitioner No. 1<br \/>\nand Ms. Urmila Punera, petitioner No. 2, who happens to<br \/>\nbe a resident of the premises\/hostel in question,<br \/>\nnamely, New Maharashtra Sadan, Kasturba Gandhi Marg,<br \/>\nNew Delhi. Petitioners in the writ petition have<br \/>\nsought the following relief:-\n<\/p>\n<p> (i) to issue an appropriate write or order<br \/>\nrestraining all the respondents including<br \/>\nrespondent Government of Maharashtra from<br \/>\ndemolishing any of the blocks of buildings A-E<br \/>\nin the premises now known as New Maharashtra<br \/>\nSadan and to maintain the status quo;\n<\/p>\n<p> (ii) to call for the respondent Ministry&#8217;s<br \/>\nfile ref. to in Annex-P-3-communication viz; M\/O<br \/>\nUrban Affairs and Employment (lands Division)\n<\/p>\n<p>&#8211; vide Ministry&#8217;s letter No. J-13022\/1\/78\/L-II<br \/>\n(vol. II) dated 24.3.1999.\n<\/p>\n<p> (iii) to allow the petitioners to inspect the<br \/>\nfile in the light of freedom of information<br \/>\nBill 2000;\n<\/p>\n<p> (iv) declaring that the building &amp; property of<br \/>\n6 acres covered by Annex-P3 communication<br \/>\ndated 16.6.1999 belong to Govt. of India and<br \/>\nnot to Govt. of Maharashtra and that the<br \/>\nalleged transfer of property is of no legal<br \/>\nconsequence or force;\n<\/p>\n<p> (v) that meanwhile the property be duly<br \/>\nmaintained in good repair by respondent Govt.<br \/>\nof Maharashtra with hygiene and sanitary care<br \/>\nwith necessary night lighting;\n<\/p>\n<p> (vi) if the transfer is declared illegal, to<br \/>\ndirect that the property be handed over to<br \/>\nrespondent National Commission for women to<br \/>\nbuild its own office along with a women&#8217;s<br \/>\ncomplex with women&#8217;s media centre and a<br \/>\nworking women&#8217;s hostel and other facilities<br \/>\nexclusively for women&#8217; <\/p>\n<p> (vii) to pass such other or further order<br \/>\ndeemed fit and proper.\n<\/p>\n<p> 2. This writ petition has had a chequered<br \/>\nhistory. For a considerable period of time, by making<br \/>\nof numerous miscellaneous applications, the progress<br \/>\nand disposal of the main writ petition was digressed.<br \/>\nAs the writ petition was listed today for disposal, I<br \/>\nhave heard counsel for the parties.\n<\/p>\n<p> 3. As regards relief Nos. (ii) and (iii),<br \/>\nthese have already been granted and records were made<br \/>\navailable and counsel for the petitioner also had the<br \/>\ninspection of the records of respondents. Regarding<br \/>\nthe first prayer that blocks of buildings A-E be not<br \/>\ndemolished, learned counsel for respondent\/State of<br \/>\nMaharashtra has submitted that State of Maharashtra<br \/>\ndoes not plan to demolish the building till the<br \/>\nproceedings under the Public Premises (Eviction of<br \/>\nUnauthorised Occupants) Act, 1971 (in short PP Act,<br \/>\n1971) are concluded. It is clarified by her that<br \/>\nportions of the building, where the allottees or<br \/>\noccupants have been evicted may be taken up for<br \/>\ndemolition and reconstruction in accordance with law.<br \/>\nThe relief No. (iv), as sought by the petitioner is<br \/>\nthat the building and property be declared to be<br \/>\nbelonging to the Government of India and not to the<br \/>\nState Government of Maharashtra. I am afraid such a<br \/>\ndeclaration cannot be given at the behest of<br \/>\npetitioner No. 1, who itself has no locus and<br \/>\npetitioner No. 2, who happens to be an<br \/>\nallottee\/unauthorised occupant, facing proceedings<br \/>\nunder the Public Premises (Eviction of Unauthorised<br \/>\nOccupants) Act, 1971. In writ jurisdiction, this<br \/>\nCourt will not embark on determination of question of<br \/>\ntitle. Learned counsel for the petitioner in her<br \/>\nattempt to submit that the State of Maharashtra was<br \/>\nnot the legal owner and was not lawfully entitled to<br \/>\ninstitute proceedings against petitioner No. 2 and<br \/>\nother occupants, submitted that Union of India itself<br \/>\nwas not clear on whether the property belongs to the<br \/>\nState of Maharashtra or not. According to her,<br \/>\nopinion has been expressed by certain functionaries of<br \/>\nL&amp;DO that the property does not belong to the State of<br \/>\nMaharashtra. She submits that the Central Government<br \/>\nin its counter affidavit had not denied the<br \/>\nallegations made in petition and, therefore, it be<br \/>\ndeemed to have accepted the allegations of the<br \/>\npetitioners. She also submitted that the response of<br \/>\nthe Central Government and the State of Maharashtra<br \/>\nwas not adequate inasmuch the affidavit had been filed<br \/>\nby an Engineer, who was not competent or conversant<br \/>\nwith the facts. She submits that the understanding<br \/>\nwas that the present building would be maintained as<br \/>\nwomen&#8217;s hostel.\n<\/p>\n<p> 4. Learned counsel for the respondent in<br \/>\nrebuttal has urged that the Union of India has<br \/>\ntransferred the property on &#8220;As is Where is Basis&#8221;.<br \/>\nIn this connection, he refers to the communication<br \/>\ndated 29.12.1998, by which a decision was taken to<br \/>\nrestore possession to the State of Maharashtra.<br \/>\nReceipt for formal handing over of possession was<br \/>\nissued on 24.3.1999. It would be relevant to<br \/>\nreproduce the extract from the letter dated<br \/>\n29.12.1998:-\n<\/p>\n<p>  &#8220;Keeping in view that the property by law is<br \/>\nvested in Govt. of Maharashtra, I am directed<br \/>\nto convey the approval of the President of<br \/>\nIndia for the restoration of possession of<br \/>\nabout 6 acres of land know as Sirmur plot as<br \/>\nshow in L &amp; DO plan No. 163 at K.G. Marg, to<br \/>\nGovt. of Maharashtra.\n<\/p>\n<p> The possession of the land will be handed over<br \/>\nto Govt. of Maharashtra only after relocation<br \/>\nof the occupants at the cost of State<br \/>\nGovt. C.P.W.D.\/Directorate\/Estate will take all<br \/>\nsteps to evict all those, if necessary by<br \/>\nre-locating them elsewhere, who are under<br \/>\ntheir control, or those whom Govt. has let<br \/>\ninto use or possession.&#8221;\n<\/p>\n<p> On a perusal of the foregoing, it would be<br \/>\nseen that the Union of India has taken care to ensure<br \/>\nthat provision is made for relocation of the occupants<br \/>\nat the cost of State\/CPWD with stipulation that steps<br \/>\nwill be taken for relocation of the occupants.<br \/>\nMs. Lily Thomas, counsel for the petitioner submitted<br \/>\nthat building in question ought to be retained as<br \/>\nwomen&#8217;s hostel and grave hardship would be caused to<br \/>\nthe women, if they are evicted. The plea is without<br \/>\nsubstance. Firstly, proceedings for eviction have<br \/>\nbeen initiated under the P.P. Act, 1971 are separately<br \/>\npending. It would be for such of the occupants, who<br \/>\nwant to defend their occupation to take such pleas, as<br \/>\nare available at law in contesting the proceedings.<br \/>\nSecondly, there is considerable merit in the<br \/>\nsubmission of Mr. Mahinder Singh that some of the<br \/>\noccupants have been occupying premises for<br \/>\nconsiderable period of time for more than one or two<br \/>\ndecades are public interest purpose is best served by<br \/>\nsuch hostels functioning as transit accommodation.<br \/>\nHowever, it is not necessary for me to express any<br \/>\nopinion on this aspect. The writ petition is not<br \/>\nmaintainable on the short ground of it seeking<br \/>\nessentially a declaration in respect of title in<br \/>\nproperty, which cannot be adjudicated upon in writ<br \/>\nproceedings.
