M. Shah, learned Assistant Government Pleader, appearing on<br \/>\n\tbehalf of the appellant referred to the averments made in the<br \/>\n\tmemorandum of the application to submit that the delay has been duly<br \/>\n\texplained and sufficient cause has been made out for condoning the<br \/>\n\tdelay. In the circumstances, the application deserves to be allowed<br \/>\n\tby condoning the delay.\n<\/p>\n<p>On<br \/>\n\tthe other hand, opposing the application, Mr. Deep D. Vyas, learned<br \/>\n\tadvocate for the respondent submitted that all that is stated in the<br \/>\n\tmemorandum of the application is as to how the file moved from table<br \/>\n\tto table. It was submitted that on a perusal of the averments made<br \/>\n\tin the application it is apparent that the applicants have not<br \/>\n\tthought it fit to apply for the certified copy of the judgment till<br \/>\n\tas late as on 15th<br \/>\n\tFebruary, 2011. It was submitted that merely because the applicant<br \/>\n\tis a State Government, it is not that in every case the delay has to<br \/>\n\tbe condoned and that the applicants having failed to sufficiently<br \/>\n\texplain the delay that has occasioned in filing the second appeal,<br \/>\n\tthe delay does not deserve to be condoned. In support of his<br \/>\n\tsubmission,  the learned advocate placed reliance upon the<br \/>\n\tdecision of the Supreme Court in the case of Lanka<br \/>\n\tVenkateshwarlu (D) by L.Rs. V\/s. State of A.P. &amp; Ors.,<br \/>\n\tAIR 2011 SC 1199,<br \/>\n\tfor the<br \/>\n\tproposition that the concepts such as &#8220;liberal approach&#8221;,<br \/>\n\t&#8220;justice-oriented approach&#8221;, &#8220;substantial justice&#8221;<br \/>\n\tcannot be employed to jettison the substantial law of limitation. It<br \/>\n\twas submitted that in the facts and circumstances of the case, the<br \/>\n\trespondents having failed to satisfactorily explain the delay that<br \/>\n\thad occasioned in filing the second appeal, there is no reason for<br \/>\n\tthe Court to adopt a liberal approach and condone the delay. It was<br \/>\n\tsubmitted that the application, therefore, deserves to be rejected.\n<\/p>\n<p>A<br \/>\n\tperusal of the averments made in the memorandum of the application<br \/>\n\tindicates that the judgment and decree passed by the learned<br \/>\n\tAdditional District Judge, Porbandar, in Regular Civil Appeal No.20<br \/>\n\tof 2006 came to be pronounced on 30th<br \/>\n\tOctober, 2010. Thereafter, the District Government Pleader vide<br \/>\n\tletter dated 13th<br \/>\n\tDecember, 2010 forwarded his opinion to the Deputy Secretary, Legal<br \/>\n\tDepartment recommending that an appeal be preferred in the matter.<br \/>\n\tOn 1st<br \/>\n\tJanuary, 2011, the Legal Department instructed the Deputy Secretary,<br \/>\n\tHealth and Family Welfare Department to forward a report under Rules<br \/>\n\t54 and 55 of the Law Officers Rules. The said letter of the Legal<br \/>\n\tDepartment came to be received in the branch dated 13.1.2011. On<br \/>\n\t15.1.2011 the letter of the Legal Department came to be entered in<br \/>\n\tthe Register and on 18.1.2011, the Deputy Section Officer prepared a<br \/>\n\tnote for obtaining sanction from the Legal Department for preferring<br \/>\n\tan appeal in the matter as<br \/>\n\topined by the District Government Pleader. On 24th<br \/>\n\tJanuary, 2011, the Section Officer put up a note to the Under<br \/>\n\tSecretary who on 27th<br \/>\n\tJanuary, 2011 submitted the file to the Law Officer of the<br \/>\n\tDepartment, who thereafter, submitted the file to the Joint<br \/>\n\tSecretary, who in turn, placed the file before the Principal<br \/>\n\tSecretary. On 28th<br \/>\n\tJanuary, 2011, the Principal Secretary forwarded the file to the<br \/>\n\tSecretary, Legal Department for according the sanction for filing an<br \/>\n\tappeal in the matter and on 10.2.2011, the Legal Department, by<br \/>\n\tpassing a Government Resolution in this regard, took a decision to<br \/>\n\tfile an appeal. On 14.2.2011 Government Pleader&#8217;s Office received<br \/>\n\tthe Government Resolution instructing the Government Pleader to file<br \/>\n\tan appeal in the matter. However, the same was not accompanied by a<br \/>\n\tcertified copy of the judgment and decree. The Office of the<br \/>\n\tGovernment Pleader, therefore, addressed a telegram dated 15.2.2011<br \/>\n\tto the concerned department for sending the certified copy of the<br \/>\n\tjudgment and decree. It appears that thereafter the certified copy<br \/>\n\tof the judgment and decree came to be applied for on 21.2.2011,<br \/>\n\twhich came to be delivered on 23.2.2011 and was received by the<br \/>\n\tOffice of the Government Pleader, High Court on 1st<br \/>\n\tMarch, 2011. It appears that thereafter, some time was consumed in<br \/>\n\tdrafting the memorandum of appeal and the second appeal ultimately<br \/>\n\tcame to be filed on 2nd<br \/>\n\tApril, 2011.\n<\/p>\n<p>In<br \/>\n\tthe light of the facts noted herein above, it is apparent that no<br \/>\n\tsooner than the opinion of the Government Pleader was received by<br \/>\n\tthe Legal Department, steps have<br \/>\n\tbeen taken for filing the appeal. From the averments made in the<br \/>\n\tapplication, it cannot be said that there was any deliberate<br \/>\n\tnegligence on the part of the applicants or that the applicants had<br \/>\n\tat any point of time given up the cause. In the circumstances, in<br \/>\n\tthe opinion of this Court, sufficient cause has been made out for<br \/>\n\tfiling the appeal beyond the prescribed period of limitation. The<br \/>\n\tdecision of the Supreme Court in the case of Lanka<br \/>\n\tVenkateswarlu<br \/>\n\t(supra) on which reliance has been placed by the learned advocate<br \/>\n\tfor the respondent does not in any manner support the case of the<br \/>\n\trespondent inasmuch as in the facts of the said case, there was a<br \/>\n\tgross delay in filing the appeal and the High Court while condoning<br \/>\n\tthe delay had observed that in the normal case the High Court would<br \/>\n\thave thrown out the application without having a second thought in<br \/>\n\tthe matter. It was in the peculiar facts of the said case that the<br \/>\n\tSupreme Court observed that it was at a loss to fathom any logic or<br \/>\n\trationale, which could have impelled the High Court to condone the<br \/>\n\tdelay after holding the same to be unjustifiable. The facts of the<br \/>\n\tpresent case stand on totally different footing from the facts of<br \/>\n\tthe said case.\n<\/p>\n<p>As<br \/>\n\tnoticed hereinabove, the delay of 64 days in filing the second<br \/>\n\tappeal has been satisfactorily explained by the applicants. In the<br \/>\n\tcircumstances, the application is allowed. The delay of 64 days that<br \/>\n\thas occurred in filing Second Appeal (Stamp) No.57 of 2011 is hereby<br \/>\n\tcondoned.
