No.115 of 2010\n    ------------------------------------------------\n     Dated this the 26th day of October, 2010\n\n                       ORDER\n<\/pre>\n<p>Pius C. Kuriakose, J<\/p>\n<p>      By our order dated 01\/06\/10 we held that<\/p>\n<p>there is no serious infirmity about the impugned<\/p>\n<p>judgment of the Appellate Authority except to the<\/p>\n<p>extent the Appellate Authority granted relief to the<\/p>\n<p>respondent without imposing any condition. It was<\/p>\n<p>for the purpose of imposing suitable conditions<\/p>\n<p>that notice was issued to the respondent. Even<\/p>\n<p>though notice is served on the respondent, she<\/p>\n<p>has not entered appearance before this Court.<\/p>\n<p>     2.   Having     heard    the    submissions    of<\/p>\n<p>Sri.B.Krishnan,   the learned counsel          for the<\/p>\n<p>revision petitioner, we are of the view that the<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.115 of 2010         -2-<\/span><\/p>\n<p>       impugned judgment of the Appellate Authority can<\/p>\n<p>       be    modified   by  incorporating    the  following<\/p>\n<p>       conditions:-\n<\/p>\n<p>             1) The respondent\/tenant is directed to<\/p>\n<p>       collect D.Ds for Rs.2,80,000\/- dt.01\/02\/08, for<\/p>\n<p>       Rs.17,000\/- dt.05\/02\/08, and for Rs.41,800\/-<\/p>\n<p>       dt.07\/02\/08 produced before the Rent Control<\/p>\n<p>       Court and reckoned with by the Appellate<\/p>\n<p>       Authority for granting relief to the respondent and<\/p>\n<p>       produce re-validated DDs or fresh DDs for the<\/p>\n<p>       same amount within a period of one month of this<\/p>\n<p>       order being communicated to her. She will also<\/p>\n<p>       pay a sum of Rs.10,000\/- to the revision<\/p>\n<p>       petitioner as cost within the above period.<\/p>\n<p>             The impugned judgment of the Appellate<\/p>\n<p>       Authority will become operative only if the above<\/p>\n<p>       conditions are complied with strictly. If the<\/p>\n<p><span class=\"hidden_text\">R. C. R. No.115 of 2010        -3-<\/span><\/p>\n<p>       conditions are not complied with the judgment of<\/p>\n<p>       the Appellate Authority will stand set aside and<\/p>\n<p>       the order of the Rent Control Court will stand<\/p>\n<p>       restored. The revision petitioner is directed to<\/p>\n<p>       send a copy of this order as and when he receives<\/p>\n<p>       the      same    by    Registered    Post   with<\/p>\n<p>       acknowledgment due to the respondent\/landlady<\/p>\n<p>       and produce the postal acknowledgment card<\/p>\n<p>       before the Rent Control Court.
