THE SARPANCH   BIJHARURA PANCHAYAT , UNDER ITADHI BLOCK, BUXAR\n                                   -----------\n<\/pre>\n<p>2\/   16\/11\/2010                Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the State.\n<\/p>\n<p>                               The petitioner claims to have been selected<\/p>\n<p>                  and appointed as a Nyayamitra in the Gram Kutchery,<\/p>\n<p>                  Bijhorura Panchayat under the Itarhi and joined as such<\/p>\n<p>                  on 18.12.2007. He further asserts that he is working<\/p>\n<p>                  since then but is not being paid his salary for which he<\/p>\n<p>                  has   represented   before   the   District   Magistrate   on<\/p>\n<p>                  19.3.2009.\n<\/p>\n<p>                               The appointment of Nyayamitras is regulated<\/p>\n<p>                  by the Bihar Gram Kutchery Nyayamitra (Appointment,<\/p>\n<p>                  Service Conditions and Duties) Rules, 2007. Rule-8<\/p>\n<p>                  provides for the payment of wages to Nyayamitras. Rule-9<\/p>\n<p>                  prescribes the procedure by which the appointment is to<\/p>\n<p>                  be made. Rule-11 provides the procedure for disciplinary<\/p>\n<p>                  action against a Nyayamitra. Rule-12 prescribes the<\/p>\n<p>                  procedure for any complaint with regard to matters<br \/>\n<span class=\"hidden_text\">                    -2-<\/span><\/p>\n<p>related to appointment before the Sub-divisional Officer.<\/p>\n<p>He is required to dispose it within a maximum period of<\/p>\n<p>30 days. There can be no doubt that a claim for salary<\/p>\n<p>arising out of an appointment as              a Nyayamitra is a<\/p>\n<p>matter related to the appointment and stands fully<\/p>\n<p>covered by Rule-12.\n<\/p>\n<p>            Though Rule-12 provides for a limitation of 30<\/p>\n<p>days for raising of any claims, the denial of salary is a<\/p>\n<p>continuing cause of action month to month. The Court<\/p>\n<p>therefore directs the petitioner to file an application<\/p>\n<p>before the Sub-divisional Officer within a period of 30<\/p>\n<p>days from today. It he does so, the Sub-divisional Officer<\/p>\n<p>is directed to dispose off his application in accordance<\/p>\n<p>with law within a maximum period of 30 days provided in<\/p>\n<p>Rule-12    from   the    date   of    presentation      of   such<\/p>\n<p>application.\n<\/p>\n<p>            If the Sub-divisional Officer finds justification<\/p>\n<p>in the claim or in any part of the claim, he shall issue<\/p>\n<p>necessary directions for payment of salary within a<\/p>\n<p>specified period. In the alternative, any order to the<\/p>\n<p>prejudice of the petitioner has to be reasoned and<\/p>\n<p>speaking in nature.\n<\/p>\n<p>            In the event that the Sub-divisional Officer<\/p>\n<p>finds   justification    in   the    claim,     the   petitioner&#8217;s<\/p>\n<p>appointment has not been interfered with and he is<br \/>\n<span class=\"hidden_text\">                        -3-<\/span><\/p>\n<p>     discharging duties, the Sub-divisional Officer shall issue<\/p>\n<p>     notice to the concerned who, according to him, are<\/p>\n<p>     answerable for withholding the salary of the petitioner.<\/p>\n<p>     Thereafter, the Sub-divisional Officer shall proceed to<\/p>\n<p>     recover the cost of the present litigation incurred by the<\/p>\n<p>     State Government from the salary of the concerned quite<\/p>\n<p>     apart from the question of proceeding departmentally<\/p>\n<p>     against the delinquent concerned, if the situation so<\/p>\n<p>     warrants.\n<\/p>\n<p>                 The writ application stands disposed.<\/p>\n<pre>KC                              ( Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Vinod Kumar vs The State Of Bihar &amp;Amp; Ors on 16 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.5111 of 2010 1.
