I have heard the arguments \n\nMaheshwara, learned Counsel for the \n\nNo.7632\/2009, Sri.S \\\/ivei<ananda., learnecl 'c\u00a7ps%:seVl'Ctro\u00a7;thre A '\n\nappellant in MFA No.7898\/2009 \n\nlearned Counsel for the resporidentd"claim_ant_ in__:"botl*\u00e9 the'-it\n\nappeals.\n\n3. At   learned\nCounsel for  contends that the\nappeal"ofthe;:tnsu3:"an'ceAV"Cornp'a~ny\u00a7 (MFA No.7632\/2009) is\nnot  reason that the Insurance\n\nCompany' not obtain\u00ab...leave of the Claims Tribunal under\n\n   of 't'hev..M.\\.f' Act, 1988. The records disclose that\n\n ' thi'sV.apvp:el|'_'an:t' Insurance Company did not obtain leave of\n\nthe"l'CIainiVs'j__tribunal under Section 170 of the MV Act,\n\n 198"8,  is settled law that if leave under Section 170 of\n\nA   Act is not obtained by the insurer, he cannot\n\n'maintain the appeal challenging the cause of accident,\n\n'being negligence of the driver of the Vehicle or the\n\nquantum of compensation awarded by the C\u00e9airns Tribunal\n\nW \n\n \n\n\n\nin favour of the claimants. However, the owner of the\n\nvehicle involved in the accident, being the .person\n\naggrieved by the impugned Judgment and \n\nchallenge its correctness. Therefore, \n\nNo.7'632\/2009 filed by theVii1--sju'rer of thel..said'V":vVehic'le is'\n\nliable to be dismissed...' as ,n'o'L=.",_:rnaV'i'n_tainabl'e, the other\nappeal filed by  vehicle is\nmaintainable.:,~:V'   f if _ V \n\n4.  ileagrneld Counsel for the\nappellantral\u00e9lcolnteiynds that though two\nvehicles'   __cycle which was driven by the\n\ndeceasedVV'hi_mseEf'._and'  said car were involved in the\n\n sai_d-\ufb01accident,lti'i~e.,.CE_a,i~mant, the wife of the deceased, did\n\n' not..cho_ose't,o"vproceed against the owner and insurer of the\n\nmotor   therefore, the Claims Tribunal committed\n\n serl\u00e9oilsferror in fastening liability of paying entire amount\n\n  of'licomp'ensation to the respondent claimant in respect of<\/pre>\n

ciaimant would be at liberty to proceeld’ <\/p>\n
