{"id":170049,"date":"2011-05-12T00:00:00","date_gmt":"2011-05-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/durga-prasad-and-ors-vs-the-state-of-m-p-on-12-may-2011"},"modified":"2016-06-01T05:43:18","modified_gmt":"2016-06-01T00:13:18","slug":"durga-prasad-and-ors-vs-the-state-of-m-p-on-12-may-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/durga-prasad-and-ors-vs-the-state-of-m-p-on-12-may-2011","title":{"rendered":"Durga Prasad And Ors. vs The State Of M.P on 12 May, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Durga Prasad And Ors. vs The State Of M.P on 12 May, 2011<\/div>\n<pre>                             1\n\n\n\n\n        Criminal Appeal No. 994\/1999.\n\n12.05.2011\n\n     Shri      Satish        Chaturvedi,           learned\n\ncounsel for appellants.\n\n     Shri     Vivek     Sharma,         learned    PL     for\n\nrespondent\/State.<\/pre>\n<p>     Perused PUD dated 30\/04\/11 in which it<\/p>\n<p>has been shown that appellants have failed<\/p>\n<p>to   appear       before     the       trial     Court     on<\/p>\n<p>23.04.11.\n<\/p>\n<p>     Learned counsel for appellants submits<\/p>\n<p>that matter may be heard finally today to<\/p>\n<p>which    learned        PL       for     State     has     no<\/p>\n<p>objection.\n<\/p>\n<p>     Heard finally.\n<\/p>\n<p>     This    is    an   appeal         preferred    by    the<\/p>\n<p>appellants         feeling        aggrieved        by     the<\/p>\n<p>judgment dated 22.03.99, delivered by the<\/p>\n<p>then Special Judge, Raisen in Special Case<\/p>\n<p>No.158\/96     in    which    appellants          have    been<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>convicted      for   alleged        offence     punishable<\/p>\n<p>under    Section      323    IPC     and      sentenced    to<\/p>\n<p>R.I.for six months and fine of Rs.500\/-<\/p>\n<p>each,    in    default        of     payment      of    fine<\/p>\n<p>appellants to further undergo R.I. for one<\/p>\n<p>month.\n<\/p>\n<p>2.   Learned counsel for the appellants has<\/p>\n<p>not challenged the finding of conviction<\/p>\n<p>of   the       appellant          but        confined     his<\/p>\n<p>arguments only on the point of sentence.<\/p>\n<p>So there is no need to consider the facts<\/p>\n<p>of the case.\n<\/p>\n<p>3.   Learned     counsel          for    the    appellants<\/p>\n<p>submitted that out of 13 persons who were<\/p>\n<p>tried,   these       three    appellants         have   been<\/p>\n<p>convicted and sentenced as aforesaid, the<\/p>\n<p>appellants are first offender and there is<\/p>\n<p>no   criminal        record        against      them.     The<\/p>\n<p>incident is of the year 1993. Therefore,<\/p>\n<p>their         case      may             be      considered<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>sympathetically.        He    submits     that       alleged<\/p>\n<p>offence      under      Section          323     IPC      is<\/p>\n<p>punishable with fine alone also.<\/p>\n<p>4.     On the contrary, learned counsel for<\/p>\n<p>the     State    has    supported        the        judgment<\/p>\n<p>delivered by the trial Court and contended<\/p>\n<p>that no interference is called for in this<\/p>\n<p>appeal.\n<\/p>\n<p>5.     Keeping     in    view      the         facts     and<\/p>\n<p>circumstances of this case and submissions<\/p>\n<p>made    by   the     parties,      the     interest       of<\/p>\n<p>justice would be served if the amount of<\/p>\n<p>fine is enhanced in lieu of sentence.<\/p>\n<p>       Consequently,     the      appeal       is     partly<\/p>\n<p>allowed.     The conviction of the appellants<\/p>\n<p>by the trial Court is hereby maintained.<\/p>\n<p>However,     instead         of   jail    sentence,        I<\/p>\n<p>impose extra fine amount of Rs.1,000\/-(Rs.<\/p>\n<p>One Thousand Only) on each appellant. The<\/p>\n<p>said    amount     be   deposited        in    the     trial<br \/>\n<span class=\"hidden_text\">                          4<\/span><\/p>\n<p>Court within three months from the date of<\/p>\n<p>receipt of certified copy of this order,<\/p>\n<p>failing which the appellants shall undergo<\/p>\n<p>R.I. for one month.
