            These applications are filed by the accused<\/p>\n
persons in a crime registered for offences punishable, inter<\/p>\n
alia, under Sections 326 and 308 read with 149 IPC.<\/p>\n
B.A.No.83\/08 is one for regular bail filed by the 2nd accused.<\/p>\n
B.A.Nos.12 and 284 of 2008 are applications for anticipatory<\/p>\n
bail filed by accused Nos.1, 3, 4 and 6. The 2nd accused was<\/p>\n
arrested and continues in custody from 8.12.07. The alleged<\/p>\n
incident took place on the night of 17.11.07. The crux of the<\/p>\n
allegations is that a group of six persons armed with<\/p>\n
dangerous      weapons           had        attacked          the   de facto<\/p>\n
complainant\/informant.         In the F.I. Statement, the de facto<\/p>\n
complainant alleged that one person described as the son of<\/p>\n
Vikraman Mooper and five others had attacked him. Political<\/p>\n
animosity is the alleged motive stated in the FIR. Later, in the<\/p>\n
course of investigation, when the said son of Vikraman<\/p>\n

Mooper was traced, the de facto complainant took the stand<\/p>\n
that he was not the person who attacked him.         Later, the<\/p>\n
prosecution apprehended accused Nos.2 and 5. They were<\/p>\n
arrested. Accused No.5 has already been granted regular<\/p>\n
bail by the Sessions Court. The 2nd accused has come to this<\/p>\n
Court seeking regular bail.\n<\/p>\n
      2.    It is the case of the prosecution now that the<\/p>\n
present 1st accused had engaged accused Nos.2 to 8 to<\/p>\n
mount an attack on the de facto complainant. The learned<\/p>\n
counsel for the first accused submits that the 1st accused had<\/p>\n
no motive ever against the de facto complainant, the victim.<\/p>\n
In these circumstances, the entire allegations may be held to<\/p>\n
be not justified, submits the learned counsel for the<\/p>\n
petitioners.\n<\/p>\n
      3.    The learned counsel for the petitioners further<\/p>\n
submit that the allegations under Sections 326 and 308 IPC<\/p>\n
are both not justified by the allegations in this case or the<\/p>\n
nature of injuries suffered. The inclusion of these allegations<\/p>\n

clearly show that vexation is the motive.<\/p>\n
      4.    The learned Public Prosecutor opposes the<\/p>\n
applications for anticipatory bail but does not oppose the<\/p>\n
application for regular bail. Appropriate conditions may be<\/p>\n
imposed, it is prayed.\n<\/p>\n
      5.    I have considered all the relevant inputs.     I am<\/p>\n
satisfied that regular bail can be granted to the 2nd accused<\/p>\n
subject to appropriate terms and conditions.<\/p>\n
      6.    Coming to the applications for anticipatory bail, the<\/p>\n
learned Public Prosecutor was requested to pointedly bring to<\/p>\n
the notice of this Court any material to show that the 1st<\/p>\n
accused has any animosity against the de facto complainant<\/p>\n
as to justify his engaging accused Nos.2 to 8 to unleash an<\/p>\n
attack on the victim.      The learned Public Prosecutor after<\/p>\n
perusal of the case diary shows that though the de facto<\/p>\n
complainant’s statement has been recorded on three<\/p>\n
occasions by now, there is no mention of any animosity<\/p>\n
between him and the 1st accused.       But the learned Public<\/p>\n

Prosecutor points out that one of the arrested accused had<\/p>\n
stated that there was such animosity and it is because of such<\/p>\n
animosity that accused Nos.2 to 8 were engaged to attack the<\/p>\n
victim. It is of crucial relevance to note that eventhough the<\/p>\n
victim has been questioned many times thereafter, his version<\/p>\n
on this aspect has not been cross checked or recorded<\/p>\n
admittedly.\n<\/p>\n
       7.   The allegation under Section 326 IPC is not<\/p>\n
justified and is not pressed, submits the learned Public<\/p>\n
Prosecutor. No grievous hurt under Section 320 IPC is shown<\/p>\n
to have been suffered by the victim.\n<\/p>\n
       8.   My attention has been drawn to the wound<\/p>\n
certificate showing the nature of injuries suffered by the<\/p>\n
victim. The totality of circumstances do persuade me to agree<\/p>\n
with the learned counsel for the petitioners that sufficient and<\/p>\n
satisfactorily allegations justifying the inclusion of the offence<\/p>\n
under Section 308 IPC are not shown to insist. I am, in these<\/p>\n
circumstances, satisfied that anticipatory bail can be granted<\/p>\n

to the other accused persons subject to appropriate terms<\/p>\n
and conditions.\n<\/p>\n
      9.    In the result :-\n<\/p>\n
      (a)   B.A.83\/08 is allowed. The petitioner\/2nd accused<\/p>\n
shall be released on bail on the following terms and<\/p>\n
conditions:\n<\/p>\n
      i)    The petitioner(A2) shall execute a bond for<\/p>\n
Rs.50,000\/- (Rupees fifty thousand only) with two solvent<\/p>\n
sureties each for the like sum to the satisfaction of the learned<\/p>\n
Magistrate.\n<\/p>\n
      ii)   The petitioner shall make himself available for<\/p>\n
interrogation before the investigating officer between 10 a.m<\/p>\n
and 12 noon on all Mondays and Fridays, for a period of two<\/p>\n
months from the date of his release and thereafter as and<\/p>\n
when directed by the investigating officer in writing to do so.<\/p>\n
      (b)   B.A.Nos.12\/08 and 284\/08 are allowed. Following<\/p>\n
directions are issued under Section 438 Cr.P.C in favour of<\/p>\n
the petitioners(accused Nos.1, 3, 4 and 6 ).<\/p>\n

\n                                : 6 :<\/span><\/p>\n
      i)    Petitioners(accused Nos.1, 3, 4 and 6) shall<\/p>\n
surrender before the learned Magistrate having jurisdiction at<\/p>\n
11 a.m on 18.1.08. They shall be released on regular bail on<\/p>\n
condition that they execute bonds for Rs.25,000\/-(Rupees<\/p>\n
twenty five thousand only) each with two solvent sureties each<\/p>\n
for the like sum to the satisfaction of the learned Magistrate.<\/p>\n
      ii)   The petitioners(accused Nos.1, 3, 4 and 6) shall<\/p>\n
make themselves available for interrogation before the<\/p>\n
investigating officer between 10 a.m and 5 p.m on 21.1.08<\/p>\n
and 22.1.08. During this period, the investigators shall be at<\/p>\n
liberty to interrogate the said petitioners in custody and take<\/p>\n
all necessary steps in the proper conduct of the investigation.<\/p>\n
      iii)  Thereafter they shall make themselves available for<\/p>\n
interrogation before the investigating officer on all Mondays<\/p>\n
and Fridays between 10 a.m and 12 noon for a period of two<\/p>\n
months. Subsequently the petitioners(accused Nos.1, 3, 4<\/p>\n
and 6) shall so appear as and when directed by the<\/p>\n
investigating officer in writing to do so.<\/p>\n

\n                                : 7 :<\/span><\/p>\n
      (iv) If the petitioners(accused Nos.1, 3, 4 and 6) do not<\/p>\n
appear before the learned Magistrate as directed in clause (i),<\/p>\n
directions issued above shall thereafter stand revoked and<\/p>\n
the police shall be at liberty to arrest the said petitioners and<\/p>\n
deal with them in accordance with law, as if these directions<\/p>\n
were not issued at all.\n<\/p>\n
      (v)   If they were arrested prior to 18.1.08, they shall be<\/p>\n
released from custody on their executing a bond for<\/p>\n
Rs.25,000\/- (Rupees twenty five thousand only) without any<\/p>\n
sureties, undertaking to appear before the learned Magistrate<\/p>\n
on 18.1.08.\n<\/p>\n
      10. Hand over copy of this order to the learned counsel<\/p>\n
for the petitioner.\n<\/p>\n<\/p>\n
