Rule.\n<\/p>\n<p> With the consent of the parties, writ<br \/>\npetition is taken up for disposal.\n<\/p>\n<p> 2. The petitioner in response to an<br \/>\nadvertisement of respondent No. 2 i.e. Directorate<br \/>\nGeneral, Doordarshan, inviting proposals, under the new<br \/>\nsponsorship scheme in September, 1990, gave his<br \/>\nproposal for telecasting a serial. Petitioner offered<br \/>\nto telecast his serial &#8216;Jhumru or Saat Thug&#8221; under the<br \/>\ncategories of children serials. Certain discrepancies<br \/>\nwere pointed out to the petitioner by respondent No. 2.<br \/>\nPetitioner claims to have removed the same.\n<\/p>\n<p> 3. In the year 1992, the petitioner&#8217;s<br \/>\nserial was listed at item No. 7 in the wait list for the<br \/>\nprime slot. Subsequently, the respondents informed the<br \/>\npetitioner that there has been a change and<br \/>\nprioritisation of serials would be done by random<br \/>\nnumber generation through a computer. Based on the<br \/>\n&#8216;random generation&#8217; petitioner&#8217;s serial was waitlisted<br \/>\nat priority No. 21. The petitioner waited in vain to<br \/>\nhear from the respondent, but to no avail. The<br \/>\nrespondent thereafter enquired of the petitioner<br \/>\nwhether he would be willing to accept the non-prime<br \/>\nslot, as there was no scope for telecasting the<br \/>\nwaitlisted proposals for a few years on the prime time<br \/>\nslots. Petitioner indicated his willingness to have<br \/>\nhis serials on the non-prime time slot. The respondent<br \/>\nthereafter informed the petitioner that his serial had<br \/>\nbeen waitlisted under the New Sponsorship Scheme<br \/>\nAlong with the other waitlisted serials.\n<\/p>\n<p> 4. Thereafter, on 29th September, 1997,<br \/>\nrespondent asked the petitioner to produce a pilot of<br \/>\nthe programme at his own cost and risk and to submit<br \/>\nthe same to the respondent within a period of three<br \/>\nmonths for consideration by the Selection<br \/>\nCommittee\/Preview Committee. On 28th December, 1997,<br \/>\nthe petitioner submitted the pilot programme to the<br \/>\nrespondent. The petitioner kept on reminding the<br \/>\nrespondents for telecasting of his serial, but there<br \/>\nwas no response. Ultimately, on 22nd June, 2000, the<br \/>\nrespondents informed the petitioner that the pilot<br \/>\nprogramme of the petitioner&#8217;s serial has not approved<br \/>\nfor telecasting on DD-1. The petitioner thereafter<br \/>\nfiled the present writ petition seeking a writ of<br \/>\nmandamus to allot a prime time slot to the petitioner<br \/>\nfor telecasting serial &#8216;Jhumru or Saat Thag&#8217;.<br \/>\nPetitioner also sought compensation for the losses<br \/>\nsuffered.\n<\/p>\n<p> 5. Petitioner has filed an additional<br \/>\naffidavit to bring on record certain developments which<br \/>\nwere not mentioned in the writ petition. The<br \/>\npetitioner who was disgusted with the non-telecasting<br \/>\nof his serial on DD-1 requested the respondent to<br \/>\nconsider the same for telecasting on DD-2 Metro<br \/>\nChannel. The respondents in response to the<br \/>\npetitioner&#8217;s request for telecasting his serial at<br \/>\nDD-2, informed him that it has been slated for<br \/>\ntelecasting from 12th July, 1998 for 26 episodes. The<br \/>\npetitioner sought extension of time, vide his letter<br \/>\ndated 6th July, 1998 for telecasting the same.<br \/>\nPetitioner again applied for extending the date of<br \/>\ntelecasting on 4th August, 1998. The respondents<br \/>\nthereupon, on 29th October, 1998 finally informed the<br \/>\npetitioner to resume the telecast immediately or else<br \/>\nthe slot would be withdrawn.\n<\/p>\n<p> 6. Mr. Vashisht, learned counsel for the<br \/>\npetitioner assails the actions of the respondents as<br \/>\narbitrary and discriminatory. He submits that the<br \/>\npetitioner after the successful preparation of the<br \/>\nscript of the serial was left in uncertainty for a<br \/>\nlong period. As regards the final rejection of the<br \/>\nserial for telecasting on DD-1 by the Preview<br \/>\nCommittee, Mr. Vashisht submit that once the petitioner<br \/>\nhad been asked to prepare a pilot for the serial, the<br \/>\nscope of the Preview Committee was confined to<br \/>\nsuggesting some modifications or improvements and it<br \/>\ncould not reject the same.\n<\/p>\n<p> I am afraid similar plea has been rejected<br \/>\nby this Bench in  Urvashi Films &amp; TV Group v. Union of<br \/>\nIndia and Ors. (C.W. No. 5674\/2000) decided on 28th<br \/>\nSeptember, 2000. In the cited case, it was held that<br \/>\nthe Preview Committee while considering the pilot of a<br \/>\nprogramme is to decide its acceptability for telecast<br \/>\nfinally. Its function was not confined to merely<br \/>\nsuggesting additions or alterations. The latter was<br \/>\nonly a supplementary function. An LPA against the said<br \/>\ndecision was filed, but he same has been dismissed by<br \/>\nthe Division Bench. This submission, accordingly, will<br \/>\nnot advance petitioner&#8217;s case.\n<\/p>\n<p> 7. Coming to the second plank of the<br \/>\npetitioner&#8217;s submission, Mr. Vashisht very strenuously<br \/>\nurged that there was arbitrariness in the decision<br \/>\nmaking process of the respondents in as much as the<br \/>\nCommittee headed by the same Convener Ms. Usha Bhasin,<br \/>\nController of Programme had approved the said serial<br \/>\nfor telecasting on DD-2, while rejecting the same for<br \/>\nDD-1. The submission appears attractive on the first<br \/>\nflush. However, a deeper consideration would show that<br \/>\nthe criteria, requirements of content and the standards<br \/>\nof serials for acceptability for the two channels may<br \/>\nbe different. The respondents in the counter-affidavit<br \/>\nand the additional affidavit have set out that even<br \/>\nthough the Committee may have been headed by the same<br \/>\nperson, the composition of the Committee was different.<br \/>\nSecondly, it is argued that DD-1 is a national channel<br \/>\nwhere the acceptability criteria, requirement of<br \/>\ncontent and standards are different from those for<br \/>\nmetro stations of the country. There is merit in this<br \/>\nsubmission.\n<\/p>\n<p> Besides. In the absence of specific<br \/>\nallegations of malafides or discriminatory treatment or<br \/>\nmanifest arbitrariness in the selection process, the<br \/>\nCourt cannot substitute its opinion for the opinion of<br \/>\nthe expert committees, in the instant case that of the<br \/>\nSelection\/Preview Committee.
