The brief facts of the case are as follows: __   V  \u00ab\n\nThe first respondent \ufb01led a <\/pre>\n
Commissioner for Workmen.’s  Con:.pensati’onI_:._,see;i:ing_t><\/p>\n
‘ compensation. He has contended uthat he Was\ufb01irori\u00e9ing as a<\/p>\n
cleaner in a lorry bea,+:’1:g  No.KA-20\/163
\nbelonging to the second  after
\nunloading the   returning to
\nShimoga. While’  p.m., near Holehatti,
\nthe lorry inan’ accident, while avoiding an
\noncoming  t\u00a7i\u00a7=.  duestion dashed against a
\nroa.dside_..  after the accident, the claimant<\/p>\n
 shifted ..to\u00ab.,Me”cggon Hospital, Shirnoga for first aid and<\/p>\n
 therea1″t,er,.~’h’e’ V’\u00e9i’i;fas,I=.Vshifted to Victoria Hospital, Bangalore.<\/p>\n
V7fl’he.Doctors of Victoria Hospital, in turn referred the claimant<\/p>\n
 Hospital. In View of Deepavali festival, doctors<\/p>\n
l”4’V.’jw_e’re not ‘available in NIMHANS Hospital and the claimant<\/p>\n
\/5\/J<\/p>\n
was admitted to Abhaya Hospital where he had _.-taken<\/p>\n
treatment. He contends that he was an in~patient for:<\/p>\n
of 21 days and he has spent huge amount  <\/p>\n
treatment. The claimant contended :t’nathe ‘lwasl ah’ou’t<\/p>\n
26 years as on the date of accident. ‘fh.e the=<\/p>\n
was paying a salary of Rs.4,0G0l\/   day it<\/p>\n
as batta. He has contended that  thellaccident, he<\/p>\n
became permanently disabled ‘fo;f,compensation.<\/p>\n
3. in pursuanyce.    Commissioner\nfor  owner appeared on\n<\/pre>\n
the first date –_()fA not \ufb01led objections. The
\nInsurance   denying the averments
\nmade  ‘claim  and also contended that the said<\/p>\n
lorry ‘iS!VlCQVC.1’_vc”d  insurance, but it is for the claimant to<\/p>\n
prove.  sought for dismissal of the claim<\/p>\n
 petition.\n<\/p>\n<\/p>\n
4. On the basis of the pleadings of the parties, the
\nCommissioner for Workmen’s Compensation <\/p>\n
necessary issues.\n<\/p>\n
5. In order to prove their respectiife’ <\/p>\n
claimant examined himself as \u00bbP,W. reiiedaluponf <\/p>\n
documents marked as Ex.P.1 to  1  llegcainined
\ntwo other witnesses   and
\nDr.Prashanth N.T. as    Court
\nCommissioner. H    the Insurance<\/p>\n
Company, the Assiat\u00e9gnt  Cfficer was examined
\nas R.W.}.  marked  in”s2.irance policy as Ex.R. 1.<\/p>\n
6. The   evidence has deposed that While he<\/p>\n
“ret1i1*–nin–gfr”oni Daifanagere to Shimoga, the accident has<\/p>\n
occurred;  avoid the oncoming Vehicle, the lorry in<\/p>\n
 against a roadside tree. The claimant<\/p>\n
‘ “”su:stained grievous injuries in the accident and he has taken<\/p>\n
C”\u00ab.:’tre’atn1er1t-din Abhaya Hospital at Bangalore. He has also<\/p>\n
\u00e9~<\/p>\n
deposed that he has undergone two operations. Due to the<\/p>\n
accident, he has suffered permanent disability.<\/p>\n
‘7. The claimant was thoroughly cross–exarnin:ecif_i.by the <\/p>\n
Insurer. In the cross-examination. the clairnant dephosedfthati<\/p>\n
due to the accident that occurred  he’fvvasf”~oop<\/p>\n
seriously injured and he has  treat1ne:ntV’Afbhaya
\nHospital at Bangalore.  been
\nproduced in that regard.   has treated
\nthe claimant  through Court<\/p>\n
Commissioner. ‘,I)oc”to3fVs’i’~’:i_r:._ their} evidence have clearly<\/p>\n
deposed that the clai:”riaritp>’ha:s*’-undergone serious injuries of
\nmultiple facial”-ogignjugriesiff Maxillary fracture Lefort-III,
\n\ufb01facture pl rnaridible parasyrnphysis, fracture of right<\/p>\n
Zygom  ‘invo.1ving..ithe _ Zygomatic arch.<\/p>\n
 The~..__fInsiure13’ f\ufb01led additional objections on 18~8–2G05<\/p>\n
“‘eionte’nding  the vehicle was insured in favour of one<\/p>\n
 ._ “Na1:osIiad\u00bb.aj1d the insurance is still in existence. However, the<\/p>\n
\/\u00a34<\/p>\n
claimant claims under Nazeer Khan. Hence, he is not the<\/p>\n
employee of Naushad and he cannot claim compensation..{V.,_<\/p>\n
9. The Insurer in its objections has admitted     <\/p>\n
lorry is covered by insurance. However, “iti.s?aiso- contended\u00ab<\/p>\n
that the policy has been issued to. Naushad._and    pp<\/p>\n
veri\ufb01ed in whose name the R.C.   has not
\ndisputed the accident that  at 8.30
\npm. and the claimant ismvthg  the second<\/p>\n
respondent.\n<\/p>\n
10. On the  of the parties, the
\nCommissioner tor  has held that the
\naccident tool;  lvAO:2OO3 and in the accident the
\nclaiirxanfhas-.”suffered’serious injuries. Further, the claimant<\/p>\n
is   second respondent and the accident<\/p>\n
  it the course of employment. The<\/p>\n
 further held that as on the date of the<\/p>\n
 the said lorry stands in the name of Nazeer Khan<\/p>\n

who is the second respondent in this appeal. The instirance<\/p>\n
is stiil in subsistence, hence, the insurer is Iiabie”.tfo\u00ab..’_0p\u00abay<\/p>\n
compensation. Taking into consideration the age”and:i6f)%y:’ofA <\/p>\n
the salary drawn by the ciaimant, .the__4Cornniis’siener4_’_jhas ‘Au<\/p>\n
awarded compensation of Rs.5,16,672\/ <\/p>\n
and also awarded interest at th’e_V:vyi’ate of 1_2%_0po,a’;=.yrromi the”<\/p>\n
date of the claim petition.\n<\/p>\n
11. Being aggrieved by’…   by the
\nCommissioner for   the Insurer has
\ncome up in this   award passed by
\nthe  iaw. He has contended that
\nthe claimant    3 injuries. However, the
\n has consideration 100% disability<\/p>\n
 awarded ‘conipensation, which is contrary to law. The<\/p>\n
Doctors_\u00ab.whov.Vhad: treated the ciaimant have deposed in their<\/p>\n
_V7.e\\(id.ence ‘that… the disability is oniy 50% whereas the<\/p>\n
\u00ab1.'{io1nj:n.issioner has taken 100% disabiiity, which is contrary to<\/p>\n
  sought for setting aside the same. Further, the<\/p>\n

Insurer has also contended that the interest awarded at 12%
\np.a. by the Commissioner is contrary to the judgmen.tV_:7trhe<\/p>\n

\naddressed   tor the parties, perused the
\naward pVassedd”~   hthexu Ciommissioner for Workmen’s
\nci\u00a75nip\u00a2n$\u00a7\u00e9;itmr   and documentary evidence of the<\/p>\n
parti.es.__. 2: it  ” V’<\/p>\n
 It isnot .in:’.:di.spute that the claimant was Working as a<\/p>\n
 in  lorry bearing registration No.KA-20\/163<\/p>\n
 the second respondent. While returning from<\/p>\n
\u00e9~<\/p>\n
Davanagere, the said lorry met with an accident on Shimoga~<\/p>\n
Honnali road. The claimant has contended that the  of<\/p>\n
the vehicle was paying him a salary of <\/p>\n
Rs.50\/- per day as batta. Though the owner  ._ <\/p>\n
the Commissioner, he has not \ufb01led=__ <\/p>\n
claim petition. Immediately after-the <\/p>\n
was shifted to Mecggon Hospital  aid and
\nthereafter, he was shifted  From there, he
\nwas shifted to NIMI-EAVNS,   ‘there were no
\nDoctors available.   he was admitted
\nto Abhaya    summary issued by
\nthe Abhaya   was admitted on
\n26102003  1-.2003. He has undergone
\n operatiens.V 1I?’o!C:;tors who had treated the claimant
\nclaimant has suffered following injuries:<\/p>\n
1’. m’\u00b0.__ ‘A  ‘facial injuries;\n<\/p>\n
[ii)l'”‘— E\u00a5._\/Lvlvlaxillary fracture Lefort~III;<\/p>\n
..   (iii) ‘Fracture of mandible right parasymphysis; and<\/p>\n
\ufb01v<\/p>\n
(iv) fracture of right Zygoma involving the Zygomatic<\/p>\n
arch.\n<\/p>\n
The Doctors have further opined that in vi_ew~ above<\/p>\n
injuries, the claimant is likely to:=__v<\/p>\n
Further, he is disabled to do the__.work._o’f a c1:eaiie1goi9 <\/p>\n
manual work due to the injuiieis’-,:suffered   The
\nDoctors have also opined\u00ab–_..that._ hje   undergo future
\noperations to remove. the  iinplanted in the<\/p>\n
facial operation.\n<\/p>\n
15. Thoughf\u00bb the whole body
\ndisability of the functional disability is
\n100%. Adniittehdlyaviie’.isAAan’illiterate Working as a cleaner of
\nthe    unable to do any other work than the<\/p>\n
clea’n._ei’_or’ fcoo-1ie.lh’ view of the accident, he is not fit to do<\/p>\n
  majiual   Hence, he suffered functional disability at<\/p>\n
