Justice R.BASANT\n\n Dated :30\/11\/2007\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                       B.A.No.7406 of 2007\n                      -------------------------------------\n             Dated this the 30th day of November, 2007\n\n                                  ORDER\n<\/pre>\n<p>      Application for regular bail.            Petitioner faces allegations,<\/p>\n<p>inter alia, under Section 409 I.P.C. The crux of the allegation is<\/p>\n<p>that he had misappropriated a huge amount of Rs.3.4 lakhs<\/p>\n<p>during the period 2002-2003. The petitioner had come to this<\/p>\n<p>Court with an application for anticipatory bail and this Court as<\/p>\n<p>per order dated 31.10.07 in B.A.No.6603 of 2007 dismissed the<\/p>\n<p>prayer with a direction to surrender and seek bail. Accordingly,<\/p>\n<p>the petitioner has surrendered on 22.11.07.                  He continues in<\/p>\n<p>custody from that date.\n<\/p>\n<p>      2.    The learned counsel for the petitioner prays, the<\/p>\n<p>learned Public Prosecutor does not oppose the said prayer and I<\/p>\n<p>am satisfied that the petitioner can now be enlarged on bail<\/p>\n<p>subject to appropriate terms and conditions.<\/p>\n<p>      3.    In the result, this application is allowed.                 The<\/p>\n<p>petitioner shall be released on bail on the following terms and<\/p>\n<p>conditions.\n<\/p>\n<p><span class=\"hidden_text\">B.A.No.7406 of 2007              2<\/span><\/p>\n<p>      i)   The petitioner shall execute a bond for Rs.50,000\/-<\/p>\n<p>(Rupees Fifty thousand only) with two solvent sureties each for<\/p>\n<p>the like sum to the satisfaction of the learned Magistrate;<\/p>\n<p>      ii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the Investigating Officer between 10 a.m and<\/p>\n<p>12 noon on all Mondays for a period of two months and<\/p>\n<p>thereafter as and when directed by the Investigating Officer in<\/p>\n<p>writing to do so.\n<\/p>\n<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court V.G.Sasidaran Nair vs State Of Kerala Represented By on 30 November, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 7406 of 2007() 1.
