Heard
\n\tMr.Tejas Barot, learned counsel for the applicant and Ms.Shah,
\n\tlearned APP representing the respondent State.\n<\/p>\n
The
\n\tpresent application is filed by the applicant u\/s.439 of the Cr.P.C.
\n\tfor releasing him on regular bail in connection with C.R.No.II 3092
\n\tof 2010 registered with Godhra railway police station for the
\n\toffences punishable u\/ss.8(C), 15 and 29 of the Narcotic Drugs and
\n\tPsychotropic Substances Act (hereinafter referred to as ‘the Act’).\n<\/p>\n
Mr.Barot,
\n\tlearned counsel for the applicant states that the applicants is
\n\tinnocent and he was falsely involved in this case. That the
\n\tapplicant is poor person and he was travelling for the purpose of
\n\tgetting labour work. It is further submitted that the similarly
\n\tsituated co-accused, namely, Mangilal Badiyabhai Bhuriya was
\n\treleased on regular bail by this Court vide order dated 25.2.2011 in
\n\tCriminal Misc.Application No.1613 of 2011. It is submitted that as
\n\tper the prosecution case about 44 Kgs. of Poppy Pod\/Poppy Straw came
\n\tto be seized from the co-accused Mangilal and while releasing
\n\tMangilal on bail, this Court observed that the quantity of allegedly
\n\tcontraband article seized from Mangilal did not fall within the
\n\tpurview of commercial quantity. It is submitted that so far as the
\n\tinstant case of applicant Rassubhai Thavaria Muniya is concerned, as
\n\tper the prosecution case, the allegedly contraband quantity seized
\n\tfrom him comes to 22.183 kgs. i.e. half the quantity than what was
\n\tseized from Mangilal. It is, therefore, submitted that the allegedly
\n\tcontraband article seized from the applicant – Rassubhai
\n\tcannot be said to be commercial quantity. It is, therefore,
\n\tsubmitted that since the allegations levelled against the applicant
\n\tand co-accused Mangilal and the alleged role played by them is
\n\tidentical, the applicant – Rassubhai may be released on bail
\n\ton the same line as co-accused Mangilal has been released.\n<\/p>\n
Per
\n\tcontra, Ms.C.M.Shah, learned APP vehemently opposed this application
\n\tand stated that the applicant is involved in a very serious offence
\n\tunder the Act. Mere fact that less than commercial quantity of
\n\tcontraband is seized from the person of the applicant, that itself
\n\twould not be sufficient to grant bail in his favour. It is further
\n\tsubmitted that before the chargesheet, applicant had filed bail
\n\tapplication and, therefore, the instant bail application may not be
\n\tallowed.\n<\/p>\n
Having
\n\tconsidered the submissions advanced on behalf of both the sides and
\n\tperusing the relevant papers, so also considering the order dated
\n\t25.2.2011 passed by this Court in Criminal Misc.Application No.1613
\n\tof 2011, releasing the co-accused Mangilal Bhuriya on bail, this
\n\tCourt is of the opinion that the applicant herein Rassubhai, who is
\n\talmost identically situated accused, should be released on regular
\n\tbail u\/s.439 of the Cr.P.C. So far as the earlier application being
\n\tCr.M.A.No.11722 of 2010 preferred by this applicant seeking regular
\n\tbail is concerned, vide order dated 21.10.2010, this Court had
\n\tpermitted the applicant to withdraw the said bail application
\n\tspecifically reserving liberty of the applicant to move for bail
\n\tbefore the concerned Sessions Court after the chargesheet is filed.
\n\tUnder such circumstances, when the first bail application was
\n\tpreferred before chargesheet and same came to be withdrawn reserving
\n\tthe liberty to move for bail after the chargesheet is filed, the
\n\tmere fact that earlier bail application was not pressed shall not
\n\tcome in way of the applicant. Moreover, the earlier bail application
\n\tcam to be withdrawn conditionally on 21.10.2010 whereas the
\n\tsimilarly situated co-accused came to be released by this Court on
\n\t25.2.2011, which event is pressed into service as change of
\n\tcircumstance.\n<\/p>\n
Considering
\n\tthe submissions made on behalf of the parties and having regard to
\n\tthe facts and circumstances of the case, the application is allowed
\n\tand applicant is ordered to be released on bail in connection with
\n\tII-CR No.3092 of 2010 registered with Godhra Railway Police Station
\n\tfor the offences alleged against him in this application on his
\n\texecuting a bond of Rs.10,000\/- (Rupees Ten Thousand Only) with one
\n\tsolvent surety of the like amount to the satisfaction of the lower
\n\tCourt and subject to the
\n\tconditions that he shall,<\/p>\n
(I)\tnot take undue
\nadvantage of his \tliberty or\tabuse his liberty;\n<\/p>\n
(ii)\tnot act in a manner
\ninjurious to the\tprosecution;\n<\/p>\n
(iii)\tnot leave the
\nlocal limits of State \tof Gujarat\twithout the prior \tpermission of
\nthe concerned\tSessions Judge;\n<\/p>\n
(iv)\tmark
\nhis presence before the \tInvestigating\tOfficer on every 15th
\n\tday of the calender month between \t09:00 a.m. to 02:00 p.m.;\n<\/p>\n
(v)\tSurrender his
\npassport, if any, to \tthe lower\tCourt within a week;\n<\/p>\n
(vi)\tfurnish the present
\naddress of \tresidence to the Investigating\tOfficer as well as to the
\nCourt at\tthe time of furnishing bond and \tshall not\tchange his
\nresidence till \tfurther orders;\n<\/p>\n
(vii)\tmaintain
\n\tlaw and order;\n<\/p>\n
\tThe Authority will
\n\trelease the applicant only if he is not required in connection with
\n\tany other offence for the time being.\n<\/p>\n
If
\n\tbreach of any of the above conditions is committed,
\n\tthe concerned Sessions Judge will be free to issue warrant or take
\n\tappropriate action in the matter.\n<\/p>\n
\tBail bond to be
\n\texecuted before the lower Court having jurisdiction to try the case.\n<\/p>\n
\tAt the trial, the trial
\n\tCourt shall not be influenced by the observations of preliminary
\n\tnature, qua the evidence at this stage, made by this Court while
\n\tenlarging the applicant on bail. Rule is made absolute to the
\n\taforesaid extent.\n<\/p>\n
\tDirect Service is
\n\tpermitted.\n<\/p>\n
