BENCH No. - 7016 of 2010\n\nPetitioner :- Brahm Dev Yadav\nRespondent :- Sub Divisional Magistrate Safipur Unnao\nPetitioner Counsel :- R.N.Gupta,Moti Lal Yadav\nRespondent Counsel :- C.S.C.\n\nHon'ble Pradeep Kant,J.\n<\/pre>\n<p>Hon&#8217;ble Ritu Raj Awasthi,J.\n<\/p>\n<p>      Sri Anand Kumar, Sub Divisional Officer, Safipur,<br \/>\nDistrict Unnao is present in person. He could not satisfy nor<br \/>\nexplain that under what authority and on what material he has<br \/>\nsuspended the agreement of fair price shop of the petitioner.<br \/>\nVague recital has been made in the order that telephonic<br \/>\ncomplaint given by card holders and public has persuaded him<br \/>\nto pass the order. It, thus, shows that the impugned order has<br \/>\nbeen passed in an absolutely and arbitrary manner and without<br \/>\napplication of mind as also without finding out the truth, even<br \/>\nprima-facie, of any such complaint, made on telephone.\n<\/p>\n<p>      The order aforesaid shows that, though the officer did not<br \/>\nvisit the place he has made general observations, that less<br \/>\nquantity of commodity is being supplied to the card-holders and<br \/>\nexcess price is being realized. It also says that sugar has not<br \/>\nbeen distributed in the presence of observer nor in the presence<br \/>\nof the Village Level Committee.\n<\/p>\n<p>        The officer could not explain , that when he has not<br \/>\nvisited the shop and there being no written complaint, nor there<br \/>\nis anything to show as to who are those members who had<br \/>\nmade the complaints on telephone then on what basis this<br \/>\nagreement has been suspended. The impugned order, thus, is<br \/>\nliable to be set aside.\n<\/p>\n<p>      Sri Anand Kumar, Sub Divisional Officer, though tenders<br \/>\nunconditional apology and states that he may recall the order<br \/>\nbut the order has yet not been recalled. We find that by an<br \/>\n action of the respondents officer, the petitioner has been put to<br \/>\ngreat agony, as he has to approach the Court by engaging a<br \/>\nlawyer, resulting into consumption of some precious time of the<br \/>\nCourt also.\n<\/p>\n<p>      We, therefore, set aside the impugned order 15.07.2010,<br \/>\ncontained as Annexure No. 1 to the writ petition.\n<\/p>\n<p>      We under the circumstances direct that Sri Anand Kumar<br \/>\nshall deposit Rs.5000\/- as costs within a period of one month<br \/>\nfrom today before the Registrar of this Court; failing which the<br \/>\nsame shall be realized as arrears of land revenue by the District<br \/>\nMagistrate on a recovery certificate being issued by the<br \/>\nRegistrar of this Court and the same shall be remitted to the<br \/>\nMediation and Conciliation Centre of Lucknow Bench.\n<\/p>\n<p>      We further direct and make it clear that no other action<br \/>\nshall be taken against the Sri Anand Kumar i.e. the Officer<br \/>\nconcerned, either departmentally or otherwise nor the<br \/>\nobservations made against him in this order shall be mentioned<br \/>\nin the service record of the officer concerned and also the<br \/>\npresent order will not come in the way of his service career<br \/>\nwhile considering his promotion etc.<\/p>\n<p>      The writ petition is allowed.\n<\/p>\n<p>Order Date :- 2.8.2010<br \/>\nvks\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Brahm Dev Yadav vs Sub Divisional Magistrate &#8230; on 2 August, 2010 Court No. &#8211; 1 Case :- MISC.
