PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/04\/2011 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p> Learned APP Mr.L.R.Pujari waives service of notice of Rule on behalf<br \/>\nof respondent &#8211; State.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner has filed this petition under Section 482 of the Code of<br \/>\nCriminal Procedure, with a prayer to quash and set aside the impugned<br \/>\norder dated 13.4.2001 passed by the learned Principal Judge, City<br \/>\nSessions Court, Ahmedabad  below Exh.1 in Criminal Appeal No.114 of<br \/>\n2011.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned advocate Ms.Archana Amin for the petitioner and learned APP<br \/>\nMr.L.R.Pujari for the respondent &#8211; State.\n<\/p>\n<p>4.\tIt<br \/>\nis submitted by learned advocate  Ms.Archana Amin that she is<br \/>\nappearing on behalf of petitioner and she is appointed through legal<br \/>\naid.  It is submitted that the petitioner is convicted for the<br \/>\noffence punishable under Section 138 of the Negotiable Instruments<br \/>\nAct.  The learned trial Judge by his order dated 11.3.2011 passed in<br \/>\nCriminal Case No.2481 of 2008 has convicted the petitioner for the<br \/>\noffence punishable under Sec.138 of the Negotiable Instruments Act<br \/>\nfor one year simple imprisonment with fine of Rs.2,500\/-, and in<br \/>\ndefault to undergo two months simple imprisonment.   The trial court<br \/>\nalso directed the petitioner to o make  payment of Rs.2,50,000\/-  to<br \/>\nthe complainant  as compensation under Section 357 of Cr.P.C.\n<\/p>\n<p>5.\tThe<br \/>\nsaid order was challenged by the petitioner before the appellate<br \/>\ncourt  being Criminal Appeal No.114 of 2011. The appellant court by<br \/>\nits order dated 13.4.2011 passed below Exh.1 in Criminal Appeal<br \/>\nNo.114 of 2011  which reads as under.\n<\/p>\n<p>&#8220;Admit.\n<\/p>\n<p>Substantive order of sentence is ordered to stand suspended till<br \/>\nhearing and final disposal of the appeal, subject to the appellant<br \/>\nfurnishing a fresh personal bond of Rs.10,000\/- and two sureties of<br \/>\nRs.5,000\/- each, as also on depositing in the court an amount of<br \/>\nRs.35,000\/- within ten days from the date of this order.\n<\/p>\n<p>Call<br \/>\nfor R&amp;P of Criminal Case No.2481\/2008 from Metropolitan<br \/>\nMagistrate, Negotiable Instruments Act Court No.7.  Notice to the<br \/>\nrespondents returnable on 06\/05\/2011.&#8221;\n<\/p>\n<p>6.\tRequest<br \/>\nis only made by the learned advocate for the petitioner  for<br \/>\nextending the time to deposit the amount of Rs.35,000\/- as per the<br \/>\nimpugned order passed by the appellate court.\tIt is submitted by<br \/>\nlearned advocate for the petitioner that the petitioner is an<br \/>\nauto-rickshaw driver and he is not able to make arrangement of<br \/>\nRs.35,000\/- and so he preferred this application through legal aid,<br \/>\nand the Legal Aid Authority has appointed Ms.Archana Amin to defend<br \/>\nthe case of the petitioner.\n<\/p>\n<p>7.\tConsidering<br \/>\nthe aforesaid facts and circumstances of the case, six weeks time is<br \/>\ngranted to the petitioner  to deposit the amount of Rs.35,000\/- as<br \/>\nper the order passed by the appellate court.   Rest of the order of<br \/>\nthe appellate court will remain the same.   It is clarified that no<br \/>\nfurther extension will be granted to the petitioner for depositing<br \/>\nthe said amount.\n<\/p>\n<p>8.<br \/>\n With the aforesaid observations and directions, the petition is<br \/>\ndisposed of.
