Single<br \/>\nJudge of this Court, whereby the application of the original<br \/>\npetitioner is directed to be decided as per the policy prevailing<br \/>\nthen i.e. on the date of the application for compassionate<br \/>\nappointment.\n<\/p>\n<p>2.\t\tHeard<br \/>\nMr. Shah, Ld. AGP for the applicant and Mr. Parikh, Ld. Counsel for<br \/>\nthe respondent no. 1 original petitioner. We may also state that with<br \/>\na view to see that the merits of the matter may not be frustrated on<br \/>\naccount of the delay, we have also heard Mr. Shah, Ld. AGP as well as<br \/>\nMr. Parikh on the merits of the appeal.\n<\/p>\n<p>3.\t\tAs such if the<br \/>\ncontents of the application for condonation of delay are considered<br \/>\nin light of the subsequent affidavit-in-rejoinder filed on behalf of<br \/>\nthe applicant by Shri Bachubhai Rupaji Bhagora, it appears that there<br \/>\nis no sufficient explanation for delay and the stand taken is<br \/>\ncontrary. Such a long delay of 641 days cannot be said to be<br \/>\nsufficiently explained, which may call for discretion for condonation<br \/>\nof delay.\n<\/p>\n<p>4.\t\tApart from the<br \/>\nabove, if the merits of the appeal against the order of the Ld.<br \/>\nSingle Judge is considered, it appears that the issue, which arose in<br \/>\nthe appeal, is covered by the decision of the Division Bench of this<br \/>\nCourt dated 11\/5\/2010 in Letters Patent Appeal No. 22 of 2010 and<br \/>\nallied matters which includes  Letters Patent Appeal No. 2306 of 2009<br \/>\nin  Special Civil Application No. 12472 of 2008, wherein the view<br \/>\ntaken is that the application for compassionate appointment if not<br \/>\ndecided for a long time, it cannot be rejected on the ground of<br \/>\nchange of policy and the applicants were directed to decide the<br \/>\napplications as per the policy prevailing then.\n<\/p>\n<p>5.\t\tFurther, additional<br \/>\naspect is that the aforesaid decision of the Division Bench dated<br \/>\n11\/5\/2010 was carried by the applicants to the Apex Court in SLP so<br \/>\nfar as it related to  Letters Patent Appeal No. 2306 of 2009 and as<br \/>\nper the order passed by the Apex Court in aforesaid SLP dated<br \/>\n19\/10\/2010 the view taken by the Division Bench dated 11\/5\/2010 has<br \/>\nnot been interfered with and the Apex Court has expressed the view in<br \/>\nagreement with the view taken by this Court.  Under these<br \/>\ncircumstances, we find that even if the merits of the present appeal<br \/>\nare considered, the ultimate conclusion recorded by the Ld. Single<br \/>\nJudge would not call for interference.\n<\/p>\n<p>6.\t\tHence, in view of<br \/>\nthe above, the application for condonation of delay is dismissed.\n<\/p>\n<p>7.\t\tIn view of the<br \/>\nabove, the  Letters Patent Appeal [Stamp] No.1842 of 2010 would not<br \/>\nsurvive and shall stand disposed of accordingly.\n<\/p>\n<p>[<br \/>\nJAYANT PATEL, J. ]<\/p>\n<p>[<br \/>\nJ.C.
