PUBLIC PROSECUTOR for\nOpponent \n==========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 01\/12\/2008 \n\n \n\n \n \nCOMMON\nORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE BANKIM.N.MEHTA)<\/p>\n<p>1.\tThe<br \/>\nappellants have preferred these appeals under section 374(2) of the<br \/>\nCode of Criminal Procedure, 1973 and challenged the judgment and<br \/>\norder of conviction and sentence passed by the learned Additional<br \/>\nSessions Judge, Banaskantha at Deesa on 31.1.2002 in Sessions Case<br \/>\nNo.120 of 1999 convicting and sentencing them to undergo life<br \/>\nimprisonment and to pay fine of Rs.1000\/- each in default thereof to<br \/>\nundergo further imprisonment of one year for the offence under<br \/>\nsection 302 of the Indian Penal Code and RI for four months for the<br \/>\noffence under section 135 of the Bombay Police Act.\n<\/p>\n<p>2.\tAccording<br \/>\nto the prosecution case, on 17.4.1999 at about 10:00 p.m., the<br \/>\naccused and one unidentified accused committed murder of Keshabhai<br \/>\nHemrajbhai, Pachabhai Madhabhai and Bhamrabhai Madhabhai with weapons<br \/>\nlike axe, dhariya and wooden log.\n<\/p>\n<p>3.\tOn<br \/>\nthe basis of the first information report lodged by Ugamben Sonabhai,<br \/>\noffence was registered and investigation was started. At the end of<br \/>\ninvestigation, charge sheet came to be filed against the accused for<br \/>\nthe offence punishable under sections 302 and 34 of the Indian Penal<br \/>\nCode and section 135 of the Bombay Police Act.  As the offence was<br \/>\ntriable by Sessions Court, the case was committed to the City<br \/>\nSessions Court and it was registered as Sessions Case No.120 of 1999.<br \/>\n The learned Additional Sessions Judge framed charge Exh-2 for the<br \/>\naforesaid offences against the accused. The accused denied having<br \/>\ncommitted the offence and claimed to be tried.  Therefore, the<br \/>\nprosecution adduced evidence.  On completion of recording of<br \/>\nevidence, the learned trial Judge explained to the accused the<br \/>\nincriminating circumstances appearing in the evidence.  The accused<br \/>\nin their further statement recorded under section 313 of the Code of<br \/>\nCriminal Procedure, 1973, stated that they have not committed the<br \/>\noffence.   After hearing the learned Additional Public Prosecutor and<br \/>\nlearned advocate for the accused, the Court convicted the accused.<br \/>\nBeing aggrieved by the said decision, both the accused have preferred<br \/>\nthe appeals.  As both the appeals are against the same judgment, we<br \/>\nhave heard both the appeals together and decided the same by this<br \/>\ncommon judgment.\n<\/p>\n<p>4.\tWe<br \/>\nhave heard learned advocate Ms. Sadhana Sagar for the appellants and<br \/>\nlearned APP Ms. Mita Panchal at length and in great detail.  We have<br \/>\nalso perused the impugned judgment and record and proceedings of the<br \/>\ntrial Court.\n<\/p>\n<p>5.\tThe<br \/>\nlearned advocate for the appellant has submitted that there is no<br \/>\nevidence against the accused Motilal and he has been implicated only<br \/>\non the basis of suspicion.  It is also submitted that the evidence<br \/>\nagainst the accused Amedaji is also not convincing and he has been<br \/>\nimplicated only because he had made inquiries.  Therefore, there is<br \/>\nno other convincing evidence to connect the accused with the crime<br \/>\nand hence, the impugned judgment is required to be set aside.\n<\/p>\n<p>6.\tThe<br \/>\nlearned APP has submitted that there is clinching evidence<br \/>\nimplicating both the accused.  Therefore, no interference is<br \/>\nwarranted in the impugned judgment.\n<\/p>\n<p>7.\tThe<br \/>\nmedical evidence of PW 4 Dr. Mona Bhatt Exh-15 indicates that death<br \/>\nof Keshabhai Hemraj, Pachabhai Madhabhai and Bhamrabhai Madhabhai<br \/>\nwere on account of hemorrhagic shock due to head injury.  The<br \/>\npostmortem reports Exh-17, 18 and 19 indicate the injuries found on<br \/>\nthe dead bodies.  They also indicate that the injuries were on the<br \/>\nvital part of the body.  According to the doctor, the injuries were<br \/>\nsufficient in the ordinary course of nature to cause death and such<br \/>\ninjuries were possible by dhariya and axe.  Therefore, the medical<br \/>\nevidence clearly indicates that all the three deaths were homicidal.<br \/>\nNow the question requires to be determined is whether the accused<br \/>\nwere responsible for the fatal injuries.\n<\/p>\n<p>8.\tThe<br \/>\nfirst information report Exh-54 is filed by PW 7 Ugamben Sonabhai.<br \/>\nIt is alleged therein that on the previous day of incident, in the<br \/>\nevening at about 6:30 p.m., the first informant, her father, her<br \/>\nmaternal aunt Rupaben, Parvatiben, Bevuben and Pasuben were talking,<br \/>\nat that time, accused Amedaji Kasturji came to her house and inquired<br \/>\nfrom her father as to which village he belonged and thereafter, left.<br \/>\n Thereafter, on the night of the incident at about 1:00 o&#8217;clok, on<br \/>\nhearing sound of beating, she woke up and saw that three persons were<br \/>\nassaulting Pacha, Bhamra and Keshabhai with axe and wooden log.  It<br \/>\nis also alleged that accused Amedaji Kasturji had axe in his hand and<br \/>\nother two wearing white bush-shirts had axe and wooden log in their<br \/>\nhands and they were inflicting blows.  The evidence of PW 7 Ugamben<br \/>\nSonabhai Exh-28 also indicates that accused Amedaji was armed with<br \/>\naxe and had assaulted the deceased with axe, but the witness could<br \/>\nnot identify two other assailants.  The witness has been extensively<br \/>\ncross-examined.  It appears from the cross-examination that accused<br \/>\nAmedaji had assaulted deceased Keshabhai.\n<\/p>\n<p>9.\tThe<br \/>\nevidence of PW 8 Patuben Exh-30 indicates that on hearing the shouts<br \/>\nof PW 7 Ugamben, she woke up and saw that three persons were beating<br \/>\nthe deceased.  According to her, out of three assailants, one had<br \/>\naxe, one had dhariya and one had wooden log and she could identify<br \/>\nthe accused Amedaji but could not identify other two assailants.  The<br \/>\nwitness has been extensively cross-examined  but it becomes clear<br \/>\nthat accused Amedaji was one of the assailants and had attacked the<br \/>\ndeceased.  This indicates that accused Amedaji was involved in the<br \/>\noffence.  Therefore, the prosecution case against the accused Amedaji<br \/>\nhas been proved beyond reasonable doubt.  Therefore, the learned<br \/>\nJudge was justified in convicting the accused Amedaji.\n<\/p>\n<p>10.\tAs<br \/>\nregards conviction of accused Motilal Kasturji is concerned, none of<br \/>\nthe eye witness has identified him. Even there is no test<br \/>\nidentification parade to identify the assailant.  Therefore, there is<br \/>\nno evidence to indicate that accused Motilal Kasturji was one of the<br \/>\nassailants and had caused fatal injury to the deceased.  Therefore,<br \/>\nthe learned trial Judge committed serious error in convicting him for<br \/>\nthe offence of murder of Keshabhai Hemrajbhai, Pachabhai Madhabhai<br \/>\nand Bhamrabhai Madhabhai.  Therefore, his conviction is required to<br \/>\nbe quashed and set aside.\n<\/p>\n<p>11.\tIn<br \/>\nthe result, Criminal Appeal No.290 of 2002 is allowed.  The judgment<br \/>\nand order of conviction and sentence passed by the learned Additional<br \/>\nSessions Judge, Banaskantha at Deesa on 31.1.2002 in Sessions Case<br \/>\nNo.120 of 1999 is quashed and set aside qua accused Motilal Kasturji<br \/>\nKoli and he is ordered to set free, if not required in any other<br \/>\noffence.  The fine, if paid, is ordered to be returned to the<br \/>\naccused.\n<\/p>\n<p>\tCriminal<br \/>\nAppeal No.308 of 2002 fails and stands dismissed.  The judgment and<br \/>\norder of conviction and sentence passed by the learned Additional<br \/>\nSessions Judge, Banaskantha at Deesa on 31.1.2002 in Sessions Case<br \/>\nNo.120 of 1999, is confirmed qua accused Amedaji Kasturji Koli.\n<\/p>\n<p>(BHAGWATI<br \/>\nPRASAD, J.)<\/p>\n<p>(BANKIM<br \/>\nN.
