Civil Judge (S.D.)<br \/>\n      Surat, has passed the following orders on 19th June 1992.\n<\/p>\n<p>       &#8221; Application Ex.   5 is hereby allowed.<br \/>\n    The defendant Corporation is hereby directed to<br \/>\n        initiate the proceedings for taking action in<br \/>\n        accordance with the provisions of Town Planning<br \/>\n        Act and B.P.M.C. Act to hand over the actual<br \/>\n<span class=\"hidden_text\">        physical possession of final plot No. 103, 133<\/span><br \/>\n        and 91 to the plaintffs within Four (4) months<br \/>\n        from the date of this order. &#8221;\n<\/p>\n<p>The above said orders are in challenge    in   the<br \/>\npresent Appeal From Order before me.\n<\/p>\n<p>Upon hearing learned counsel Mr. Prashant Desai<br \/>\nfor the    Appellant- Ori.    defendant Surat Municipal<br \/>\nCorporation and learned counsel Ms. V.P. Shah for the<br \/>\nRespondents, and regard being had to the Supreme Court<br \/>\npronouncement in The Municipal Corporation for Greater<br \/>\nBombay and another, Appellants v. The Advance Builders<br \/>\n(India) Pvt.Ltd. and others, Respondents, A.I.R.  1972,<br \/>\nS.C.    793 and also to the provisions contained under<br \/>\nsection 68 of the Gujarat Town Planning And Urban<br \/>\nDevelopment Act, 1973; the said orders require to be<br \/>\nmodified as indicated hereinafter.\n<\/p>\n<p>In modification of the above said orders I would<br \/>\nsay    that,    the   Appellant-Ori.defendant    Municipal<br \/>\nCorporation shall initiate the necessary procedings for<br \/>\nsummary eviction under section 68 of the Gujarat Twon<br \/>\nPlanning &amp; Urban Development Act, 1976, within a period<br \/>\nof four weeks from the date of receipt of the writ of the<br \/>\npresent orders, and shall complete the same according to<br \/>\nlaw within     a reasonable period.     The rest of the<br \/>\ndirections in the orders under appeal shall          stand<br \/>\ndeleted.     The present Appeal succeeds to the above said<br \/>\nextent and the same is hereby partly allowed.       Appeal<br \/>\nFrom Order stands disposed of with the above said orders.<br \/>\nNo cost.
