Roy (G.A.), Bihar.\n                                            ...\n6\/15.10.2009<\/pre>\n<p>                 The petitioner is aggrieved with the order dated-16.06.2004,<br \/>\n             passed by the Respondent No. 4, whereby the punishment of forfeiture of<br \/>\n             increments in salary for a period of one year, was imposed against the petitioner.<br \/>\n             Challenging the aforesaid order of punishment as being illegal, the petitioner has<br \/>\n             also challenged the order dated 03.07.2007, passed by the Appellate Authority,<br \/>\n             namely, the Respondent No. 3 dismissing the Appeal filed by the petitioner<br \/>\n             against the impugned order of punishment.\n<\/p>\n<p>             2.            The petitioner&#8217;s case in brief is as follows: &#8211;\n<\/p>\n<blockquote><p>                                                   The petitioner was posted as a Constable<br \/>\n                                           under the District Commandant, Jharkhand Home<br \/>\n                                           Guard in the district of Garhwa and was allotted the<br \/>\n                                           work of Cash Messenger.\n<\/p><\/blockquote>\n<blockquote><p>                                                   The Disciplinary Authority had found<br \/>\n                                           reason to put the petitioner under suspension on the<br \/>\n                                           ground of misconduct and to initiate a disciplinary<br \/>\n                                           proceeding against him for specific charges.\n<\/p><\/blockquote>\n<blockquote><p>                                                   During the period of his suspension, the<br \/>\n                                           petitioner was paid subsistence allowance.\n<\/p><\/blockquote>\n<blockquote><p>                                                   At the conclusion of the enquiry, the<br \/>\n                                           Enquiry Officer found the charge against the<br \/>\n                                           petitioner not proved.\n<\/p><\/blockquote>\n<blockquote><p>                                                   However,      the   Disciplinary     Authority<br \/>\n                                           proceeded to inflict the punishment of stoppage of<br \/>\n                                           increment for one year, equivalent of two black<br \/>\n                                           marks against the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                              [2]<br \/>\n                                                       [W.P. (S) No. 6984 of 2007]<\/p>\n<p>                                       Being aggrieved with the impugned order<br \/>\n                              dated 16.06.2004 inflicting punishment of forfeiture<br \/>\n                              of increments in salary for one year, the petitioner<br \/>\n                              filed an appeal before the Appellate Authority<br \/>\n                              (Respondent No. 3),<br \/>\n                                       During this period, a Notification was<br \/>\n                              issued, whereby upon cadre bifurcation, the<br \/>\n                              petitioner was allotted the Bihar Cadre and was<br \/>\n                              relieved from his duty in the State of Jharkhand<br \/>\n                              with effect from 01.04.2005.\n<\/p><\/blockquote>\n<blockquote><p>                                       Pursuant to the cadre allotment and upon his<br \/>\n                              being relieved from his post in Jharkhand, the<br \/>\n                              petitioner joined his post in Bihar on 06.04.2005.\n<\/p><\/blockquote>\n<blockquote><p>                                       Since the Appeal filed by the petitioner<br \/>\n                              against the impugned order of punishment was not<br \/>\n                              being disposed of promptly, the petitioner filed a<br \/>\n                              writ application before this Court vide W.P. (S) No.<br \/>\n                              7849 of 2006. This Court by order dated<br \/>\n                              06.04.2007, while disposing of the writ application,<br \/>\n                              directed the Deputy Commandant General, Home<br \/>\n                              Guard, Ranchi, namely, the Respondent No. 3 to<br \/>\n                              consider and dispose of the petitioner&#8217;s Appeal,<br \/>\n                              which was pending since 2004 and to pass<br \/>\n                              appropriate orders in accordance with law within a<br \/>\n                              period    of   two    months    from    the   date   of<br \/>\n                              receipt\/production of a copy of the Court&#8217;s order.\n<\/p><\/blockquote>\n<blockquote><p>                                       Pursuant to the directions as contained in the<br \/>\n                              aforesaid writ application, the Appellate Authority<br \/>\n                              disposed of the appeal by passing the impugned<br \/>\n                              order dismissing the same by the impugned order<br \/>\n                              dated-03rd July, 2007.\n<\/p><\/blockquote>\n<p>3.             Assailing both the impugned orders, Mr. Dhananjay Kr. Dubey,<br \/>\nlearned counsel for the petitioner would submit inter alia, the following grounds: &#8211;\n<\/p>\n<blockquote><p>                              (i)      Admittedly, the Enquiry Officer did not find<br \/>\n                              the petitioner guilty of the charge levelled against<br \/>\n                              him.\n<\/p><\/blockquote>\n<blockquote><p>                              (ii)     The Disciplinary Authority was though<br \/>\n                              competent to differ from the findings of the Enquiry<br \/>\n                              Officer and to proceed on the basis of his own<br \/>\n                               [3]<br \/>\n                                                         [W.P. (S) No. 6984 of 2007]<\/p>\n<p>                               findings inferred from the materials on record, but<br \/>\n                               before doing so, it was legally incumbent upon the<br \/>\n                               Disciplinary Authority to serve a second show<br \/>\n                               cause notice upon the petitioner assigning reasons<br \/>\n                               as to why he chooses to differ from the findings of<br \/>\n                               the Enquiry Officer after serving a copy of the<br \/>\n                               Enquiry Report and after giving opportunity to the<br \/>\n                               petitioner to explain as to why the proposed extreme<br \/>\n                               punishment should not be imposed against him.\n<\/p><\/blockquote>\n<blockquote><p>                               (iii)      Before passing the impugned order, the<br \/>\n                               petitioner was neither served with any second show<br \/>\n                               cause notice nor supplied a copy of the Enquiry<br \/>\n                               Report and above all, the Disciplinary Authority did<br \/>\n                               not assign any reason for differing with the findings<br \/>\n                               of the Enquiry Officer.\n<\/p><\/blockquote>\n<blockquote><p>                                          Learned counsel adds that the punishment<br \/>\n                               under such circumstances is against the principles<br \/>\n                               of equity and natural justice and illegal and cannot<br \/>\n                               be sustained in law.\n<\/p><\/blockquote>\n<p>4.             Learned counsel for the Respondent-State, by referring to the facts<br \/>\nof the case, would concede that as it appears, before passing the impugned order<br \/>\nof punishment, the petitioner was not served with the second show cause notice<br \/>\nnor was a copy of the Enquiry Report served upon the petitioner and neither were<br \/>\nany reasons assigned by the Disciplinary Authority for differing from the findings<br \/>\nof the Enquiry officer and to this extent, the impugned order of punishment could<br \/>\npossibly be assailed by the petitioner.\n<\/p>\n<p>5.             Learned counsel, however, invites attention to certain relevant<br \/>\nissues by referring to the order of this Court, passed in the earlier writ application.<br \/>\nLearned counsel explains that the petitioner was made aware of the fact that he<br \/>\nwas allotted the State of Bihar on cadre bifurcation and was relieved from duty on<br \/>\nand from 01.04.2005. In the earlier writ application, the petitioner does not appear<br \/>\nto have challenged the impugned order of his punishment. Rather, the only prayer<br \/>\nof the petitioner was based on his grievance that the appeal preferred by him, was<br \/>\nnot being disposed of expeditiously by the Appellate Authority. Learned counsel<br \/>\nadds that considering the present position that the petitioner is no more a<br \/>\nGovernment servant under the State of Jharkhand, his remedy, if at all would be<br \/>\nbefore the appropriate Forum in the State where he is presently posted, namely,<br \/>\nthe State of Bihar.\n<\/p>\n<p>                                   [4]<br \/>\n                                                            [W.P. Having heard the learned counsel for the parties and having gone<br \/>\n      through the facts of this case, I find that the impugned order of punishment does<br \/>\n      suffer from perversity and illegality in as much as, it has been passed without<br \/>\n      observing the principles of natural justice and without observing the mandatory<br \/>\n      Rules of procedure, as laid down under the Service Code. As such, the impugned<br \/>\n      order of the petitioner&#8217;s punishment (Annexure-1) and the impugned order of the<br \/>\n      Appellate Authority (Annexure-7) are hereby set aside. The matter is however,<br \/>\n      remitted to the concerned disciplinary authority of the petitioner in the concerned<br \/>\n      Department, in the State of Bihar where the petitioner is presently employed, to<br \/>\n      reconsider the Enquiry Report submitted in respect of the petitioner and to take an<br \/>\n      appropriate decision on the same by passing a reasoned and speaking order. Such<br \/>\n      decision must however, be communicated effectively to the petitioner.\n<\/p>\n<p>                                                                  (D.G.R.
