Application No. 27\/01, whereby the direction has<br \/>\n\tbeen given to hold the election.\n<\/p>\n<p>Heard<br \/>\n\tMr. Vyas for the petitioner, Mr.Shah for Mr. Rawal for the<br \/>\n\trespondent and Mr. Shukla, learned AGP for respondent No.7.\n<\/p>\n<p>The<br \/>\n\tlearned counsel for the respondent Mr.Shah has placed on record the<br \/>\n\tcopy of the order dated 22.02.2008 passed by this Court (Coram :Akil<br \/>\n\tKureshi, J.) in Special Civil Application No. 3556\/08, whereby the<br \/>\n\tdirections are given at para 6 as under:\n<\/p>\n<p>?S6.Under<br \/>\nthe circumstances, this petition is disposed of by  giving following<br \/>\ndirections:\n<\/p>\n<p>1)\tThe<br \/>\n\tproposed election notified in the public notice dated 24.1.2008<br \/>\n\tproposed to be conducted on 24.2.2008 shall not be conducted. The<br \/>\n\tpetitioner shall issue public notice in any leading Daily of Rajkot<br \/>\n\tcancelling the election. Such notice shall be issued on 23.2.2008.\n<\/p>\n<p>2)\tRespondent<br \/>\n\tNo.1 shall conduct election for electing new trustees and  all<br \/>\n\toffice bearers and members of the executing committee as per the<br \/>\n\tconstitution within 60 days from today.\n<\/p>\n<p>3)\tTo<br \/>\n\tensure that elections are completed within the aforesaid time, all<br \/>\n\tefforts will be made by the trust from the stage of updating\/<br \/>\n\tpreparation of electoral roles and completing the election with<br \/>\n\tcounting of votes and declaration of result. This shall be done<br \/>\n\tunder supervision and in consultation with an observer of the Court<br \/>\n\twho shall be the Registrar of the District Court, Rajkot whose<br \/>\n\texpenses and remuneration shall be borne by the respondent trust. At<br \/>\n\tthe initial stage, the respondent shall deposit a sum of Rs.<br \/>\n\t20,000\/- with the District Court, Rajkot, by way of adhoc sum to be<br \/>\n\tadjusted at the time once the elections are completed. It will be<br \/>\n\topen to the observer to appropriate such reasonable sum as may be<br \/>\n\tnecessary for the expenditure without reference to the Court. His<br \/>\n\tremuneration shall however, be decided at an appropriate stage on<br \/>\n\this report.\n<\/p>\n<p>4)\tSince<br \/>\n\tthe petitioners have undertaken not to proceed further with the<br \/>\n\tprocess of holding election, regular civil suit No. 75\/2008 filed<br \/>\n\tbefore the Principal Senior Civil Judge, Rajkot does not survive and<br \/>\n\tit is stated that same will be withdrawn accordingly. Once elections<br \/>\n\tare completed, all the proceedings pertaining to conduct of the<br \/>\n\telections before different authority shall also be rendered<br \/>\n\tinfructuous.??\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tShah has further declared before the Court that pursuant to the<br \/>\n\tdirection issued by this Court, the process of election is on.\n<\/p>\n<p>Under<br \/>\n\tthese circumstances, even otherwise also, the election is not being<br \/>\n\theld pursuant to the order passed by the Charity Commissioner.<br \/>\n\tFurther, this Court at the interim stage, at the present proceedings<br \/>\n\tdid not give any direction.\n<\/p>\n<p>Hence,<br \/>\n\tno useful purpose would be served in examining the question which<br \/>\n\tare raised in the petition, more particularly pertaining to the<br \/>\n\tscope and ambit of the power of the Charity Commissioner under<br \/>\n\tSection 41A of the Act and hence, the petition can be said as having<br \/>\n\tbecome infructuous on account of the order dated 22.02.2008 passed<br \/>\n\tby this Court in Special Civil Application No. 3556\/08 referred to<br \/>\n\thereinabove.\n<\/p>\n<p>Hence,<br \/>\n\tthe present petition is disposed of as having become infructuous.<br \/>\n\tHowever, it is observed that the question raised in this petition<br \/>\n\tshall remain open.
