No.135\/91. The High Court accepted<br \/>\nthe oral  evidence that\t the yield from the land was 22 bags<br \/>\nper acre. It also accepted the deduction of 50% of the value<br \/>\nof the\tcrop for  cultivation expenses. It also accepted the<br \/>\nprevailing price  as on\t the relevant  dated as Rs.130\/- per<br \/>\nbag; 27.20  acres for  single crop wet lands and 4 acres for<br \/>\ndouble crop  wet lands.\t Therefore, it accepted the findings<br \/>\nof the\treference Court\t and modified the same to the extent<br \/>\nof single crop wet lands. Thus this appeal by special leave.\n<\/p>\n<p>     Notification  under   Section  4\t[1]  of\t  the\tLand<br \/>\nAcquisition Act,  1894 [for  short, &#8220;the Act&#8221;] was published<br \/>\non 19th August, 1983. The award under Section 11 was made on<br \/>\nApril 25,  1987. The reference Court awarded compensation on<br \/>\n8th February,  1991. On appeal, by judgment and decree dated<br \/>\n16th August,  1991, the\t High Court confirmed the award with<br \/>\nthe above modification.\n<\/p>\n<p>     It is  contended for  the State that statistics for the<br \/>\nyear 1957 show that the yield in that area was about 10 bags<br \/>\nand that,  therefore,  the  High  Court\t was  not  right  in<br \/>\nconfirming the\tcompensation at 22 bags per acre. It is seen<br \/>\nthat from  the year  1957 till 1987 considerable improvement<br \/>\nmust obviously have been made. Under those circumstances, no<br \/>\nattempt has  been made\tby the State to produce the relevant<br \/>\nstatistics  of\t the  produce\tas  on\t the  date   of\t the<br \/>\nnotification, viz.,  19th August, 1983. Therefore, we cannot<br \/>\naccept the contention of the State that the produce from the<br \/>\nlands would  be as  per the  statistics prevailing  in 1957.<br \/>\nEven accepting the valuation given by the reference Court as<br \/>\nwell as the High Court, it is settled law that multiplier of<br \/>\n10  would   be\tthe   proper  multiplier  to  determine\t the<br \/>\ncompensation when  the land  is assessed on the basis of the<br \/>\nyield of  agricultural lands.  The reference  Court  applied<br \/>\nmultiplier  of\t16  and\t the  High  Court  upheld  it.\tThis<br \/>\nobviously is  illegal and  application of wrong principle of<br \/>\nlaw.\n<\/p>\n<p>     The annual\t yield at  Rs.1430\/- should be multiplied by<br \/>\n10 and\tthe market value should be determined at Rs.14,300\/-<br \/>\nper acre. The compensation should accordingly be determined.<br \/>\nThe claimants  would also  be entitled\tto enhanced solatium<br \/>\nand interest  and also\t12% additional\tamount per  annum on<br \/>\nenhanced compensation  under the Act as amended by Act 68 of<br \/>\n1984.\n<\/p>\n<p>     The appeal is allowed accordingly.
