Later he was deputed to the  Directorate  of\nYouth  Services\t as an Assistant Director  and\tsubsequently\nconfirmed  in the said post. On 27th of March, 1978, he\t was\ntemporarily promoted as Deputy Director for a period of\t six\nmonths,\t and  an order was made on 20th December,  1978\t ap-\npointing him on a regular basis with effect from 27th March,\n1978.  Respondent  No. 1 was recruited\tdirectly  as  Deputy\nDirector  on 28.7.1978, joined service on 7.8.1978  and\t was\nconfirmed on 7.8.1980.\n    A  draft Gradation List was published on  25th  January,\n1983 wherein the appellant was shown above respondent No. 1,\nand  he represented against this placement by claiming\tsen-\niority\tover  the appellant. This was not  accepted,  and  a\nfinal  Gradation List was published on 14th September,\t1983\nmaintaining the position shown in the draft list.\n    Respondent\tNo. 1 filed a writ petition before the\tHigh\nCourt  which  was transferred to  the  State  Administrative\nTribunal. The Tribunal held that respondent No. 1 was senior\nto  the\t appellant as the promotion of 27th March,  1978  in\nfavour of the appellant was a temporarily measure and  after\nthe six months period expired, the appellant was really\t not\ncontinuing  as Deputy Director, and that the order  of\t20th\nDecember,  1978 issued by the Government could\tnot,  there-\nfore,  provide a regular retrospective promotion in view  of\nthe  special  Rules obtaining in the  State.  It  therefore,\ndirected the redrawing of the seniority list by showing\t the\nappellant below respondent No. 1.\n    Aggrieved  by the aforesaid order of the  Tribunal,\t the\nappellant  as well as the State Government filed appeals  to\nthis Court.\n696\nDismissing the appeals, this Court,\n    HELD:  1.  The Tribunal has found that  under  Karnataka\nState  Civil Services (Regulation of Promotion, Pay  &amp;\tPen-\nsion)  Rules 1973 no retrospective promotion  is  admissible\nunless\tthe  situation comes within the various\t clauses  of\nrule 2, and that the instant case was not covered by rule  2\nand,  therefore, the order of 22nd December, 1978  giving  a\nretrospective  promotion from 27.3.1978 was  not  justified.\n[698B-C]\n    2.\tAttempt\t was made to place the appellant  above\t re-\nspondent No. 1 by making shifting orders between 27.3.78 and\n22.12.1978. The appellant was Editor of Youth Karnataka even\nwhen he was confirmed as Assistant Director and the Tribunal\nhas recorded that he never worked as Assistant Director. The\nconclusion  reached  by the Tribunal cannot be\tsaid  to  be\nwrong. Its order, therefore, does not call for any interfer-\nence. [698D-E]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>    CIVIL APPELLATE JURISDICTION: Civil Appeal Nos.977 &amp; 978<br \/>\nof 1988.\n<\/p>\n<p>    From  the Judgment and Order dated 17.12.1987  Tribunal,<br \/>\nBangalore of the Karnataka Administrative in Application No.<br \/>\n4743 of 1986(T).\n<\/p>\n<p>    P.P.  Rao,\tR.B.  Datar, S.R. Bhat,\t P.  Chowdhary,\t P.R<br \/>\nRamasesh and R.P. Wadhwani for the appearing parties.<br \/>\nThe Judgment of the Court was delivered by<br \/>\n    RANGANATH MISRA, J. These are appeals by special  leave,<br \/>\nthe  first  one by Nagaraja, the main  contestant,  and\t the<br \/>\nsecond by the State of Karnataka challenging the decision of<br \/>\nthe  Karnataka\tState Administrative Tribunal by  which\t the<br \/>\nTribunal  accepted  the claim of inter-se seniority  of\t re-<br \/>\nspondent No. 1.\n<\/p>\n<p>    In the Directorate of Youth Services of the State, there<br \/>\nare  posts  of\tAssistant and  Deputy  Directors.  Appellant<br \/>\nNagaraja  joined  service under the State  Government  as  a<br \/>\nLecturer  on  6.9.1966 and came on deputation as  Editor  of<br \/>\n&#8216;Youth\tKarnataka&#8217; from 18th of August, 1976. While  working<br \/>\nas such Editor he was confirmed as an Assistant Director  in<br \/>\nthe Youth Directorate. On 27th of March, 1978, Nagaraja\t was<br \/>\ntemporarily promoted as the Deputy Director for a period  of<br \/>\nsix  months.  On 20th of October, 1978, an  order  was\tmade<br \/>\npromoting<br \/>\n<span class=\"hidden_text\">697<\/span><br \/>\nNagaraja regularly as Deputy Director and on 22.12.1978\t his<br \/>\nappointment was made on regular basis with effect from 27.3.<br \/>\n1978.\n<\/p>\n<p>    Gudodagi,  respondent No. 1, was recruited\tdirectly  as<br \/>\nDeputy Director on 28.7.1978. He joined on 7.8.1978 and\t was<br \/>\nconfirmed in the said post on 7.8.1980. The draft  Gradation<br \/>\nList  was published on 25.1.1983 wherein Nagaraja was  shown<br \/>\njust above Gudodagi. Accordingly he represented against this<br \/>\nplacement by claiming seniority over Nagaraja and when\tthat<br \/>\nwas not accepted and the final Gradation List was  published<br \/>\non 14th of December, 1983 maintaining the position shown  in<br \/>\nthe  draft list, Gudodagi filed a writ petition\t before\t the<br \/>\nKarnataka High Court which, on the constitution of the State<br \/>\nAdministrative Tribunal, was transferred to it.<br \/>\n    The\t Tribunal on heating parties has held that  Gudodagi<br \/>\nwas  senior to Nagaraja as the promotion of 27th  of  March.<br \/>\n1978,  in  favour of Nagaraja was a  temporary\tmeasure\t and<br \/>\nafter  the six months expired, Nagaraja was really not\tcon-<br \/>\ntinuing\t as  Deputy Director. The order of  December,  1978,<br \/>\ncould not provide a regular retrospective promotion in\tview<br \/>\nof  the special Rules obtaining in the\tState.\tAccordingly,<br \/>\nthe Tribunal directed re-drawing up of the seniority list by<br \/>\nshowing\t Nagaraja below Gudodagi. Thereupon, these  two\t ap-<br \/>\npeals  have  been filed&#8211;one by Nagaraja and  the  other  by<br \/>\nState of Karnataka.\n<\/p>\n<p>The promotional order of 27th March, 1978, read thus:<br \/>\n&#8220;Pending  consultation\twith the  Karnataka  Public  Service<br \/>\nCommission,  Shri  N. Nagaraja,\t Assistant  Director,  Youth<br \/>\nServices  is  temporarily promoted to  officiate  as  Deputy<br \/>\nDirector,  Youth  Services in the grade Rs.900-1750  in\t the<br \/>\nDepartment of Youth Services for a period of six months with<br \/>\nimmediate effect from the date of taking over charge of\t the<br \/>\npost or until further orders, whichever is earlier.&#8221;\n<\/p>\n<p>    The\t Tribunal  has found that Nagaraja  had\t taken\tover<br \/>\ncharge\tas Deputy Director on 13th of April, 1978,  and\t the<br \/>\nsix  month period had expired on 13th of October, 1978.\t His<br \/>\nregular\t promotion  was notified on 20th of  October,  1978.<br \/>\nTherefore, the Tribunal has not accepted Nagaraja as  Deputy<br \/>\nDirector  between  13th of October and 20th of\tOctober.  To<br \/>\nmeet that situation the notification of 22nd December, 1978.<br \/>\nhad been made, which read thus:\n<\/p>\n<p>&#8220;In continuation of Government Notification  &#8230;..  dated<br \/>\n<span class=\"hidden_text\">698<\/span><br \/>\n27.3.1978,  Sri\t N. Nagaraja, Assistant\t Director  of  Youth<br \/>\nServices is regularly promoted to officiate as Deputy Direc-<br \/>\ntor  of\t Youth Services with effect from  27th\tMarch,\t1978<br \/>\n(i.e.  date from which he was promoted to officiate  against<br \/>\nthe post)  &#8230;&#8230;  &#8221;\n<\/p>\n<p>    The Tribunal has found that under Karnataka State  Civil<br \/>\nServices (Regulation of Promotion, Pay &amp; Pension) Act, 1973,<br \/>\nno  retrospective promotion is admissible unless the  situa-<br \/>\ntion  comes within the various clauses of rule 2..  The\t in-<br \/>\nstant  case, according to the Tribunal, was not\t covered  by<br \/>\nrule 2 and, therefore, the order of 22nd of December,  1978,<br \/>\ngiving\ta  retrospective promotion from\t 27.3.1978  was\t not<br \/>\njustified.  Once  that notification goes, Gudodagi  being  a<br \/>\ndirect recruit from 7.8.1978 would be entitled to seniority.<br \/>\n    We have analytically examined the judgment of the Tribu-<br \/>\nnal  with reference to the submissions made at the  Bar.  We<br \/>\nhave  also seen the provisions of the 1973 Act, referred  to<br \/>\nabove and see no justification to take a view different from<br \/>\nwhat  has been taken by the Tribunal. From the\tsequence  of<br \/>\nevents with reference to the dates, an impression is  avail-<br \/>\nable  to be formed that attempt was made to  place  Nagaraja<br \/>\nabove  Gudodagi by making shifting orders between  27.3.1978<br \/>\nand 22.12.1978. Nagaraja was Editor of Youth Karnataka\teven<br \/>\nwhen he was confirmed as Assistant Director and the Tribunal<br \/>\nhas  recorded  that he never worked as\tAssistant  Director.<br \/>\nTaking the broad aspects of the matter into consideration we<br \/>\nare  satisfied that the conclusion reached by  the  Tribunal<br \/>\ncan  not be said to be wrong and, therefore, does  not\tcall<br \/>\nfor any interference.\n<\/p>\n<p>The  appeals  are dismissed.
