JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nAppeal preferred under clause 15 of the Letters Patent arises from<br \/>\nthe judgment and order dated 2nd March 2009 passed by the<br \/>\nlearned Single Judge in above Special Civil Application No.2246\/1991.\n<\/p>\n<p>\tThe<br \/>\nappellant then a Medical Officer Class-I filed the above Special<br \/>\nCivil Application No.2246\/1991 to challenge the seniority of the<br \/>\nMedical Officers Class-I and to claim promotion to the post of<br \/>\nMedical Officer Class-I effective from the year 1986.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Dave has appeared for the appellant. He has strenuously<br \/>\nurged that contrary to the recruitment rules the seniority of the<br \/>\nMedical Officer Class-I was arranged not on the basis of the<br \/>\ncontinuous officiation but on the basis of acquisition of<br \/>\nqualification of Diploma in Public Health.\n<\/p>\n<p>\tThe<br \/>\nrelevant recruitment rules are found on page-93 of the paper book.<br \/>\nThe rules clearly provide that the candidate must possess  a<br \/>\nDegree or Diploma in Public Health, or Hygiene, or Sanitary Science,<br \/>\nrecognised for registration as an additional qualification by the<br \/>\nGujarat Medical Council . Thus, the argument of the learned<br \/>\nadvocate runs contrary to the relevant recruitment rules and must<br \/>\nfail. The claim for promotion from the year 1986 is based on the<br \/>\nchallenge to the aforesaid seniority list dated 7th June<br \/>\n1989. Hence, the claim for promotion should also fail.\n<\/p>\n<p>\tThe<br \/>\nlearned Single Judge has rejected the claim on the grounds of delay<br \/>\nand laches  also.\n<\/p>\n<p>\tNo<br \/>\ncase for interference is made out.
