No.38105 of 2008\n    Bhikhar Sao, Son of Sri Kailash Sao, Resident of Village Tendua Pokhar, PS Aurangabad\n                         (Muffasil), District Aurangabad --- Petitioner\n                                             Versus\n                             The State Of Bihar ---- Opposite Party\n                                            -----------\n<\/pre>\n<p>2      21.7.2011                       Heard learned counsel for the petitioner and the<\/p>\n<p>                           counsel appearing on behalf of the State.\n<\/p>\n<p>                                       The petitioner is aggrieved by the order of cognizance<\/p>\n<p>                           dated 22.12.2007 passed in Aurangabad (Town) PS Case No. 224<\/p>\n<p>                           of 2007.\n<\/p>\n<p>                                       Learned counsel for the petitioner submits that he was<\/p>\n<p>                           earlier a tenant in the house of Ram Pravesh, as such the offence<\/p>\n<p>                           under Section 7 of the Essential Commodities Act cannot be<\/p>\n<p>                           attributed to the petitioner as he had nothing to do with the<\/p>\n<p>                           premises from where the recovery of K.Oil was made.<\/p>\n<p>                                       All these aspects of the matter shall be considered at<\/p>\n<p>                           the appropriate stage of the case.
