VENNKATASWAMI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t      J U D G M E N T<br \/>\nVENKATASWAMI, J.\n<\/p>\n<p>     The undisputed facts are the following :\n<\/p>\n<p>     The suit  land was\t assigned under\t an assignment\tdeed<br \/>\ndated 5.6.1897\tby one\tNambra Kurup in favour of one Rayiru<br \/>\nKurup, Madhavi\tAmma and Chiruthayi Amma. they being brother<br \/>\nand  sisters.  The  said  Rayiru  Kurup\t purported  to\thave<br \/>\nexecuted  a   registered  deed\tof  kuzhikanam(lease)  dated<br \/>\n25.5.1946 in favour of his son by name Appu Kurup (appellant<br \/>\nherein), stipulating  a sum of Rs. 5\/- and 50 coconut leaves<br \/>\nas purappadu  (rent) Though  the said Rayiru Kurup mentioned<br \/>\nthe names  of his  sisters as  co-assignees. they  were\t not<br \/>\nparties to  the said  kuzhikanam deed.\tThe legal  heirs  of<br \/>\nChiruthai   (one of  the assignees).  being respondents 4-3l<br \/>\nherein. filed  a suit  No. 642\/58 on 26.5.1958 for partition<br \/>\nof their  l\/3rd share  in the  suit land with their share of<br \/>\nfuture mesne  profits ignoring the lease (kuzhikanam) above-<br \/>\nmentioned. A  preliminary decree  in that suit was passed on<br \/>\n14.11.1960 expressly  rejecting a  claim put  forward by the<br \/>\npresent\t appellant   of\t his  tenancy  rights  in  the\tsuit<br \/>\nproperty. The appeal filed by the appellant was dismissed on<br \/>\n2.12.1963. Thereafter,\tthe plaintiffs\tin the\tsuit filed a<br \/>\npetition for  passing final  decree. On\t 16.12.1967, a final<br \/>\ndecree came  to be  passed. Against  that final\t decree. the<br \/>\nappellant  preferred  A.S.  335\/67  before  the\t subordinate<br \/>\ncourt. When  the appeal\t was pending.  Kerala  Land  Reforms<br \/>\n(Amendment) Act.  l969 came  into  force  with\teffect\tfrom<br \/>\n1.1.1970. Taking  advantage of that, the appellant moved the<br \/>\nlearned Sub-Judge  in the  pending appeal to grant him leave<br \/>\nto file\t additional ground on the basis of Sections 7 and 78<br \/>\nof the\tKerala Act  l of  1964 as amended by Act 35 of l969.<br \/>\nThe first Appellate Court allowed that application. However.<br \/>\nby a  judgment dated 22.10.1971, the appeal was dismissed on<br \/>\nthe ground that the lease deed executed by Rayiru Kurup\t was<br \/>\na collusive one and purposely created to defeat the right of<br \/>\nthe plaintiffs\tand defendants\tNos 3  to 17  in  the  suit.<br \/>\nTherefore such\ta lease\t deed cannot be pressed into service<br \/>\nto claim  fixity of tenure under Section 7 or 7B of the Act.<br \/>\nThe appellant  herein preferred\t a further Second Appeal No.<br \/>\n1074\/71 before\tthe High  Court of  Kerala. The\t High  Court<br \/>\nremanded the matter to the trial court to find out factually<br \/>\nwhether the  appellant herein who was the first defendant in<br \/>\nthe suit.  was in  possession on  1.1.1970 of  the land over<br \/>\nwhich he  claimed tenancy  rights. After  remand, the  trial<br \/>\ncourt by  judgment dated  17.11.1977 upheld the claim of the<br \/>\nappellant under\t Section 7B in respect of the plots A, B and<br \/>\nC in  the Ext. C-4 Plan filed in the suit . Accordingly. the<br \/>\nright of  the appellant\t in those plots for fixity of tenure<br \/>\nunder Section 7B was upheld. The plaintiffs (respondents Nos<br \/>\n4 to  31 herein)  preferred a  Revision to  the Kerala Hight<br \/>\nCourt against  the order  of the  trial court  and the\tHigh<br \/>\nCourt by order dated 28.5.1982 upset the trial court&#8217;s order<br \/>\nand rejected  the claim of the appellant under Section 7B of<br \/>\nthe Kerala Land Reforms Act in respect of the plots A, B and<br \/>\nC. It  is under\t these circumstances,  the present appeal is<br \/>\npreferred by the appellant.\n<\/p>\n<p>     We have  gone through  the judgments of the trial court<br \/>\nand High Court and heard counsel for the parties.<br \/>\n    We\thave seen  in the narration of the facts that Rayiru<br \/>\nKurup knowing  that there  are two  other co-assignees,\t has<br \/>\ndeliberately and  in  order  to\t deprive  his  sisters\t(co-<br \/>\nassignees)  of\ttheir  right  in  the  suit  land  cunningly<br \/>\nexecuted the  said lease  in the  year 1946. The High Court.<br \/>\napart from  noticing the  findings rendered in the suit both<br \/>\nby the trial court and by the appellate court (before remand<br \/>\nby High\t Court) to  the effect\tthat the  said lease  was  a<br \/>\ncollusive document,  and therefore,  not valid\tand bindings<br \/>\ncame to\t the same conclusion independently also. But for the<br \/>\namendment in the year 1970. the appellant would not have got<br \/>\nthe right of fixity of tenure. As a matter of fact. it is<br \/>\nnot in\tdispute that  a portion\t of the plaint schedule land<br \/>\nwas taken possession of by the heirs of another co-assignee,<br \/>\nnamely.\t Madhvi\t  Amma.\t For   some  reason  or\t other,\t the<br \/>\nplaintiffs could not take delivery of their share and in the<br \/>\nmeanwhile the  amendment to the Kerala Land Reforms Act came<br \/>\ninto force from 1.1.1970.\n<\/p>\n<p>     In all  these circumstances.  we are  not\tinclined  to<br \/>\nexercise  our\tjurisdiction  under   Article  136   of\t the<br \/>\nConstitution to\t interfere with\t the order to the High court<br \/>\nwhich has  done substantial  justice to\t the parties  in the<br \/>\nfacts and circumstances of the case.
