No.44049 of 2010\n                          ARJUN KORA son of Jagdeo Kora\n                                       Versus\n                              THE STATE OF BIHAR\n                                      -----------\n<\/pre>\n<p>2\/   14.03.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                      offence under sections 121, 121-A, 122, 120-B, 414 of the Indian<\/p>\n<p>                      Penal Code, section 25(1-B), 26 and 35 of the Arms Act, sections 3,<\/p>\n<p>                      4 and 5 of the Explosives Substance Act and section 17 of the<\/p>\n<p>                      Criminal Law Amendment Act and sections 10, 13, 16, 18, 20 and<\/p>\n<p>                      23 of the UAPA Act, 1967<\/p>\n<p>                                   It has been submitted that recoveries were not made<\/p>\n<p>                      from the conscious possession of the petitioner and he has fair<\/p>\n<p>                      antecedents.\n<\/p>\n<p>                                   Considering the same, let the petitioner, above named,<\/p>\n<p>                      be released on bail on furnishing bail bond of Rs.5,000\/- (five<\/p>\n<p>                      thousand) with two sureties of the like amount each or any other<\/p>\n<p>                      surety to be fixed by the court below to the satisfaction of the<\/p>\n<p>                      Sessions Judge, Jamui, in connection with Sessions Trial No.327 of<\/p>\n<p>                      2010) arising out of Barhat P.S. Case No. 9 of 2010, subject to the<\/p>\n<p>                      conditions (i) That one of the bailors will be a close relative of the<\/p>\n<p>                      petitioner, who will give an affidavit giving genealogy as to how he<\/p>\n<p>                      is related with the petitioner and another bailor shall be the Shankar<\/p>\n<p>                      Kora, cousin of the petitioner. The bailor will undertake to furnish<\/p>\n<p>                      information to the court about any change in the address of the<\/p>\n<p>                      petitioner, (ii) That the affidavit shall clearly state that the petitioner<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       is not an accused in any other case and, if he is, he shall not be<\/p>\n<p>       released on bail, (iii) That the bailor shall also state on affidavit that<\/p>\n<p>       he will inform the court concerned if the petitioner is implicated in<\/p>\n<p>       any other case of similar nature after his release in the present case<\/p>\n<p>       and thereafter the court below will be at liberty to initiate the<\/p>\n<p>       proceeding for cancellation of bail on the ground of misuse, (iv)<\/p>\n<p>       That the petitioner will be well represented on each date and if he<\/p>\n<p>       fails to do so on two consecutive dates, his bail will be liable to be<\/p>\n<p>       cancelled.\n<\/p>\n<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Arjun Kora vs The State Of Bihar on 14 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
