The petition was heard for<br \/>\nfinal disposal, by consent and at the request of learned counsel on<br \/>\nboth sides.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioner has called into question order dated 25.3.2011 of<br \/>\nAuthorized Officer and Co-operative Officer (Markets) in the office<br \/>\nof District Registrar of Co-operative Societies, Vadodara, whereby<br \/>\nobjection of the petitioner to inclusion of the names of members of<br \/>\nthe managing committee of respondent Nos.3 and 4 was rejected. The<br \/>\ncontroversy revolves around pure question of law as to whether<br \/>\nmembers of the co-operative society, which has been wound up, could<br \/>\nbe included in the final list of voters for election to the<br \/>\nAgricultural Produce Market Committee concerned.\n<\/p>\n<p>3.\t\tThere<br \/>\nis no dispute about the facts that respondent No.3 co-operative<br \/>\nsociety is ordered to be wound up on 08.10.2010 and respondent No.4<br \/>\nco-operative society is ordered to be wound up on 04.02.2009. The<br \/>\nonly ground mentioned in the impugned order for including the names<br \/>\nof members of the managing committee of those two co-operative<br \/>\nsocieties is that in spite of orders for winding up and appointment<br \/>\nof liquidator, the liquidator has not actually taken over charge and<br \/>\nthe managing committees had continued to manage the affairs of the<br \/>\nco-operative societies concerned. Provisions of the Gujarat<br \/>\nCo-operative Societies Act, 1961 contains in its Chapter X, the<br \/>\nprovisions for liquidation and winding up of co-operatives societies<br \/>\nand relevant provisions of Sec.108 of that Act read as under:\n<\/p>\n<p>\t&#8220;S.108\tAppointment<br \/>\nof Liquidator:\n<\/p>\n<p>\t(1)\t\t&#8230;.\t\t&#8230;.\t\t&#8230;.\n<\/p>\n<p>\t(2)\t\t&#8230;.\t\t&#8230;.\t\t&#8230;.\n<\/p>\n<p>(3)\tWhen<br \/>\na final order is made confirming the interim order, the officers of<br \/>\nthe society,<\/p>\n<p>(a)\tshall<br \/>\nhand over to the liquidator the custody and control of any property,<br \/>\neffects and actionable claims and any books, records, and other<br \/>\ndocuments pertaining to the business of the society, which for any<br \/>\nreason are not handed over to the liquidator under sub-section (2) at<br \/>\nthe time when an interim order was made.\n<\/p>\n<p>(b)\tshall<br \/>\nvacate their offices and while winding up order remains in force, the<br \/>\ngeneral body of the society shall not exercise any powers.\n<\/p>\n<p>(4)\tThe<br \/>\nliquidator shall, subject to the general control of the Registrar,<br \/>\nexercise all or any of the powers mentioned in section 110. The<br \/>\nRegistrar may remove him from his officer and appoint another in his<br \/>\nplace, without assigning any reason.\n<\/p>\n<p>(5)\tThe<br \/>\nwhole of the assets of the society shall on the appointment of the<br \/>\nliquidator vest in him and notwithstanding anything contained in any<br \/>\nlaw for the time being in force, if any immovable property is held by<br \/>\nhim on behalf of the society, the title over the land shall be<br \/>\ncomplete as soon as the title on the ground of dispossession, want of<br \/>\npossession or physical delivery of possession.&#8221;\n<\/p>\n<p>\t(6)\t\t\t&#8230;.\t&#8230;.\t&#8230;.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the admitted fact that Registrar has issued final order for<br \/>\nwinding up of the respondent societies concerned way back in the year<br \/>\n2009 and 2010, it was apparently illegal and unauthorized for anyone<br \/>\nelse, including the managing committee or the general body of<br \/>\nco-operative society, to manage the affairs of the societies and more<br \/>\nparticularly when officers of the societies were mandatorily required<br \/>\nto vacate their offices and not exercise any powers, the argument<br \/>\nthat the liquidator was required to take over charge cannot be<br \/>\naccepted.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe peculiar facts of the case and clear provisions of law and in<br \/>\nview of the fact that deletion of the names of the members of the<br \/>\nmanaging committees of respondent Nos.3 and 4 from the final voters&#8217;<br \/>\nlist is not likely to in any way hamper or impede the process of<br \/>\nelection as also the fact that the petitioner has approached the<br \/>\ncourt before publication of the final list of voters, we consider it<br \/>\nan extraordinary and exceptional case to exercise the writ<br \/>\njurisdiction of this court in order to prevent illegality  being<br \/>\ncommitted during the process of election. Accordingly, the petition<br \/>\nis allowed with the direction that the impugned order dated 25.3.2011<br \/>\nshall stand partly set aside as far as the objection of the<br \/>\npetitioner in respect of the office bearers of respondent Nos.3 and 4<br \/>\nwere concerned  and with the further direction that names of the<br \/>\nmembers of the managing committees of respondent No.3 and 4 shall<br \/>\nstand deleted from the final voters&#8217; list prepared for the election<br \/>\nto respondent No.2. Rule is made absolute accordingly, with no order<br \/>\nas to costs.
