Code??) and sentenced to<br \/>\n\tsuffer imprisonment for life with fine of Rs.3000\/- i\/d to undergo<br \/>\n\tone year&#8217;s imprisonment. However, the learned Judge has acquitted<br \/>\n\tthe appellant ?  accused from the offence punishable under Section<br \/>\n\t135 of the Bombay Police Act and Section 3(2)(5) of The Scheduled<br \/>\n\tCastes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989<br \/>\n\t(for short ?SAtrocities Act??).\n<\/p>\n<p>The<br \/>\n\tfacts of the prosecution case is that the complainant Ramabhai<br \/>\n\tMotibhai, residing at Harijanvas, Bavlu, Taluka Kadi, District<br \/>\n\tMehsana has filed complaint before Police Inspector, Bavlu Police<br \/>\n\tStation, intere-alia stating therein that at about 8.00 hours in the<br \/>\n\tevening when he was taking dinner, his son named, Bharat returned<br \/>\n\thome with tractor and told him that Thakore Rameshji @ Hengo Khodaji<br \/>\n\thas come in the village and he had stolen wheats from their compound<br \/>\n\t(Vada) before 6 months and I have seen him today. On saying so he<br \/>\n\thad gone out. After some time i.e. at about 8.30 p.m. Thakore<br \/>\n\tRameshji Arjanji had rushed to the house of complainant and told<br \/>\n\tthat Henga has stabbed his son Bharat with knife in the Danavala<br \/>\n\tStreet and Bharat was lying in the compound of Henga. On hearing the<br \/>\n\tsaid incident the complainant along with his wife Ramilaben had<br \/>\n\trushed to the street where Bharat was lying on the earth and could<br \/>\n\tnot speak anything. His shirt was stained with blood. Below his<br \/>\n\tchest there was big wound caused with knife blow and from the said<br \/>\n\tblow he was profusely bleeding. Another knife blow was also found<br \/>\n\tnear the said first blow. Thereafter, the complainant, along with<br \/>\n\this wife and Govindbhai Bababhai, Shivabhai Mohanbhai, Jethabhai<br \/>\n\tKhushalbhai, Thakore Rameshji Arjanji, Thakore Javanji Chundaji had<br \/>\n\ttaken injured Bharat in a Jeep to the Bhagyoday Hospital at Kadi for<br \/>\n\ttreatment. On examination the doctor declared that the Bharat is<br \/>\n\tdead on the way. The complainant has stated before the Police that<br \/>\n\tthe cause of the incident is that before 6 months Thakor Rameshji @<br \/>\n\tHengo Khodaji had stolen wheat from their compound (Vada) and ran<br \/>\n\taway from the village. He came on the date of incident and on seeing<br \/>\n\thim deceased Bharat had scolded him and therefore he had given blows<br \/>\n\tof knife to Bharat and ran away. While taking him to the hospital,<br \/>\n\ton the way, Bharat died. The said complaint was given to the Police<br \/>\n\tInspector in Bhagyoday Hospital.\n<\/p>\n<p>The<br \/>\n\tPolice has lodged the complainat and registered the offence against<br \/>\n\tthe appellant ?  accused. The statement of witnesses were recorded.<br \/>\n\tThereafter the Panchnama of scene of incident, Inquest Panchnama,<br \/>\n\tPanchnama of recovery of muddamal articles Knife  and the clothes of<br \/>\n\tthe accused and the panchnama of physical condition of the accused<br \/>\n\twere drawn. Thereafter the Dead Body of the deceased was sent to<br \/>\n\tHospital for autopsy and the Muddamal articles were sent to Forensic<br \/>\n\tScience Laboratory for scientific analysis and all the reports were<br \/>\n\ttagged with the investigation papers. Thereafter, the Police filed<br \/>\n\tcharge-sheet against the present appellant ?  accused for the<br \/>\n\toffence punishable under Section 302 I.P. Code as well as under the<br \/>\n\tprovision of Section 135 of the Bombay police Act and Section<br \/>\n\t3(1)(5) of Atrocities Act.\n<\/p>\n<p>The<br \/>\n\ttrial Court framed charge (Exh.2) against the accused. The appellant<br \/>\n\t?  accused has not pleaded guilty to the charge and the case was<br \/>\n\tproceeded against the present appellant ?  accused.\n<\/p>\n<p>In<br \/>\n\torder to bring home the charge levelled against the accused, the<br \/>\n\tprosecution has examined in all 9 witnesses and relied upon their<br \/>\n\toral testimonies. They are as under :\n<\/p>\n<p>P.W.1  &#8211;\tBharatkumar Sumankumar Acharya, Medical Officer,Ex.8<\/p>\n<p>P.W.2  &#8211;\tRamabhai Motibhai Chamar, complainant, Exh.9<\/p>\n<p>P.W.3  &#8211;\tNarsinhbhai Alabhai Chamar ?  Panch, Exh. 11<\/p>\n<p>P.W.4  &#8211;\tRajendrakumar Anandray Acharya ?  M.O., Exh.20<\/p>\n<p>P.W.5  &#8211;\tPrahladbhai Alabhai Parmar, Ex.22;\n<\/p>\n<p>P.W.6  &#8211;\tBachubhai Laxmanbhai Parmar, Ex.23;\n<\/p>\n<p>P.W.7  &#8211;\tP.S.I. Dhanji Ranaji Jadeja, Ex.24;\n<\/p>\n<p>P.W.8  &#8211;\tDy.S.P. Somdat Hajiralal Sharma, Ex.25;\n<\/p>\n<p>P.W.9  &#8211;\tBabuji Maganji Thakor, Panch ?  Exh.35<\/p>\n<p>To prove the culpability of the accused, the prosecution<br \/>\nhas also produced and relied upon the following documentary evidence.<br \/>\nThey are as under:\n<\/p>\n<p>(1)\tComplaint ?  Exh.10<\/p>\n<p>(2)\tPanchnama of Scene of Offence, Exh.12;\n<\/p>\n<p>(3)\tInquest Panchnama, Exh.13;\n<\/p>\n<p>(4)\tPanchnama of physical condition of accused, Ex.14;\n<\/p>\n<p>(5)\tPanchnama of clothes recovered from the dead body of deceased,<br \/>\n\tEx.15<\/p>\n<p>(6)\t&#8211; do ?  Exh.16<\/p>\n<p>(7)\tCopy of station diary, Ex.17<\/p>\n<p>(8)\tPost Mortem Report of deceased, Ex.18<\/p>\n<p>(9)\tRavangi Yadi of F.S.L., Ex.19<\/p>\n<p>(10)\tPost Mortem Note, Ex.21<\/p>\n<p>(11)\tMedical Certificate of accused Ramesh Thakor ? Report, Ex.30<\/p>\n<p>(17)\tDepute Order, Ex.31<\/p>\n<p>(18)\tWritten arguments on complainant side, Ex.33.\n<\/p>\n<p>Thereafter,<br \/>\n\tafter examining the witnesses, the statement of accused under<br \/>\n\tSection 313 Cr. P.C. was recorded in which the appellant has<br \/>\n\tcontended that he is innocent and he has been falsely implicated in<br \/>\n\tthe said offence.\n<\/p>\n<p>After<br \/>\n\tconsidering the oral as well as documentary evidence the learned<br \/>\n\tSpecial Judge (Atrocities), Mehsana, vide impugned Judgment and<br \/>\n\tOrder dated 9.8.2001 in Special (Atrocities) Case No.104 of 2000<br \/>\n\theld the present appellant ?  accused guilty to the offence<br \/>\n\tpunishable under Section 302 I.P. Code and sentenced him to suffer<br \/>\n\tRigorous Imprisonment for life and to pay fine of Rs.3000\/- i\/d to<br \/>\n\tundergo further imprisonment for one year.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the impugned Judgment and order<br \/>\n\tof conviction and sentence passed by the learned Special Judge<br \/>\n\t(Atrocities), Mehsana, the present appellant ?  original accused<br \/>\n\thas filed this Appeal, through Jail.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. J.M. Budhbhatti, appointed through Legal Aid<br \/>\n\tCommittee, for the appellant ?  accused and Mr. K.C. Shah, learned<br \/>\n\tAPP for the respondent ?  State, at length.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tBudhbhatti, learned Advocate, has contended that the prosecution has<br \/>\n\tfailed to prove the allegations against the present appellant ?<br \/>\n\taccused. He has also contended that in the present case there was<br \/>\n\tonly one eye witness and from the oral evidence of eye witness it<br \/>\n\twas established before the trial Court that due to darkness the<br \/>\n\twitness was unable to see and, therefore, the prosecution has failed<br \/>\n\tto prove its case beyond reasonable doubt. He has also contended<br \/>\n\tthat the recovery of weapon is not proved. He has also read the oral<br \/>\n\tevidence of the Police personnel and contended that the present<br \/>\n\tappellant ?  accused was found by them under the influence of<br \/>\n\tAlcohol and he has also received some injuries and the said injuries<br \/>\n\ton the person of accused is not explained by the prosecution. It is<br \/>\n\talso one of the fatal lacuna in the prosecution case and the benefit<br \/>\n\tis required to be given to the present appellant ?  accused. Mr.<br \/>\n\tBudhbhatti has also contended that from the evidence of Medical<br \/>\n\tOfficer it was established before the trial Court that only single<br \/>\n\tblow was found from the body of the deceased and looking to the<br \/>\n\tinjury of single blow the ingredients of murder cannot be proved by<br \/>\n\tthe prosecution. He, therefore, contended that the act of the<br \/>\n\tappellant ?  accused is required to be considered that the accused<br \/>\n\thas not committed the offence with intention to kill deceased. He<br \/>\n\thas also contended that the evidence of panch witnesses as well as<br \/>\n\tthe witnesses of family of deceased cannot be considered as they are<br \/>\n\tinterested witnesses. He has also prayed that the sentence of<br \/>\n\timprisonment of life is also very harsh. Lastly, Mr. Budhbhatti has<br \/>\n\tcontended that the Judgment and Order rendered by the trial Court is<br \/>\n\tnot proper, legal and against the provisions of law and, therefore,<br \/>\n\tthe same requires to be quashed.\n<\/p>\n<p>On<br \/>\n\tbehalf of the State Mr. K.C. Shah, learned A.P.P. has contended that<br \/>\n\tthere is voluminous reliable, trustworthy and clinching evidence on<br \/>\n\trecord which unequivocally and unerringly proves that the appellant<br \/>\n\t?  accused has committed murder of deceased. Even the motive,<br \/>\n\tpreparation and intention of the present appellant ?  accused is<br \/>\n\talso proved. He also contended that from the complaint itself it is<br \/>\n\testablished that there was a previous enmity between the present ?<br \/>\n\tappellant ?  accused and the complainant as the accused has<br \/>\n\tcommitted theft and when the deceased scolded him the accused has<br \/>\n\tcommitted murder. Evidence of single eye witness cannot be thrown<br \/>\n\taway. Eye witness has deposed that the the appellant ?  accused has<br \/>\n\tduring exchange of hot discussion took out the knife and gave blow<br \/>\n\tof knife on the vital part of the body i.e. on the chest of the<br \/>\n\tdeceased and due to said injury the deceased has collapsed.\n<\/p>\n<p>We<br \/>\n\thave gone through the oral as well as documentary evidence led by<br \/>\n\tthe prosecution. We have also perused the submission made by both<br \/>\n\tthe parties. From perusal of oral evidence of P.W.1 (Exh.8) Dr.<br \/>\n\tBharatkumar Sumankumar Acharya, who is an independent and<br \/>\n\trespectable witness, it transpires that he has carried out autopsy<br \/>\n\ton the dead body of deceased. We have perused the oral evidence of<br \/>\n\tthis witness. This witness has carried out autopsy and explained the<br \/>\n\tinjuries on the deceased, which are as under :\n<\/p>\n<p>\tSemilunar wound on epigastrium just below the sternum 2<br \/>\ncm long and 1 cm broad with straight border below and convexity up<br \/>\nwards convex border more sharp with everted edges on probing the<br \/>\nwound, it is going upwards towards chest and slightly to the left, it<br \/>\nis 7 cm deep with blood clotted on edges;\n<\/p>\n<p>\tA cherp scratches on abdomen directed from lateral to<br \/>\nmediate 7 cm long and 7 cm below the wound No.(1).\n<\/p>\n<p>The doctor opined that cause of death is due to cardiac<br \/>\narrest due to injury to right atrium of heart that is wound No.(1).\n<\/p>\n<p>This expert witness has opined that injury on the<br \/>\ndeceased was possible by forceful blow of knife and the injury was<br \/>\nsufficient to cause death of deceased.\n<\/p>\n<p>Previous<br \/>\n\tenmity between the deceased and the appellant ?  accused was<br \/>\n\testablished by the oral evidence of P.W.2 ?  complainant Ramabhai<br \/>\n\tMotibhai Chamar, father of deceased. This witness has stated on oath<br \/>\n\tthat when I was taking dinner in the evening at about 8.00 O&#8217;clock<br \/>\n\this son (deceased) came and told that Ramesh @ Hengo (present<br \/>\n\tappellant ?  accused) who has committed theft of wheat from their<br \/>\n\tcompound (vada) before six months has come and thereafter he rushed<br \/>\n\tto the place of incident. We have perused the complaint as well as<br \/>\n\toral testimony of this witness. It is on record that prior to the<br \/>\n\tincident the present appellant ?  accused has committed theft of<br \/>\n\twheat and then he was absconded and when he came after six months<br \/>\n\tthe deceased scolded him and at that time, along with complainant,<br \/>\n\teye witness Prahladbhai, P.W.5, Ex.22, accompanied with the deceased<br \/>\n\tand went to the appellant ?  accused and in presence of this<br \/>\n\twitness (Prahladbhai) the deceased has called the accused from his<br \/>\n\thouse and when the accused came hot discussion took place between<br \/>\n\tthe accused and the deceased, at that time accused pulled out knife<br \/>\n\tand gave one blow of knife below the chest of deceased and ran away,<br \/>\n\tthe deceased was transported to the hospital where on the way<br \/>\n\tdeceased succumbed to the injury. Motive is explained by this<br \/>\n\twitness. It has not come on record that this witness Prahladbhai has<br \/>\n\tany enmity with the appellant ?  accused. Therefore, he has no<br \/>\n\treason to falsely implicate the accused with the crime.\n<\/p>\n<p>We<br \/>\n\thave also perused the evidence of P.W.3 ?  Narsinhbhai Alabhai<br \/>\n\tChamar (Ex.11), who is one of the panch of panchnama of scene of<br \/>\n\toffence (Exh.12). The Inquest Panchnama (Exh.13) as well as the<br \/>\n\tpanchnama of scene of offence and the oral evidence of the<br \/>\n\tcomplainant and eye witness the injury mentioned in the panchnama<br \/>\n\tare corroborated with the oral evidence of witnesses. We have also<br \/>\n\tperused the panchnama of recovery of clothes of deceased under the<br \/>\n\trecovery panchnama and the panchnama of physical condition of<br \/>\n\taccused (Ex.14) and the oral evidence of Medical Officer Dr.<br \/>\n\tRajendrakumar Anandray Acharya (Ex.20) and the Medical Certificate<br \/>\n\t(Exh.21) issued by him. It is true that Dr. Acharya (Ex.20) has also<br \/>\n\texamined the appellant ?  accused. On examination the doctor found<br \/>\n\tthat accused is having injury of CLW 2 cm x 1 cm skin deep on the<br \/>\n\tforehead. The prosecution has already explained this injury on the<br \/>\n\tappellant accused, therefore, the question regarding injury received<br \/>\n\tby the appellant ?  accused cannot arise for appreciation.\n<\/p>\n<p>The<br \/>\n\tprosecution has also examined P.W. 6 Bachubhai Laxmanbhai Parmar. He<br \/>\n\tis a Police Constable. On the date of incident he was on duty. This<br \/>\n\twitness has deposed that he, along with  P.S.I. Jadeja, Head<br \/>\n\tConstable Lakhubha and Head Constable Shankerbhai, Police Constable<br \/>\n\tLalsing and A.S.I. Vaghubhai, had gone to the place of incident in a<br \/>\n\tGovernment vehicle. The accused was not there at the place of<br \/>\n\tincident, but, the accused was lying on earth near the house of<br \/>\n\tBhopaji. On being asked by P.S.I. Jadeja, he said that his name is<br \/>\n\tRameshji @ Hengo. On interrogation by P.S.I. Jadeja the knife with<br \/>\n\tblood stains was found out from the back side pocket of the pant of<br \/>\n\tthe accused which was recovered by the P.S.I. after drawing the<br \/>\n\tpanchnama. This witness is a Police constable and not related to the<br \/>\n\tcomplainant. He has no enmity with the accused. He is an independent<br \/>\n\twitness. He has no interest in the result of the case and,<br \/>\n\ttherefore, his testimony cannot be discarded. We have also perused<br \/>\n\tthe circumstantial evidence produced by the prosecution. We have<br \/>\n\talso gone through the Serological Report, F.S.L. Report, Medical<br \/>\n\tCertificates, Post Mortem Report.\n<\/p>\n<p>Looking<br \/>\n\tto the facts and circumstances of the case as well as deposition of<br \/>\n\tprosecution witnesses, this is not a case of single witness as<br \/>\n\tcontended by Mr.Supehia, learned Advocate for the appellant ?<br \/>\n\taccused. We have also not found any contradictory evidence produced<br \/>\n\tby the prosecution. From the evidence of the complainant it is also<br \/>\n\tproved that there was a previous enmity between the deceased and the<br \/>\n\taccused as the accused has committed a theft of wheat from the<br \/>\n\tcompound (Vada) of the complainant before about six months i.e.<br \/>\n\tprior to the incident and when the deceased scolded the accused, he<br \/>\n\tinflicted knife blow on the deceased. Therefore, the contention of<br \/>\n\tMr.Supehia that this is a case of single witness cannot be<br \/>\n\tbelievable.\n<\/p>\n<p>The<br \/>\n\tHon&#8217;ble Apex Court in a number of decisions held that ?Sit is not<br \/>\n\tthe duty of the appellate Court when it agrees with the view of<br \/>\n\ttrial Court on the evidence either to restate the effect of the<br \/>\n\tevidence or to reiterate the reasons given by the trial Court.??<br \/>\n\tThe said law is laid down by the Hon&#8217;ble Court in the case of (1)<br \/>\n\tGIRIJANANDINI DEVI &amp; ORS. V\/s. BIJENDRA NARAIN CHOUDHARY,<br \/>\n\treported in AIR 1967 SC 1124, and (2) in the case of STATE<br \/>\n\tOF KARNATAKA v\/s. HEMAREDDY &amp; ANR., reported in AIR 1981<br \/>\n\tSC 1417. Yet, in the interest of justice and to observe said<br \/>\n\tcause of Appeal in a legal way, we have discussed the evidence as<br \/>\n\twell as the reasons assigned by the trial Court.\n<\/p>\n<p>As<br \/>\n\tobserved and discussed at length, in our opinion, the prosecution<br \/>\n\thas proved its case beyond reasonable doubt. There is no reason for<br \/>\n\tthe complainant and the witnesses to falsely involve the appellant ?<br \/>\n\taccused. The appellant ?  accused has not explained anything during<br \/>\n\trecording his further Statement under Section 313 Cr.P.C. From the<br \/>\n\toral as well as documentary evidence adduced by the prosecution, in<br \/>\n\tour opinion, the learned trial Judge has rightly convicted and<br \/>\n\tsentenced the appellant ?  accused. Therefore, the conviction and<br \/>\n\tsentence awarded by the trial Court against the appellant ?<br \/>\n\taccused does not call for any interference of this Court in exercise<br \/>\n\tof appellate powers.\n<\/p>\n<p>We<br \/>\n\tfind ourselves in complete agreement with the said finding, ultimate<br \/>\n\tconclusion and resultant order of conviction passed by the trial<br \/>\n\tCourt and we are of the view that no other conclusion except the one<br \/>\n\treached by the trial Court is possible in the instant case as the<br \/>\n\tevidence on record stands. Therefore, there is no valid reason or<br \/>\n\tjustifiable ground to interfere with the impugned Judgment and order<br \/>\n\tof conviction and sentence.\n<\/p>\n<p>For<br \/>\n\tthe forgoing reasons the Appeal fails and is hereby dismissed. The<br \/>\n\tJudgment and order of conviction and sentence dated 9.8.2001<br \/>\n\trecorded by the trial Court against the appellant ?  accused in<br \/>\n\tSpecial (Atrocities) Case No.104 of 2000 is confirmed and<br \/>\n\tmaintained.
