Application No.52 of 2002 whereby, the<br \/>\nsaid application was allowed.\n<\/p>\n<p>2.0\tThe<br \/>\nbrief facts of the case are that deceased   Kadarbhai Hussainbhai<br \/>\nwas working as a Driver of the Auto-rickshaw bearing registration No.<br \/>\nGJ-11-T-3238, belonging to respondent no. 6 herein.  On 02.10.2002,<br \/>\nduring noon hours, while deceased   Kadarbhai was going towards<br \/>\nMangrol from Madhavpura in the said Auto-rickshaw, it met with an<br \/>\naccident. As a result thereof, the deceased sustained severe bodily<br \/>\ninjuries and was admitted in a private Hospital. However, on<br \/>\n03.10.2002, he succumbed to the injuries.\n<\/p>\n<p>2.1\tThe<br \/>\nlegal heirs of the deceased, therefore, filed an application before<br \/>\nthe learned Commissioner under the W.C. Act, Junagadh, claiming<br \/>\ncompensation of Rs.4,00,000\/- together with interest. The Court<br \/>\nbelow, after appreciating the evidence on record, allowed the said<br \/>\napplication. Hence, this appeal by original opponent no. 2<br \/>\nInsurance Company.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Learned Advocate for the appellant   Insurance Company<br \/>\ncontented that though a specific contention was raised with regard to<br \/>\nthe possession of a valid licence by the deceased at the relevant<br \/>\npoint of time, the Court below has not framed any issue regarding the<br \/>\nsaid aspect.\n<\/p>\n<p>4.\tI<br \/>\nhave gone through impugned judgment passed by the Court below and<br \/>\nfind that the said contention raised by the Insurance Company<br \/>\ndeserves consideration.\n<\/p>\n<p>5.\tConsidering<br \/>\nthe facts of the case, I am of the opinion that instead of deciding<br \/>\nthe matter on merits, it would be appropriate to remand the matter to<br \/>\nthe Court below so as to enable the Court below to consider the<br \/>\nmatter afresh, after framing issue regarding the said aspect.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, the appeal is partly allowed. The impugned judgment<br \/>\npassed by the Court below is quashed and set aside. The matter is<br \/>\nremanded to the Court below for consideration afresh, after framing<br \/>\nnecessary issue regarding the aspect of valid licence. The Court<br \/>\nbelow will dispose of the matter, as expeditiously as possible,<br \/>\npreferably within a period of six months from the date of receipt of<br \/>\nwrit of this order. It is clarified that this Court has not entered<br \/>\ninto the merits of the matter and the Court below while considering<br \/>\nthe matter afresh shall not be influenced by the fact that this Court<br \/>\nhas quashed its earlier order. The amount deposited by the appellant<br \/>\n  Insurance Company will be invested for a further period of six<br \/>\nmonths and the interest accrued thereupon will not be disbursed and<br \/>\nwill be accumulated, till the final outcome in the matter. R &amp; P<br \/>\nto be sent back to the trial Court concerned forthwith. No order as<br \/>\nto costs.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
