Patel waives service<br \/>\nof the Rule on behalf of the opponents.\n<\/p>\n<p>2.\tPresent<br \/>\nCivil Applications have been preferred for condonation of delay of<br \/>\n1260 days in preferring First Appeals against the judgment and award<br \/>\npassed by the trial Court.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned A.G.P. for the applicant and looking to the facts<br \/>\nand circumstances of the case, it appears that because of poverty and<br \/>\nnon-availability of the funds to pay court fee for filing First<br \/>\nAppeal, present applicant could not prefer the First Appeal. Looking<br \/>\nto the facts and circumstances of the case, it appears that the<br \/>\namount awarded by the trial Court has been deposited before the trial<br \/>\nCourt and same has been allowed to be withdrawn by the applicant and<br \/>\nonly because of withdrawal of amount by the applicant, he is able to<br \/>\nprefer the First Appeal and he is also able to pay court fee. Thus,<br \/>\nthe poverty has prevented the present applicant to prefer the First<br \/>\nAppeal.\n<\/p>\n<p>4.\tLooking<br \/>\nto the reasons stated in the Civil Application, there are reasonable<br \/>\nreasons for condonation of delay. In view of the aforesaid facts, the<br \/>\ndelay caused in filing First Appeal against the judgment and award<br \/>\npassed by the trial Court, is hereby condoned. Even otherwise the<br \/>\nreasons stated in the Civil Applications are not controverted by<br \/>\nrespondents.
