The<br \/>\n\tinjunction was initially not granted by the DRT, whereas the<br \/>\n\tappellate Tribunal (DRAT) granted injunction on condition to deposit<br \/>\n\tthe amount of Rs.11.25 lac.\n<\/p>\n<p>The<br \/>\n\tcontention of the petitioner is that the petitioner would deposit<br \/>\n\tthe amount if the property is to be released in his favour.\n<\/p>\n<p>Such<br \/>\n\tcontention, if accepted, would result into diluting the order, on<br \/>\n\tthe stand which is sought to be canvassed, but was not accepted by<br \/>\n\tthe Tribunal.  Further in a petition under Article 227 of the<br \/>\n\tConstitution of India, if the matter is examined as per the settled<br \/>\n\tlegal position for judicial review, it cannot be said that there is<br \/>\n\tany error apparent on the face of record, nor the discretions<br \/>\n\texercised by the Tribunal or the Appellate Tribunal are so perverse,<br \/>\n\twhich may call for interference by this Court under Article 227 of<br \/>\n\tthe Constitution of India.\n<\/p>\n<p>Apart<br \/>\n\tfrom the above, in any event, the matter is still pending before the<br \/>\n\tTribunal.    The petitioner, if desirous to buy the property by<br \/>\n\toffering a better price, they may move the Tribunal, but the order<br \/>\n\twhich is passed by the Appellant Tribunal does not call for<br \/>\n\tinterference.
