NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.  We have  heard learned  counsel on both<br \/>\nsides.\n<\/p>\n<p>     The third\trespondent, Dr.\t B.S. Goel, while working as<br \/>\nHead the  Department of\t Statistics in\tMMD Degree  College,<br \/>\nModinagar  had\t gone  on   foreign  assignment\t  in   Basra<br \/>\nUniversity, Iraq  for a\t period of one year. Subsequently, a<br \/>\nletter was  written by\tthe Managing Committee on August 20,<br \/>\n1979 seeking the third respondent to join duty. Since he did<br \/>\nnot  join   the\t duty,\t the  Managing\tCommittee  passed  a<br \/>\nResolution to hold an enquiry into unauthorised absence from<br \/>\nduty. On  27.2.1980, a charge-sheet in the shape of a letter<br \/>\nwas sent  to respondent\t No.3. He did not participate in the<br \/>\nenquiry.  The\tEnquiry\t Officer  submitted  his  report  on<br \/>\n19.6.1980. The\tManaging Committee,  on consideration of the<br \/>\nreport, dismissed  the third  respondent on 31.7.1980 stated<br \/>\nthat  since   the  third  respondent  had  gone\t on  foreign<br \/>\nassignment, with  the  approval\t giving\t by  the  appellant-<br \/>\nManagement, termination without giving an opportunity to the<br \/>\nrespondent to  join duty is not proper. Accordingly, a cable<br \/>\nwas sent to the third respondent university as under:\n<\/p>\n<blockquote><p>     &#8220;ON 20.1.1981,  the University sent<br \/>\n     him a  cable on  his Basrah address<br \/>\n     and  had\talso  sent   a\tcopy  in<br \/>\n     confirmation  of  the  above  cable<br \/>\n     that he  should join  M.M. College,<br \/>\n     Modi Nagar\t (Ghaziabad) immediately<br \/>\n     and latest\t by 15th  February, 1981<br \/>\n     positively failing\t which the Vice-\n<\/p><\/blockquote>\n<pre>     Chancellor\t  will\t  approve    the\n     termination  proceedings\tin  this\n     case.\"\n<\/pre>\n<blockquote><p>     Admittedly, the  third respondent, Dr.B.S. Goel did not<br \/>\njoin the  duty by  the prescribed time. Consequently, he was<br \/>\nnot taken  to the  duty when  he later\ton reported for duty<br \/>\nafter coming  to India. He filed a writ petition in the High<br \/>\nCourt. The  High Court, in the impugned order, dated January<br \/>\n8, 1996,  in Writ  Petition No.9343\/81,\t has held that since<br \/>\nthe approval of termination was not given earlier, the Vice-\n<\/p><\/blockquote>\n<p>Chancellor had\tno power  to review  the  order\t and  accord<br \/>\nsanction for termination by the proceedings dated 21.2.1981.\n<\/p>\n<p>     We find  that the\tview taken  by the High Court is not<br \/>\ncorrect. The  approval sought  by the  appellant  for  third<br \/>\nresponden&#8217;s absence from service was after the expiry of the<br \/>\nperiod of  foreign assignment.\tNecessarily, he,  therefore,<br \/>\nunauthorisedly remained\t absent from  duty. Approval  by the<br \/>\nVice-Chancellor to  the dismissal of teacher from service is<br \/>\na pre-condition\t and the Vice-Chancellor had passed on order<br \/>\nwith a\tdirection to  give further  opportunity for joining.<br \/>\nLetter dated  15.2.1981 is  a  conditional  letter.  On\t his<br \/>\nfailure to  join duty,\tthe approval  of the Vice-Chancellor<br \/>\nstood accorded. Under these circumstance, the removal of the<br \/>\nrespondent from\t service is  accordingly in  accordance with<br \/>\nlaw.\n<\/p>\n<p>     The appeal\t is accordingly allowed. The judgment of the<br \/>\nHigh Court  stands reversed. The writ petition dismissed.
