KRISHNAN, J.\n                  ...........................................\n                   R.P.(F.C).No.95 OF 2007\n                 .............................................\n           Dated this the 21st day of January, 2010.\n\n                               O R D E R\n<\/pre>\n<p>      This revision is preferred             against         the order of the<\/p>\n<p>Family Court, Kottayam in M.C.No.68\/2004. The wife and<\/p>\n<p>two children moved an application for maintenance and the<\/p>\n<p>court below awarded maintenance at the rate of Rs.2,000\/=<\/p>\n<p>to the wife and Rs.1,000\/= each to the children. It is against<\/p>\n<p>that decision,    the husband has come up in revision for<\/p>\n<p>reduction of the maintenance.\n<\/p>\n<p>      2. Heard the learned               counsel           for the   revision<\/p>\n<p>petitioner.  The learned counsel very                     strongly contends<\/p>\n<p>before me that it was the recalcitrant attitude of the wife<\/p>\n<p>that had resulted in separation. The present wife is the<\/p>\n<p>second wife and there are children to the husband in the<\/p>\n<p>first wife who also depends               on him.          The second wife is<\/p>\n<p>refusing to look after the children in the first wife and that<\/p>\n<p>had created gulf between the parties and their                       separate<\/p>\n<p>living.\n<\/p>\n<p>      3. The wife on the other hand would contend that she<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nR.P.(F.C).No.95 OF 2007<\/p>\n<p>is not being properly looked after and therefore she is living<\/p>\n<p>separately. Both of them had reached the stage of non<\/p>\n<p>union and therefore considering the materials, I do not<\/p>\n<p>want to disturb the finding regarding         entitlement of the<\/p>\n<p>maintenance. The only question survives is regarding the<\/p>\n<p>quantum. According to the wife, her husband is working as<\/p>\n<p>a cashier and his mother was an employee in a bank and<\/p>\n<p>his first wife   was also    employed and she is no more.<\/p>\n<p>According to the wife, there is pension for the mother and<\/p>\n<p>the children of the first wife also getting her family pension<\/p>\n<p>besides the salary of the husband.          The husband is only<\/p>\n<p>having 6 cents of property.        It is also contended that the<\/p>\n<p>wife is suffering from carcinoma over the Ovary and<\/p>\n<p>undergoing constant medical attention.          The children are<\/p>\n<p>studying in reputed schools and documents are produced<\/p>\n<p>to show that an mount of Rs.4,070\/= is paid as fees annually.<\/p>\n<p>So, in this background the court below fixed the quantum.<\/p>\n<p>One cannot hold that it as an excess amount but it is<\/p>\n<p>submitted that husband has to look after the needs of the<\/p>\n<p>children. So taking note of the entire situation, I think<\/p>\n<p><span class=\"hidden_text\">                             : 3 :<\/span><br \/>\nR.P.(F.C).No.95 OF 2007<\/p>\n<p>leniency to the maximum possible extent of reduction is by<\/p>\n<p>Rs.250\/= of maintenance to the wife. The revision petition<\/p>\n<p>is disposed of accordingly.\n<\/p>\n<p>      4. Therefore the revision   petition is disposed of  by<\/p>\n<p>modifying   the maintenance amount       to Rs.1,750\/= to the<\/p>\n<p>wife and retaining the amount of Rs.1,000\/= each to the<\/p>\n<p>children and payable from the date of petition.<\/p>\n<p>      Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                  M.N.
