The<br \/>\n\tappeal being Criminal Appeal No.234 of 2010 preferred before the<br \/>\n\tSessions Court was partly allowed and conviction for the offences<br \/>\n\tpunishable under the Dowry Prohibition Act was quashed and set aside<br \/>\n\thowever conviction for the offence under Sec.498-A and 323 of IPC<br \/>\n\twas maintained by the learned Principal Judge, Ahmedabad City vide<br \/>\n\tjudgment and order dated 7-4-2011.\n<\/p>\n<p>It<br \/>\n\tis submitted that applicant was on bail during trial and during<br \/>\n\tpendency of appeal. He is aged 53 years and is suffering from<br \/>\n\tvarious ailments. Taking into consideration the above facts  and<br \/>\n\talso the sentence awarded on the applicant by the trial court, the<br \/>\n\tapplication deserves to be allowed.\n<\/p>\n<p>This<br \/>\n\tapplication is allowed. Pending hearing and final disposal of Cri.<br \/>\n\tRevision Application, the applicant is ordered to be released on<br \/>\n\tbail on his executing personal bond of Rs.5,000\/- (Rupees Five<br \/>\n\tThousand only) with one surety of like amount before the trial court<br \/>\n\ton condition that he shall not leave India without prior permission<br \/>\n\tof this Court. Rule is made absolute.
