JUSTICE R.M. DOSHIT)<\/p>\n<p>\t  The writ<br \/>\npetitioners in above Special Civil Application No. 5722 of 2001<br \/>\nare the Union of India and Western Railways. The said petitioners<br \/>\nhave challenged the judgment and order dated 30th April,<br \/>\n2001 passed by the Central Administrative Tribunal, Ahmedabad<br \/>\n[hereinafter referred to as,  the Tribunal ] in<br \/>\nOriginal Application No. 125 of 1993.\n<\/p>\n<p>\t  The writ<br \/>\npetitioners in above Special Civil Application No. 3552 of 2001 are<br \/>\nthe employees of the Western Railways. They have challenged the<br \/>\ncommon judgment and order dated 30th April, 2001 passed by<br \/>\nthe Tribunal in Original Applications Nos. 555 of 1995; 567 of 1995;<br \/>\n568 of 1995 and 593 of 1995. The subject matter in both these<br \/>\npetitions is identical.\n<\/p>\n<p>\t  The<br \/>\napplicants before the Tribunal were the employees of the Western<br \/>\nRailways. In the year 1991, with the computerization, the Western<br \/>\nRailways required competent staff to man the Computer Reservation<br \/>\nCenters. Applications were invited from the existing staff of the<br \/>\nWestern Railways. Accordingly, the above referred employees had<br \/>\napplied for appointment in the Computer Reservation Centers. The said<br \/>\nemployees were given training. After receiving training, they were<br \/>\nposted in the cadre of Enquiry-cum-Reservation Clerks [hereinafter<br \/>\nreferred to as  the ECRC ] in the<br \/>\npay-scale of Rs. 1400-2300. After serving as such for sometime, in<br \/>\nthe year 1993, the Western Railways decided to call upon the said<br \/>\nemployees working in the ECRC cadre either to opt to continue in the<br \/>\nECRC cadre or for repatriation to their parent cadre. It is this<br \/>\ndecision of the Western Railways which was subject matter of<br \/>\nchallenge before the Tribunal below. \t  According to the applicants,<br \/>\ntheir appointment  in the ECRC cadre was permanent and there was no<br \/>\nquestion of their opting for repatriation to their parent cadre.<br \/>\nAccording to the Western Railways, the appointment made in the year<br \/>\n1991 was officiating appointment until regular staff was<br \/>\nselected and employed.\n<\/p>\n<p>\t It is not in<br \/>\ndispute that pending the applications before the Tribunal,  the<br \/>\napplicants continued to serve in the ECRC cadre; and they have<br \/>\ncontinued to serve as such pending the present writ petitions<br \/>\nalso. We are informed that some of the applicants have, upon reaching<br \/>\nthe age of superannuation, retired from service.\n<\/p>\n<p>\t In above view<br \/>\nof the matter, we are of the opinion that in view of passage of time,<br \/>\nthe cause of action does not survive. As the applicants  have served<br \/>\nin the ECRC cadre continuously since 1991, the question of their<br \/>\nrepatriation to their parent cadre should not arise. The petitions<br \/>\nhave become infructuous.\n<\/p>\n<p>\t The petitions<br \/>\nare accordingly disposed of. Rule nisi issued in each<br \/>\nApplication is discharged. The parties will bear their own<br \/>\ncost.
