The<br \/>\n\trespondent invited applications for the post of Class-III and IV<br \/>\n\temployees and selection committee has decided to appoint three<br \/>\n\tstrangers as Junior Octroi Clerk in the month of September, 1996.<br \/>\n\tThereafter, on 04th November 1996, the petitioner was<br \/>\n\tterminated from his service. On 02nd December 1996, the<br \/>\n\tpetitioner submitted an application stating therein that junior to<br \/>\n\thim is allowed to continue in service and therefore, he may be<br \/>\n\tallowed to continue in service according to his seniority. Hence,<br \/>\n\tpresent petition.\n<\/p>\n<p>It<br \/>\n\tis the case of the petitioner that the petitioner is qualified for<br \/>\n\tthe said post on regular and permanent basis as well as he has six<br \/>\n\tyears&#8217; experience, however, his case has not been considered. It is<br \/>\n\tfurther submitted that though the respondent-authority had filed an<br \/>\n\tundertaking before this Court in one another petition to regularize<br \/>\n\tservices of the petitioner on permanent basis as and when there is<br \/>\n\tvacancy, the same has not been complied with. It is further<br \/>\n\tsubmitted that the rojamdars who are junior to the petitioner are<br \/>\n\tcontinued in service and the service of the petitioner has been<br \/>\n\tterminated. Thus, the principal of &#8216;last come, first go&#8217; has not<br \/>\n\tbeen followed by the respondent. Hence, the present petition may be<br \/>\n\tallowed with all the reliefs prayed for therein.\n<\/p>\n<p>Mrs.Krina<br \/>\n\tCalla, learned Assistant Government Pleader, has relied upon the<br \/>\n\taffidavit-in-reply filed on behalf of the respondent, and has<br \/>\n\tsubmitted that the appointments have been made as per the<br \/>\n\tadvertisement were cancelled by the respondent as per the order of<br \/>\n\tthe Collector. However, in view of the order passed by this Court in<br \/>\n\tanother petition, they have been continued in service. Hence, the<br \/>\n\tpresent petition is required to be dismissed.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts and circumstances of the case, contentions<br \/>\n\traised by learned advocates for the respective parties and documents<br \/>\n\ton record, it transpires that the petitioner was serving as an<br \/>\n\tOctroi Clerk on daily wages. The function of Octroi collection was<br \/>\n\tentrusted to the Contractor. Thus, the staff appointed in the Octroi<br \/>\n\tDepartment has become surplus. The petitioner&#8217;s service is,<br \/>\n\ttherefore, terminated, which has become effective since November,<br \/>\n\t1996. Further, as stated by the learned advocate for the respondent,<br \/>\n\tthe other employees have been continued in service in view of the<br \/>\n\tdecision of this Court (Coram : M.R. Shah, J) rendered on 23rd<br \/>\n\tFebruary 2007 in Special Civil Application No.3561 of 1997.<br \/>\n\tFurther, since the said department is closed, there is no work of<br \/>\n\tRojamdar. Hence, there is no question of reinstating the petitioner<br \/>\n\tin service. Further, this Court vide order dated 17th<br \/>\n\tSeptember 1997 has refused the interim relief. Thus, the action of<br \/>\n\tthe respondent-authority in terminating the service of the<br \/>\n\tpetitioner is just and proper. I do not find any merits in the<br \/>\n\tpresent petition and the same is required to be dismissed.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, the present petition fails and is, accordingly,<br \/>\n\tdismissed. Rule is discharged with no order as to costs.
