JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 27\/01\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>\tRule.\n<\/p>\n<p>\tMr.Satyam Y.Chhaya, learned advocate, waives service of notice of<br \/>\n\tRule on behalf of the respondent. On the facts and in the<br \/>\n\tcircumstances of the case, and with the consent of the learned<br \/>\n\tcounsel for the respective parties, the petition is being heard and<br \/>\n\tfinally decided today.\n<\/p>\n<p>\tThis<br \/>\n\tpetition has been filed with a prayer to quash and set aside order<br \/>\n\tdated 02.03.2009 passed by the Trial Court below application at<br \/>\n\tExhibit 48 in Regular Civil Suit No.153 of 1999, whereby, the said<br \/>\n\tapplication filed by the petitioner (original plaintiff) under the<br \/>\n\tprovisions of Order 6, Rule 17 and Section 151 of the Code of Civil<br \/>\n\tProcedure ( the Code  for short) has been rejected.\n<\/p>\n<p>\tThe<br \/>\n\tbrief facts of the case are that the above-mentioned suit had been<br \/>\n\tfiled by the petitioner (original plaintiff), interalia, for grant<br \/>\n\tof permanent injunction, claiming certain easementary rights against<br \/>\n\tthe respondent. The suit was instituted on 14.10.1999. On<br \/>\n\t12.08.2008, the petitioner filed the application at Ex.48 praying<br \/>\n\tfor certain amendments in the plaint, incorporated therein. The said<br \/>\n\tapplication has been rejected by the impugned order, giving rise to<br \/>\n\tthe filing of the petition.\n<\/p>\n<p>\tMr.S.P.Majmudar,<br \/>\n\tlearned counsel for the petitioner, has submitted that the said<br \/>\n\tapplication has been rejected by the Trial Court mainly on two<br \/>\n\tgrounds. The first ground is that as per Section 65 of the<br \/>\n\tLimitation Act, the plaintiff is required to file such application<br \/>\n\twithin a period of three years. It is submitted that even assuming<br \/>\n\tthat the Court was referring to Article 65 of the Limitation Act,<br \/>\n\tthe said Article is not applicable in a suit for easementary rights.<br \/>\n\tThe second ground on which the application has been rejected goes to<br \/>\n\tthe very root of the matter and touches upon the merits of the case<br \/>\n\tas the reason for rejection is that no documentary evidence has been<br \/>\n\tproduced in support of the contention of the petitioner that the<br \/>\n\trespondent has put up doors and windows in his premises, thereby<br \/>\n\tcreating new easementary rights. It is submitted that the<br \/>\n\tapplication could not have been rejected on this ground as the<br \/>\n\tparties are required to lead evidence, even assuming that the<br \/>\n\tapplication might have been allowed.\n<\/p>\n<p>\tOn<br \/>\n\tthe other hand, Mr.Satyam Y.Chhaya, learned counsel for the<br \/>\n\trespondent, has submitted that the suit was instituted on 14.10.1999<br \/>\n\tand the Panchnama upon which the petitioner is relying was carried<br \/>\n\tout on 16.10.1999. The application is highly belated and there is no<br \/>\n\tmention in the said application regarding the reasons for the delay.\n<\/p>\n<p>\tI<br \/>\n\thave heard the learned counsel for the respective parties, perused<br \/>\n\tthe averments made in the petition and contents of the impugned<br \/>\n\torder.\n<\/p>\n<p>\tAt<br \/>\n\tthe very outset, for reasons stated hereinafter, this Court is not<br \/>\n\tinclined to go into the merits of the case. A perusal of the<br \/>\n\timpugned order, especially, paragraph-3 thereof makes it clear that<br \/>\n\tthe Court has relied upon  Section 65 of the Limitation Act<br \/>\n\twhile rejecting the application of the petitioner. Even assuming<br \/>\n\tthat the Court was referring to Article 65, the said Article is not<br \/>\n\tapplicable to the facts and circumstances of the present case, as it<br \/>\n\tlays down the period of limitation for adverse possession. The<br \/>\n\tsecond ground on which the application has been rejected is on the<br \/>\n\tmerits of the case which could not have been gone into by the Trial<br \/>\n\tCourt at this stage.\n<\/p>\n<p>\tAs<br \/>\n\tthe grounds on which the application has been rejected are not<br \/>\n\tgermane to the provisions of Order 6 Rule 17 of the Code and as the<br \/>\n\tTrial Court appears to have proceeded on an erroneous footing that<br \/>\n\tSection 65 (Article 65) of the Limitation Act is applicable, the<br \/>\n\tpetition is partly-allowed and the impugned order, having been<br \/>\n\terroneously passed, is quashed and set aside. The matter is remanded<br \/>\n\tto the same Court for fresh hearing of the application Ex.48, in<br \/>\n\taccordance with law. The Trial Court shall hear the respective<br \/>\n\tparties and pass a fresh order within a period of one month from the<br \/>\n\tdate of the receipt of the Writ of this Court. It is open to the<br \/>\n\tlearned counsel for the respective parties to urge all rights and<br \/>\n\tcontentions available to them, before the Trial Court. Rule is made<br \/>\n\tabsolute, to the above extent.
