(J)\n\nCITATION:\n 1994 AIR 1152\t\t  1994 SCC  (1) 373\n JT 1993 (6)   527\t  1993 SCALE  (4)556\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>The Judgment of the Court was delivered by<br \/>\nKULDIP SINGH, J.- Special leave granted.\n<\/p>\n<p>2.According  to the executive instructions dated May  20,<br \/>\n1980,  issued by the Central Board of Excise and Customs,  a<br \/>\nGroup &#8216;C&#8217; Officer, when transferred on his own request, from<br \/>\none Central Excise Collectorate to another, is not  entitled<br \/>\nto  count  the\tservice\t rendered  by  him  in\tthe   former<br \/>\nCollectorate for the purpose of seniority in the new charge.<br \/>\nThe  question  for  our consideration is  whether  the\tsaid<br \/>\nofficer\t is  further deprived of the said service  even\t for<br \/>\ndetermining  his  eligibility for promotion  to\t the  higher<br \/>\ncadre.\t The  Central  Administrative  Tribunal,   Allahabad<br \/>\nBench,\thas answered the question in the affirmative.\tThis<br \/>\nappeal\tby way of special leave is against the\tjudgment  of<br \/>\nthe Tribunal.\n<\/p>\n<p>3.Renu\tMullick,  the appellant, joined\t service  in  the<br \/>\nDirectorate  of Statistics and Intelligence, Central  Excise<br \/>\nand  Customs,  New  Delhi  on December\t17,  1974  as  Lower<br \/>\nDivision Clerk (LDC).  She was promoted to the post of Upper<br \/>\nDivision Clerk (UDC) on May 10, 1981.  She was\ttransferred,<br \/>\non her own request, to Allahabad by the Order dated July 30,<br \/>\n1987, and she joined as UDC on August 4, 1987 in the Central<br \/>\nExcise Collectorate at Allahabad.\n<\/p>\n<p>4.Executive  instructions dated May 20, 1980,  issued  by<br \/>\nthe  Central Board of Excise and Customs provide for  inter-<br \/>\ncollectorate transfers on the conditions specified  therein.<br \/>\nThe  relevant  conditions in para 2(ii) and para  3  are  as<br \/>\nunder:\n<\/p>\n<blockquote><p>\t      &#8220;2.  (ii) The transferee will not be  entitled<br \/>\n\t      to  count the service rendered by him  in\t the<br \/>\n\t      former   Collectorate  for  the\tpurpose\t  of<br \/>\n\t      seniority in the new charge.  In other  words,<br \/>\n\t      he  will\tbe treated as a new entrant  in\t the<br \/>\n\t      Collectorate  to which he is  transferred\t and<br \/>\n\t      will  be placed at the bottom of the  list  of<br \/>\n\t      the temporary employees of the concerned cadre<br \/>\n\t      in the new charge;\n<\/p><\/blockquote>\n<blockquote><p>\t      3.A  written undertaking to abide\t by  the<br \/>\n\t      requisite terms and conditions may be obtained<br \/>\n\t      from  the employees seeking  transfers  before<br \/>\n\t      the transfers are actually effected.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      5.    The\t  appellant   gave   the   necessary<br \/>\n\t      undertaking in the following words:<br \/>\n\t      &#8220;I  hereby  agree to and undertake  to  comply<br \/>\n\t      with the conditions detailed below:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">\t      376<\/span><\/p>\n<blockquote><p>\t      (1)My  seniority\twill be fixed  below  the<br \/>\n\t      last   temporary\t UDC   in   the\t   Allahabad<br \/>\n\t      Collectorate,  i.e.  I will be  treated  as  a<br \/>\n\t      fresh  entrant in the cadre of UDC in the\t new<br \/>\n\t      charge.\n<\/p><\/blockquote>\n<blockquote><p>\t      (2)No  transfer, travelling  allowance  and<br \/>\n\t      joining time etc., will be admissible to me as<br \/>\n\t      a result of this transfer.\n<\/p><\/blockquote>\n<blockquote><p>\t      (3)I  will  not be considered  for  further<br \/>\n\t      confirmation and promotion in the\t Directorate<br \/>\n\t      of  S  &amp; 1, Central Excise  and  Customs,\t New<br \/>\n\t      Delhi.\n<\/p><\/blockquote>\n<blockquote><p>\t      I\t will be adjusted against a  direct  recruit<br \/>\n\t      and unreserved vacancy in the grade of UDC.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      6.It  is\tnot  disputed  that  on\t joining<br \/>\n\t      Central  Excise Collectorate,  Allahabad,\t the<br \/>\n\t      appellant\t was  placed at the  bottom  of\t the<br \/>\n\t      seniority\t  list\t in  accordance\t  with\t the<br \/>\n\t      government  instructions\tquoted\tabove.\t The<br \/>\n\t      appellant\t does not make any  grievance  about<br \/>\n\t      the  fixation  of\t her seniority\tin  the\t new<br \/>\n\t      charge at Allahabad.\n<\/p><\/blockquote>\n<blockquote><p>\t      7.In  the year 1991, the\tappellant  along<br \/>\n\t      with  several  other UDCs was  considered\t for<br \/>\n\t      promotion\t to  the post of  Inspector  by\t the<br \/>\n\t      Departmental Promotion Committee in accordance<br \/>\n\t      with  the\t Central  Excise  and  Land  Customs<br \/>\n\t      Department Group &#8216;C&#8217; Posts Recruitment  Rules,<br \/>\n\t      1979  (the  Rules).   Rule  4  read  with\t the<br \/>\n\t      Schedule\t to   the  Rules   lays\t  down\t the<br \/>\n\t      eligibility  qualifications for  promotion  to<br \/>\n\t      the  post of Inspector.  The relevant  extract<br \/>\n\t      is reproduced hereunder:\n<\/p><\/blockquote>\n<blockquote><p>\t      &#8220;Inspector:Promotion  by\tselection  from<br \/>\n\t      UDC with 5 years service or UDC with 13  years<br \/>\n\t      of total service as UDC and LDC taken together<br \/>\n\t      subject to the condition that they should have<br \/>\n\t      put  in a minimum of two years of\t service  in<br \/>\n\t      the grade of UDC&#8230;.\n<\/p><\/blockquote>\n<blockquote><p>\t      Note  3: If a junior person is considered\t for<br \/>\n\t      promotion\t on the basis of his completing\t the<br \/>\n\t      prescribed  qualifying  period of\t service  in<br \/>\n\t      that  grade, all persons senior to him in\t the<br \/>\n\t      grade shall also be considered for  promotion,<br \/>\n\t      notwithstanding\tthat  they  may\t  not\thave<br \/>\n\t      rendered\tthe prescribed qualifying period  of<br \/>\n\t      service  in  that\t grade\tbut  have  completed<br \/>\n\t      successfully   the   prescribed\tperiod\t  of<br \/>\n\t      probation.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>\t      8.To  clarify Note 3 quoted above,  Office<br \/>\n\t      Memorandum  dated\t July 19, 1989,\t was  issued<br \/>\n\t      which is in the following terms:<br \/>\n\t      &#8220;When   juniors\twho   have   completed\t the<br \/>\n\t      eligibility   period   are   considered\t for<br \/>\n\t      promotion,   their  seniors  would   also\t  be<br \/>\n\t      considered  irrespective of whether they\thave<br \/>\n\t      completed the requisite service provided\tthey<br \/>\n\t      have  completed the probation period in  order<br \/>\n\t      to  ensure that seniors who might have  joined<br \/>\n\t      later   due   to\tvarious\t reasons   are\t not<br \/>\n\t      overlooked for promotion.&#8221;\n<\/p><\/blockquote>\n<p>9.On  November\t11,  1989, the\tappellant  and\t79  other<br \/>\ncandidates  were  promoted to the post\tof  Inspector.\t The<br \/>\npromotion  order  stated that the same was  provisional\t and<br \/>\nsubject\t to further revision or modifications, if any.\t The<br \/>\nappellant joined as Inspector at Allahabad and continued  to<br \/>\nserve in that capacity till the impugned order of  reversion<br \/>\nwas passed.  On February 20,<br \/>\n<span class=\"hidden_text\">377<\/span><br \/>\n1992,  the Additional Collector (P &amp; V), Central Excise\t and<br \/>\nCustoms, Allahabad, passed an order reverting the  appellant<br \/>\nfrom  the post of Inspector.  No reason was assigned in\t the<br \/>\norder\tof  reversion.\t No  opportunity,  whatsoever,\t was<br \/>\nafforded  to  the appellant before passing the\tsaid  order.<br \/>\nThe  appellant challenged the order of reversion before\t the<br \/>\nCentral\t Administrative\t Tribunal,  Allahabad.\t Before\t the<br \/>\nTribunal,  the respondents took the stand that\ton  transfer<br \/>\nfrom  Delhi  to\t Allahabad,  the  service  rendered  by\t the<br \/>\nappellant at Delhi was wiped off for all purposes  including<br \/>\nfor   determining  her\teligibility  under  the\t Rules\t for<br \/>\npromotion to the post of Inspector.  The Tribunal  dismissed<br \/>\nthe application of the appellant.\n<\/p>\n<p>10.We  are of the view that the Tribunal fell into  patent<br \/>\nerror  in  dismissing the application of the  appellant.   A<br \/>\nbare  reading  of para 2(ii) of the  executive\tinstructions<br \/>\ndated May 20, 1980 shows that the transferee is not entitled<br \/>\nto  count  the service rendered by him\/tier  in\t the  former<br \/>\ncollectorate for the purpose of seniority in the new charge.<br \/>\nThe later part of that para cannot be read differently.\t The<br \/>\ntransferee  is\tto  be\ttreated as a  new  entrant  it)\t the<br \/>\ncollectorate  to which he is transferred for the purpose  of<br \/>\nseniority.   It means that the appellant would come  up\t for<br \/>\nconsideration for promotion as per her turn in the seniority<br \/>\nlist  in  the transferee unit and only if she has put  in  2<br \/>\nyears&#8217;\tservice in the category of UDC.\t But when she is  so<br \/>\nconsidered,   her past service in the previous\tcollectorate<br \/>\ncannot\tbe  ignored  for the  purposes\tof  determining\t her<br \/>\neligibility  as per Rule 4 aforesaid.  Her seniority in\t the<br \/>\nprevious  collectorate\tis  taken away for  the\t purpose  of<br \/>\ncounting  her  seniority in the new charge but that  has  no<br \/>\nrelevance  for judging her eligibility for  promotion  under<br \/>\nRule  4\t which\tis a statutory rule.   The  eligibility\t for<br \/>\npromotion  has\tto be determined with reference\t to  Rule  4<br \/>\nalone,\t  which\t prescribes the\t criteria  for\teligibility.<br \/>\nThere\tis  no\tother  way  of\treading\t  the\tinstructions<br \/>\naforementioned.\t  If the instructions are read the  way\t the<br \/>\nTribunal has done, it may be open to challenge on the ground<br \/>\nof arbitrariness.\n<\/p>\n<p>11.The\tprovisions of the Rules reproduced above lay  down<br \/>\nthat  a\t UDC with 5 years&#8217; service or UDC with 13  years  of<br \/>\ntotal  service as UDC and LDC taken together subject to\t the<br \/>\ncondition that he should have put in a minimum of 2 years of<br \/>\nservice\t in the grade of UDC, is eligible to  be  considered<br \/>\nfor  promotion to the post of Inspector.  The  Rule  nowhere<br \/>\nlays  down that 5 years or 13 years have to be spent in\t one<br \/>\ncollectorate.\tThere is no indication, whatsoever,  in\t the<br \/>\nRule that the service period of 5 years and 13 years is\t not<br \/>\napplicable  to an officer who has been transferred from\t one<br \/>\ncollectorate  to another on his own request.  On  the  plain<br \/>\nlanguage  of  the  Rule the  appellant,\t having\t served\t the<br \/>\ndepartment  for\t more than 5 years as UDC  and\talso  having<br \/>\ncompleted  13  years  composite\t service  as  UDC  and\t LDC<br \/>\nincluding 2 years minimum service as UDC, was eligible to be<br \/>\nconsidered  for\t promotion to the post\tof  Inspector.\t The<br \/>\nTribunal  failed  to  appreciate  the  elementary  rules  of<br \/>\ninterpretation and fell into patent error in non-suiting the<br \/>\nappellant.\n<\/p>\n<p>12.The\tappellant  has stated in para II of  the  petition<br \/>\nthat  8\t persons junior to the appellant  were\tpromoted  as<br \/>\nInspectors.  According to her, even<br \/>\n<span class=\"hidden_text\">378<\/span><br \/>\nif  it is assumed that she was ineligible, she was  entitled<br \/>\nto  be\tpromoted in terms of Note 3 to the Schedule  to\t the<br \/>\nRules  (reproduced above) read with Office Memorandum  dated<br \/>\nJuly  19, 1989 (quoted above).\tThis argument has  not\tbeen<br \/>\ndealt  with by the Tribunal.  Prima facie there is force  in<br \/>\nthe  argument but it is not necessary for us to go into\t the<br \/>\nsame.\n<\/p>\n<p>13.  We\t allow\tthe appeal, set aside the  judgment  of\t the<br \/>\nCentral\t Administrative Tribunal, Allahabad, dated  June  1,<br \/>\n1992  and allow the application of the appellant before\t the<br \/>\nsaid Tribunal.\tWe quash the order dated February 20,  1992,<br \/>\nreverting  the\tappellant, Renu Mullick, from  the  post  of<br \/>\nInspector to the post of Tax Assistant.\t We direct that\t the<br \/>\nappellant shall be deemed to be continuing to hold the\tpost<br \/>\nof  Inspector  from the date when she originally  joined  as<br \/>\nInspector as a result of the promotion order dated  November<br \/>\n11,  1991.   She will be entitled to all  the  consequential<br \/>\nbenefits  including  full back wages.  The arrears  of\tback<br \/>\nwages  shall be paid to the appellant with 12% interest\t per<br \/>\nannum.\tThe appellant shall also be entitled to the costs of<br \/>\nthis litigation which we quantify as Rs 1 0,000.\n<\/p>\n<p><span class=\"hidden_text\">379<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Renu Mullick vs Union Of India (Kuldip Singh, J.) on 19 November, 1993 Equivalent citations: 1994 AIR 1152, 1994 SCC (1) 373 Author: K Singh Bench: Kuldip Singh (J) PETITIONER: RENU MULLICK Vs.
