LIMITED - Petitioner(s)\n \n\nVersus\n \n\nDHARMENDRASINGH\nKANAKSINGH - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nNANAVATI\nASSOCIATES for\nPetitioner(s) : 1, \nNOTICE SERVED for Respondent(s) : 1, \nMR\nRAJESH P MANKAD for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.K.RATHOD\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/07\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>Heard<br \/>\n\tlearned advocate Mr. Joshi appearing for Nanavati Associates on<br \/>\n\tbehalf of the petitioner, learned advocate Mr. RP Mankad on behalf<br \/>\n\tof the respondent.\n<\/p>\n<p>The<br \/>\n\taffidavit in reply is filed by the respondent and separate affidavit<br \/>\n\tunder Section 17B is also filed by the respondent, which has been<br \/>\n\treceived by the petitioner, against which no counter affidavit is<br \/>\n\tfiled by the petitioner.\n<\/p>\n<p>I<br \/>\n\thave considered the submissions made by both the learned advocates<br \/>\n\tand I have also perused the award in question.\n<\/p>\n<p>Considering<br \/>\n\tthe submissions made by both the learned advocates, the question<br \/>\n\tinvolved in this petition requires detailed examination.\n<\/p>\n<p>Hence,<br \/>\n\tRule. Ad-interim relief granted in terms of para 7(B) on condition<br \/>\n\tto comply Section 17B of the I.D. Act 1947.\n<\/p>\n<p>I<br \/>\n\thave considered the affidavit of unemployment filed by the<br \/>\n\trespondent workman and the Labour Court has granted reinstatement<br \/>\n\twith 10% back wages of interim period. That the workman is<br \/>\n\tunemployed and not a gainful employed, such affidavit is filed by<br \/>\n\thim and this Court is staying reinstatement award passed by the<br \/>\n\tLabour Court and against the affidavit of the unemployment, no<br \/>\n\tcounter is filed by the petitioner, therefore, the workman is<br \/>\n\tentitled the last drawn wages, as required under Section 17B of the<br \/>\n\tI.D. Act 1947. Therefore, it is directed to petitioner to pay last<br \/>\n\tdrawn full wages to the respondent workman with effect from 26th<br \/>\n\tSeptember, 2007 to 31st July 2008 within a period of one<br \/>\n\tmonth from the date of receiving the copy of the said order. It is<br \/>\n\tfurther directed to petitioner to pay last drawn full wages to the<br \/>\n\trespondent workman regularly till the matter is finally decided by<br \/>\n\tthis Court.\n<\/p>\n<p>Hence,<br \/>\n\tNotice as to interim relief returnable on 8.8.2008.<br \/>\n\tLearned advocate Mr. Mankad waives service of notice of rule on<br \/>\n\tbehalf of the respondent.\n<\/p>\n<p>However,<br \/>\n\tit is made clear by this Court that if the petitioner is having any<br \/>\n\tmaterial or concrete evidence of gainful employment of the<br \/>\n\trespondent workman in any establishment and receiving adequate<br \/>\n\tremuneration from the establishment, then it is open for the<br \/>\n\tpetitioner to file such application before this Court for<br \/>\n\tmodification of this order.
