Rule is discharged qua applicants no. 3 and 6.\n<\/p>\n<p> \tQua<br \/>\nrest of the applicants, Counsel for the applicants submitted that the<br \/>\napplicants have no other criminal antecedents. Investigation is over<br \/>\nand charge-sheet is filed. He drew my attention to the nature of<br \/>\nallegations in the complaint against the applicants and contended<br \/>\nthat the applicants are alleged to have attacked the family members<br \/>\nof the complainant with sticks and given random blows. He submitted<br \/>\nthat there is no material on record to suggest that the applicants<br \/>\ngave blows to any of the persons on the vital parts of the body<br \/>\ncausing serious injuries. He further pointed out that co-accused with<br \/>\nsimilar allegations have been released on bail by this Court by<br \/>\norders dated 19.11.2010 passed in Criminal Misc. Application<br \/>\nNos.12833 of 2010 and 12834 of 2010.\n<\/p>\n<p>\tIn<br \/>\naddition to above, I have also considered the materials on record,<br \/>\nwhich prima facie reveal that the death occurred due to sword blow<br \/>\ngiven by another accused.\n<\/p>\n<p> \tUnder<br \/>\nthe circumstances, when the charge-sheet is already filed, \u00a0the<br \/>\napplicants are ordered to be released on  bail in connection with<br \/>\nC.R.No.I-48\/2010  registered at<br \/>\nPansina police station, District Surendranagar, on their<br \/>\nfurnishing a bond of Rs.25,000\/- (Rupees Twenty Five thousand)  each<br \/>\nwith one surety of like amount to the satisfaction of the lower Court<br \/>\nand subject to following conditions that they shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of their liberty or abuse their liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of their residence at the time of execution of the bond<br \/>\nand shall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(f)<br \/>\n\tnot enter into Limbdi Taluka, except for attending the court cases,<br \/>\nwithout permission of the concerned court, till the trial is over;\n<\/p>\n<p>(g)\tmark<br \/>\npresence in Vadhvan police station on every 1st and 15th<br \/>\nday of English Calendar month between 11:00 am to 2:00 pm;\n<\/p>\n<p>(h)\tsurrender<br \/>\ntheir passport, if any, to the Lower Court immediately.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free  to take appropriate action in the<br \/>\nmatter.\n<\/p>\n<p>\tBail<br \/>\nbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tApplication<br \/>\nis disposed of accordingly. Rule is made absolute qua applicants no.<br \/>\n1,2,4, 5 and 7.
