KHARE\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t     J U D G E M E N T<br \/>\nNanavati ,  J.\n<\/p>\n<p>     The two  respondents were\tconvicted under\t section 302<br \/>\nread with  Section 34  IPC for\tcausing death of Shanku. The<br \/>\ntrial court  based their conviction upon the evidence of PWs<br \/>\n1,2,3 and  4. The  High\t court\tafter  reappreciating  their<br \/>\nevidence  set\taside  the   conviction\t and  acquitted\t the<br \/>\nrespondents.\n<\/p>\n<p>     The High  Court in its judgement has observed that upto<br \/>\na certain  point, the  prosecution version  and the  defence<br \/>\nversion are  the same  and, therefore, the only question was<br \/>\nwhether the  deceased and  PWs 1  and 3 were the aggressors.<br \/>\nAfter taking  into consideration  the fact  that all the eye<br \/>\nwitnesses were close relatives of the deceased and that they<br \/>\nhad not explained the injury on accused No.1, the High<br \/>\ncourt came  to the conclusion that it was not proved  by the<br \/>\nprosecution that  the respondents  were the  aggressors. The<br \/>\nHigh Court  further   observed that out of the two versions,<br \/>\nthe version of the defence was more probable. Thus accepting<br \/>\nthe defence  versions, the High Court allowed the appeal and<br \/>\nacquitted the respondents.\n<\/p>\n<p>     After scrutinising\t the evidence,\twe do  not find that<br \/>\nthe view  taken by  the High Court is unreasonable and calls<br \/>\nfor any\t interference by  this court. However, we would like<br \/>\nto say that the observation made by the High Court that even<br \/>\nif the\tprosecution evidence was believed, the accused could<br \/>\nhave been convicted only under Section 323 IPC and not under<br \/>\nSection 302, does not appear to be correct.\n<\/p>\n<p>     Subject to this observation, this appeal is dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India S.
