SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 10\/10\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> Shri Dipen Desai, learned Additional Public Prosecutor waives<br \/>\nservice of rule on behalf of the respondent-State.\n<\/p>\n<p>2.\tWith<br \/>\nthe consent of the learned advocates appearing on behalf of the<br \/>\nrespective parties, the application is taken up for final hearing<br \/>\ntoday.\n<\/p>\n<p>3.\tThis<br \/>\nis an application for bail under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with a criminal complaint being C.R. No. I<br \/>\n267\/2008 registered with Pandesara Police Station for offences<br \/>\npunishable under Sections  305, 498-A and 114 of the Indian Penal<br \/>\nCode and under Sections 3 and 4 of the Dowry Prohibition Act.\n<\/p>\n<p>4.\tShri<br \/>\nShakeel A. Qureshi, learned advocate appearing on behalf of the<br \/>\napplicant has submitted that the applicant is a lady having four<br \/>\nminor children and there is nobody to look after them as her husband<br \/>\nis also in jail in connection with the aforesaid complaint.  It is<br \/>\nsubmitted that the case of the applicant is required to be considered<br \/>\nindependently and separately from other accused and considering the<br \/>\nfact that the applicant is a lady and the investigation is already<br \/>\nconcluded and chargesheet is already filed, it is requested to<br \/>\nconsider the case of the applicant.  It is submitted that considering<br \/>\nthe above, the case of the applicant is distinguishable from other<br \/>\naccused.\n<\/p>\n<p>5.\tShri<br \/>\nDipen Desai, learned Additional Public Prosecutor appearing on behalf<br \/>\nof the respondent-State while opposing the present application has<br \/>\nsubmitted that merely because the applicant is a lady, discretion may<br \/>\nnot be exercised in favour of the applicant.  It is submitted that it<br \/>\nis apprehended that if the applicant is released on bail, the other<br \/>\naccused may claim parity and, therefore, the application may be<br \/>\ndismissed.\n<\/p>\n<p>6.\tConsidering<br \/>\nthe statement made on behalf of the parties and having regard to the<br \/>\ncircumstances and facts of the case, more particularly, considering<br \/>\nthe fact that the applicant is a woman having four minor children and<br \/>\nas there is nobody to look after them, to that extent, the case of<br \/>\nthe applicant is distinguishable from the other accused and,<br \/>\ntherefore,  the application is allowed and the applicant is ordered<br \/>\nto be released on bail in connection with Crime Register No. I-<br \/>\n267\/2008 registered with Pandesara Police Station on her<br \/>\nexecuting a bond of Rs.5,000\/- (Rupees Five Thousand only) with one<br \/>\nsurety of the like amount to the satisfaction of the lower Court and<br \/>\nsubject to the conditions that she<br \/>\nshall ;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of her liberty or abuse her liberty:\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution:\n<\/p>\n<p>(c)\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>(d)\tnot<br \/>\nlave the State of Gujarat without the prior permission of the<br \/>\nSessions Court concerned;\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of her residence at the time of execution of the bond and<br \/>\nshall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>(f)\tsurrender<br \/>\nher passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
