JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 23\/07\/2010 \n\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>\tRule.\n<\/p>\n<p>Mr.A.V.Prajapati, learned counsel, appears for the original claimants<br \/>\nas he appeared in the concerned First Appeals also and waives service<br \/>\nof notice of Rule on behalf of the original claimants.\n<\/p>\n<p>\tThe<br \/>\npresent applications are for interim injunction against the execution<br \/>\nand implementation of the common Award passed by the Reference Court<br \/>\nwhich is impugned in the First Appeals.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances, there shall be interim stay against the<br \/>\nexecution and implementation of the Award passed by the Reference<br \/>\nCourt which is impugned in the First Appeals, on condition that the<br \/>\napplicants deposit the entire awarded amount, together with costs and<br \/>\ninterest, with the Reference Court within a period of eight weeks<br \/>\nfrom today.\n<\/p>\n<p>\tWe<br \/>\nhave heard learned counsel appearing for both the sides on the<br \/>\naspects of withdrawal.\n<\/p>\n<p>\tConsidering<br \/>\nthe facts and circumstances, out of the amount which may be deposited<br \/>\nby the applicants pursuant to the above order, the original claimants<br \/>\nshall be entitled to withdraw 50% of the amount and such amount shall<br \/>\nbe paid to the claimants by the Reference Court by depositing the<br \/>\nsame in the concerned Bank Accounts of the original claimants through<br \/>\nelectronic mode. The remaining 50% of the amount shall be invested<br \/>\nwith the Nationalized Bank initially for a period of five years and<br \/>\nthe investment shall be renewable from time to time until the First<br \/>\nAppeals are finally disposed of.\n<\/p>\n<p>\tThe<br \/>\napplications are allowed to the aforesaid extent. Rule is made<br \/>\nabsolute in the above terms.
