JUDGEMENT\n<\/p>\n<p> 1.RULE.   Learned   A.P.P.,   Mr.S.J.Dave,        waived<br \/>\nservice of Rule for the respondent State.\n<\/p>\n<p>2.This petition under section 482 of the Code of<br \/>\nCriminal Procedure, 1973 is filed with a prayer to quash<br \/>\nthe F.I.R.   dated 20.6.2000 registered as C.R. No.I-86<br \/>\nof 2000 in Gaekwad Haveli Police Station and Criminal<br \/>\nCase No.725 of 2000 filed before the learned Metropolitan<br \/>\nMagistrate, Court No.12, Ahmedabad reporting the offences<br \/>\npunishable under sections 363, 366 and 376 of the Indian<br \/>\nPenal Code against the petitioner.\n<\/p>\n<p>3.It appears that the original complainant, the<br \/>\nrespondent No.2 herein, filed the aforesaid F.I.R.     on<br \/>\n20.6.2000   alleging    that the petitioner herein had<br \/>\nkidnapped his     minor   daughter,  namely,   Hamidabanu\n<\/p>\n<p>-respondent No.3 herein- under a false pretext that he<br \/>\nwould marry her and thereby committed the offences<br \/>\npunishable under sections 363 and 366 of the I.P.C.<br \/>\nDuring the course of investigation, it was noticed that<br \/>\nthe petitioner had physical relations with the respondent<br \/>\nNo.3 and, therefore, the offence punishable under section<br \/>\n376 of the I.P.C. was also added subsequently and, thus,<br \/>\nthe   chargesheet    has been filed for the aforesaid<br \/>\noffences.\n<\/p>\n<p>4.The learned counsel for the petitioner submitted<br \/>\nthat false allegations were made in the said F.I.R.   It<br \/>\nis also submitted that the petitioner actually wanted to<br \/>\nmarry the respondent No.3 and they both have married and<br \/>\ntwo children have also borne out of the said wedlock<br \/>\nwhich is still intact. The learned counsel, therefore,<br \/>\ncontended that no offence was made out and the aforesaid<br \/>\nF.I.R. resulting in the criminal case may be quashed.\n<\/p>\n<p>5.Learned counsel Mr.Buddhdbhatti, appearing for<br \/>\nthe respondent No.2-complainant, has chosen not to press<br \/>\nthe complaint in view of the fact that the respondent<br \/>\nNo.3 actually married the petitioner on her own volition.<br \/>\nThis clearly shows that it was her willingness and<br \/>\nconsent to have physical relation with the petitioner<br \/>\nwhen she was above the age of 16 years. Since the said<br \/>\nrelation took place on account of consent and willingness<br \/>\nof the respondent No.3 after their marriage, no offence<br \/>\ncan be said to have been made out which would be<br \/>\npunishable under section 376 of the I.P.C., according to<br \/>\nthe learned counsel.\n<\/p>\n<p>6.Learned A.P.P.,   Mr.S.J.Dave,   has,   after    going<br \/>\n through the papers of investigation, pointed out that the<br \/>\nrespondent No.3 voluntarily left the house of her father<br \/>\nrespondent No.2- and had voluntarily gone to stay with<br \/>\nthe petitioner.   They have married and two children have<br \/>\nalso borne out of the said wedlock. In this view of the<br \/>\nmatter, according to the learned A.P.P., no offence<br \/>\npunishable under sections 363 and 366 of the I.P.C.   can<br \/>\nbe said to have been made out against the petitioner.\n<\/p>\n<p>7.It is not in dispute that the victim of the<br \/>\nalleged offence had completed 16 years of age on the date<br \/>\non which the alleged offence was said to have been<br \/>\ncommitted.   When the petitioner and the respondent No.3<br \/>\nhave married and when they have two children borne out of<br \/>\nthat wedlock coupled with the fact that they are living a<br \/>\nhappy married life, it would be in the fitness of things<br \/>\nto exercise the inherent powers and jurisdiction vested<br \/>\nin this Court by section 482 of the Cr.P.C. for quashing<br \/>\nthe F.I.R. lodged and the consequent chargesheet filed<br \/>\nagainst the petitioner.\n<\/p>\n<p>8.In the result, the petition is allowed. The<br \/>\nF.I.R. dated 20.6.2000 registered as C.R. No.86 of 2000<br \/>\nin Gaekwad Haveli Police Station and Criminal Case No.725<br \/>\nof 2000 filed before the learned Metropolitan Magistrate,<br \/>\nCourt No.12, Ahmedabad against the       petitioner   are<br \/>\nquashed.
