No.39403 of 2010\n                                ASHOK KUMAR SAH\n                                         Versus\n                                  STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>2   16.3.2011               Heard learned counsel for the parties.<\/p>\n<p>                            Torture for demand of dowry soon before<\/p>\n<p>                the   death    within       seven    years       of    marriage      in<\/p>\n<p>                matrimonial house is the allegation. Death is<\/p>\n<p>                due to burn injury. Submission is that there was<\/p>\n<p>                no question to make any demand rather an account<\/p>\n<p>                was   existing        in    name    of     deceased         in   which<\/p>\n<p>                sufficient          money     was        deposited          by      this<\/p>\n<p>                petitioner. She was sole nominee of petitioner&#8217;s<\/p>\n<p>                insurance policy. Taking all the materials into<\/p>\n<p>                consideration while the matter was investigated<\/p>\n<p>                in earlier Jamui P.S. Case No.89\/09 the Police<\/p>\n<p>                submitted final form observing a mistake of fact<\/p>\n<p>                but   now    cognizance       is    taken    on       the    basis   of<\/p>\n<p>                complaint petition.\n<\/p>\n<p>                            Thus,    having       regard    to    the       facts    and<\/p>\n<p>                circumstances        of     the    case,    in    the       event    of<\/p>\n<p>                arrest or surrender within one month from the<\/p>\n<p>                date of communication of this order, the above<\/p>\n<p>                named petitioner shall be released on bail on<\/p>\n<p>                furnishing      bail        bond     of     Rs.        10,000\/-(ten<\/p>\n<p>                thousand) with two sureties of the like amount<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>     each to the satisfaction of Sri Abhishek Ranjan,<\/p>\n<p>     Judicial    Magistrate,    1st    Class,     Jamui        in<\/p>\n<p>     Complaint Case No. 471 C\/2010, subject to the<\/p>\n<p>     condition   as   laid   down   under   section    438(2)<\/p>\n<p>     Cr.P.C.\n<\/p>\n<\/p>\n<pre>AI                                     ( Mandhata Singh, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ashok Kumar Sah vs State Of Bihar on 16 March, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
