PATTANAIK (J)\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Delay condoned.\n<\/p>\n<p>     This SLP  has been\t filed\tagainst\t the  order  of\t the<br \/>\nCentral\t Administrative\t  Tribunal,  Madras  Bench  made  on<br \/>\nJanuary 30,  1996 in OA No.1470\/93. The admitted position is<br \/>\nthat the petitioner along with others came to be selected by<br \/>\ninternal  selection   for   promotion\tunder\t25%   quota.<br \/>\nUndoubtedly, the  process of  selection was  started in 1988<br \/>\nbut the\t incumbents actually joined the promotional posts in<br \/>\nOctober 1990.  Though the  process of  selection for  direct<br \/>\nrecruits under\t25% quota  reserved for\t the candidates from<br \/>\nupon market was started in 1989, they came to join the posts<br \/>\nafter completion  of the  selection process  earlier to\t the<br \/>\npetitioner &amp;  others in August 1990. The petitioners claimed<br \/>\nseniority over\tthem. The Tribunal has rejected their claim.<br \/>\nThus, this SLP.\n<\/p>\n<p>     It is  contended for the petitioners, relying upon Rule<br \/>\n302 read  with Rule  306 of the Indian Railway Establishment<br \/>\nMahual that  since the\tprocess of  selection had  been made<br \/>\nearlier to  the direct\trecruits, the petitioner is entitled<br \/>\nto seniority  over  the\t direct\t recruits  since  they\twere<br \/>\nselected earlier  to the  respondents and,  therefore,\tthey<br \/>\nshould be  made seniors\t to the\t direct recruits. We find no<br \/>\nforce in the contention. Rule 302 reads as under:\n<\/p>\n<pre>     \"302.    Seniority\t   in\t initial\n     recruitment   Grades    -\t  Unless\n<\/pre>\n<p>     specifically stated  otherwise, the<br \/>\n     seniority among the incumbents of a<br \/>\n     post in  a grade is governed by the<br \/>\n     date of  appointment to  the grade.\n<\/p>\n<p>     The grant\tof pay\thigher than  the<br \/>\n     initial pay  should not, as a rule,<br \/>\n     confer   on   a   Railway\t servant<br \/>\n     seniority\tabove\tthose  who   are<br \/>\n     already appointed\tagainst\t regular<br \/>\n     posts.  In\t  categories   of   post<br \/>\n     partially filled  by promotion, the<br \/>\n     criterion\tfor   determination   of<br \/>\n     seniority should  be  the\tdate  of<br \/>\n     regular promotion after due process<br \/>\n     in the  case of  promotees and  the<br \/>\n     date of  joining the  working  post<br \/>\n     after due\tprocess in  the case  of<br \/>\n     direct recruits  among  themselves.<br \/>\n     When the  dates  of  entry\t into  a<br \/>\n     grade of  promoted railway servants<br \/>\n     and direct\t recruits are  the  same<br \/>\n     they should  be  put  in  alternate<br \/>\n     positions,\t the   promotees   being<br \/>\n     senior  to\t  the  direct  recruits,<br \/>\n     maintaining  interse  seniority  of<br \/>\n     each group&#8221;\n<\/p>\n<p>     Note- In  case the\t training period<br \/>\n     of a direct recruit is curtailed in<br \/>\n     the exigencies of service, the date<br \/>\n     of joining the working post in case<br \/>\n     of such  a direct\trecruit shall be<br \/>\n     the date  we  would  have\tnormally<br \/>\n     come  to\ta  working   post  after<br \/>\n     completion of the prescribed period<br \/>\n     of training.\n<\/p>\n<p>     (No.E(NG) 1-78-SR-6-42  dt.7.4.1982<br \/>\n     ACS 132)<br \/>\nSimilarly, Rule 306 reads as under:\n<\/p>\n<blockquote><p>     &#8220;306.   Candidates\t  selected   for<br \/>\n     appointment at an earlier selection<br \/>\n     shall be  senior to  those selected<br \/>\n     later irrespective\t of the dates of<br \/>\n     posting, except in the case covered<br \/>\n     by para 305.&#8221;<\/p><\/blockquote>\n<p>     A reading\tof these  Rules would  clearly indicate that<br \/>\nthe  process  of  selection  bears  no\trelevance.  What  is<br \/>\nmaterial in  determination of the inter se seniority between<br \/>\nregularly promoted  in-service candidates and those selected<br \/>\nby direct  recruitment during  the process  of selection  is<br \/>\nthat in\t the case  of the  former the  seniority starts from<br \/>\ndate on\t which they joined the working post after completion<br \/>\nof the\tprocess while in case of direct recruits their inter<br \/>\nse seniority  would start from the date their entry into the<br \/>\ngrade. Therefore,  as regards  the direct recruits, the date<br \/>\nof first  entry and joining the post is the criteria, in the<br \/>\ncase of\t the promotees\tit would  be the  date on which they<br \/>\nstart working  in the  post after completion of the process.<br \/>\nIt is  not in dispute that training is one of the conditions<br \/>\nfor  completion\t of  the  process.  Until  the\ttraining  is<br \/>\ncompleted,  they   cannot  work\t on  regular  basis  in\t the<br \/>\npromotional post.\n<\/p>\n<p>     As regards\t Rule 306, it regulates in an area where the<br \/>\nselected candidates were appointed earlier to the candidates<br \/>\nwho  subsequently  came\t to  be\t selected  and\tthe  earlier<br \/>\ncandidates  become   seniors  to   the\tsubsequent  selected<br \/>\nirrespective of\t the  date  of\tposting.  That\tcriteria  is<br \/>\ninapplicable in\t determining the  inter se seniority between<br \/>\nthe  promoters\t and  the  direct  recruits.  The  Tribunal,<br \/>\ntherefore, was\tright in  rejecting the\t claim.
