Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :24\/05\/2010\n\n O R D E R\n<\/pre>\n<p>        THOTTATHIL B.RADHAKRISHNAN, J.<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>     R.P.106\/2010 in W.P.(C).12073\/2009-D<\/p>\n<p>= = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>      Dated this the 24th day of May, 2010.<\/p>\n<p>                     Order<\/p>\n<p>The State Government seeks review of the judgment<\/p>\n<p>dated 24th June, 2009 in WP(C).12073\/2009. The<\/p>\n<p>plea projected in this review application is that<\/p>\n<p>the view expressed in paragraph 1 of the judgment<\/p>\n<p>that the Town Planning Scheme in question has not<\/p>\n<p>been operational and with the passage of time, it<\/p>\n<p>has essentially turned obsolete, tends to impinge<\/p>\n<p>the rights of the State Government and the Local<\/p>\n<p>Self Government Institutions in so far as it may<\/p>\n<p>tend to apply to various other cases.   The issue<\/p>\n<p>raised was at the instance of the petitioners and<\/p>\n<p>the judgment is issued only by considering their<\/p>\n<p>case. Not only that, the effect of the decision<\/p>\n<p>of this Court in Padmini&#8217;s case, 1993(3) KLT 465<\/p>\n<p>relied on in the judgment sought to be reviewed<\/p>\n<p>has also been dilated upon during the course of a<\/p>\n<p>different review petition. In so far as this case<\/p>\n<p><span class=\"hidden_text\">RP106\/10               -: 2 :-<\/span><\/p>\n<p>  is   concerned, the  Government    had  carried an<\/p>\n<p>  appeal to the Division Bench and had withdrawn it<\/p>\n<p>  after arguing the matter for some time. Taking<\/p>\n<p>  all   the   relevant    facts   and   factors  and<\/p>\n<p>  submissions into consideration, it is ordered<\/p>\n<p>  that the statement in the judgment sought to be<\/p>\n<p>  reviewed to the effect that the Town Planning<\/p>\n<p>  Scheme   in   question     has  essentially  turned<\/p>\n<p>  obsolete would bind the State Government and the<\/p>\n<p>  Thrissur   Corporation      only as   against  the<\/p>\n<p>  petitioners and is not intended to carry any<\/p>\n<p>  precedential value.
