15.   16.11.2010.                 This petition under Article 226 of the<\/p>\n
                       Constitution of India in Public Interest has been filed by
\n                     2<\/span><\/p>\n
one International Human Rights Association, a Non-<\/p>\n
Government Organization.\n<\/p>\n
         It is the case of the writ petitioner that the<\/p>\n
Central Government has taken up a move to eradicate<\/p>\n
manual scavenging. Under the said move the State<\/p>\n
Governments are extended financial aid to construct<\/p>\n
toilets for urban poor and in rural areas and to convert<\/p>\n
the existing dry toilets to water-closets. For the purpose,<\/p>\n
adequate funds have been placed at the disposal of the<\/p>\n
State of Bihar.     In turn, the State Government has<\/p>\n
placed the funds at the disposal of the local authorities<\/p>\n
for that purpose. It is further stated that under the said<\/p>\n
scheme    the     State   Government     has   sanctioned<\/p>\n
construction of a number of new toilets and conversion<\/p>\n
of the existing toilets into water-closets under the<\/p>\n
District Panchayats.\n<\/p>\n
          This petition is related to the areas under<\/p>\n
Danapur, Fulwarisarif, Maner and Khagaul Nagar<\/p>\n
Parishads in Patna District. It is the complaint of the<\/p>\n
petitioner that without reference to the expense the<\/p>\n
contract has been awarded to one Samadhan Sewa<\/p>\n
Samiti, the respondent no. 20, (hereinafter referred to as
\n                      3<\/span><\/p>\n
`the Samiti’). The contract was awarded in the year<\/p>\n
2007. The construction \/ conversion work had to be<\/p>\n
completed within six months. Nevertheless, after more<\/p>\n
than three years not even 25% of the work is completed.<\/p>\n
What is completed is not according to the specifications<\/p>\n
and up to the standard. Nevertheless, the Samiti has<\/p>\n
been paid the money in advance. Thus, the concerned<\/p>\n
Nagar Parishads in connivance with the Samiti have<\/p>\n
misappropriated the funds allocated for the purpose.<\/p>\n
              The petition is contested by the concerned<\/p>\n
Nagar Parishads. According to each Nagar Parishad,<\/p>\n
the construction or conversion of toilets has been<\/p>\n
satisfactorily performed by the Samiti. It is, however,<\/p>\n
admitted that the work has not been completed as<\/p>\n
alleged. It is denied that the funds allotted were<\/p>\n
misappropriated or advance had been paid to the Samiti<\/p>\n
as alleged.\n<\/p>\n
              Learned Senior Advocate Mr Y.V. Giri has<\/p>\n
appeared for the Samiti. He has contested the petition.<\/p>\n
He has submitted that the petition is filed at the behest<\/p>\n
of one Sulabh International, a renowned institution<\/p>\n
carrying out sanitation works. The Sulabh International
\n                     4<\/span><\/p>\n
failed to win the contract which has enraged the said<\/p>\n
Sulabh International. The present petition in public<\/p>\n
interest is, therefore, not maintainable. He has referred<\/p>\n
to various figures placed on the record to submit that<\/p>\n
the substantial part of the work has been completed<\/p>\n
satisfactorily and that the remaining work is in progress.<\/p>\n
He has denied that the funds allotted for the purpose or<\/p>\n
any part of it has been misappropriated. He has<\/p>\n
submitted that only 25% of the funds have been paid to<\/p>\n
the Samiti. Mr. Giri has also submitted that the work<\/p>\n
performed by the Samiti has been supervised by the<\/p>\n
concerned Nagar Parishad. The Nagar Parishad has<\/p>\n
certified the satisfactory completion of the work. The<\/p>\n
State Government has also set up its own machinery to<\/p>\n
carry out inspection work and has opined that the work<\/p>\n
has been satisfactorily performed. No further enquiry<\/p>\n
is, therefore, necessitated.\n<\/p>\n
          It is true that various figures have been placed<\/p>\n
on the record. Each Nagar Parishad and the State<\/p>\n
Government have submitted that the work has been<\/p>\n
satisfactorily performed by the Samiti. However, it is<\/p>\n
not in dispute that the work, which was required to be
\n                    5<\/span><\/p>\n
completed within six months, has not been completed<\/p>\n
today after more than three years. Ordinarily, we would<\/p>\n
rest satisfied with the satisfaction recorded by the State<\/p>\n
Government or the local authorities. However, the writ<\/p>\n
petitioner has filed an additional affidavit and placed on<\/p>\n
the record a number of photographs which prompt us to<\/p>\n
order an enquiry in the matter. We, therefore, propose<\/p>\n
to form four committees to make physical verification<\/p>\n
of the number and the quality of toilets constructed by<\/p>\n
the Samiti at various locations (placed on the record of<\/p>\n
the writ petition from page 449 to 469). Each committee<\/p>\n
will cover the area of one of the concerned Nagar<\/p>\n
Parishads,    namely,        Danapur    Nagar   Parishad,<\/p>\n
Fulwarisarif Nagar Parishad, Maner Nagar Parishad and<\/p>\n
Khagaul Nagar Parishad. Each committee will comprise<\/p>\n
two representatives of the writ petitioner, one<\/p>\n
representative of the concerned Nagar Parishad, one<\/p>\n
representative   of    the    Central   Government,   one<\/p>\n
representative of the State Government and one<\/p>\n
representative of the Samiti. With the consent of the<\/p>\n
learned Advocates, we constitute the committees as<\/p>\n

         The petitioner will within five days from today<\/p>\n
deposit a sum of Rs. 10,000\/- (Ten thousand) in the<\/p>\n
registry of this Court by way of costs. The Registry<\/p>\n
will disburse a sum of Rs. 2,500\/- (Two thousand five<\/p>\n
hundred) to each of the committees to meet initial<\/p>\n
expenses. Further order for the costs and the<\/p>\n
remuneration to the members of the above committee<\/p>\n
will be made hereafter.\n<\/p>\n
         It is further directed that Sri Arun Kumar,<\/p>\n
Regional Chief, HUDCO, Patna will be the Chairman<\/p>\n
of each committee. He will hold the amount and
\n                           9<\/span><\/p>\n
        account for the expenses incurred by each committee.<\/p>\n
        He will coordinate the timings. Each member of the<\/p>\n
        committee will cooperate with the Chairman Sri Arun<\/p>\n
        Kumar. Each committee will submit its report within<\/p>\n
        three months from today.\n<\/p>\n
                  Stand over to 21st February 2011 for further<\/p>\n
        orders.\n<\/p>\n
                  Copy of this order be furnished to each<\/p>\n
